Total Ex Works Price (in words): Rs. 3,24,59,420/- (Rupees Three Crore Twenty Four Lakhs
Fifty Nine Thousand Four Hundred and Twenty only).
TERMS AND CONDITIONS:

1. PRICES:
Prices are firm, Ex-Works BHEL, EDN Bangalore.
Packing and forwarding charges - Nil. The prices, however exclude all taxes/duties leviable by
Central/State Governments and other Local authorities from time to time. All such taxes,
duties shall be payable extra at actuals as applicable at the time of supply. The prices quoted are
after taking into account the MODVAT benefits subject to all other Statutory Obligations.

2. TERMS OF PAYMENT:
10% of the PO value as Interest Free advance and balance 90% payment along with 100% taxes
on within 30 days from the receipt and acceptance of materials at site.

3. DELIVERY:
Delivery for the above items is 12 months. The delivery period mentioned in only for the
contractual purpose.

4. EXCISE DUTY:
The price quoted is exclusive of Excise Duty including Edn. Cess, which is payable extra by the
CUSTOMER, at the rate as applicable at the time of dispatch. The present rate is 12.5%.

BHEL is paying excise duty under various tariffs under the excise duty act, under self-removal
scheme and is paying lump sum Excise Duty periodically based on EXCISE INVOICES
(Loading advice Slips) for the period.

BHEL will be submitting only the self-authenticated excise invoice as per the latest Central
Excise Rule Nos. CER-53A and 173C and the CUSTOMER is requested to reimburse the ED
based on the excise invoice. Please note that separate Excise Duty Gate Pass cannot be
furnished.

5. SALES TAX:
The price quoted excludes sales tax/other taxes leviable by Central/State Government or any
other local authorities, which if applicable, shall be charged extra at the rate prevailing at the
time of dispatch. The present rate is CST @ 2% against Form “C”. Sales tax is applicable for
the amount of Basic price, Excise Duty & Educational cess which is payable extra by the
CUSTOMER.

6. OFFER VALIDITY:
Our offer is kept valid for placement of order till 22.06.2017.

7. DESPATCH:
The materials shall be dispatched by Road on “FREIGHT TO PAY” basis through BHEL
approved Transport carriers only.

8. MATERIAL RECEIPT, ACCOUNTING & STORAGE:

BHEL expects that the CUSTOMER to raise the documents towards Material Receipt,
Inspection & Accounting within a period of 15 days from the date of receipt of each
consignment.
 BHEL shall not own the responsibility on the delayed (Beyond 15 days after the receipt of
Goods) accounting of the consignments. The consignments booked under Transporters Godown
Delivery basis shall have to be collected within 3 days from the date of receiving the
information from the Transporter about the arrival of the consignment. No claim on account of
shortages, damages & loss of material shall be made on BHEL, since the Transporter had
booked the goods in good condition at the time of booking. All components shall have to be
received, inspected, accounted and stored in covered shed only. BHEL shall not own any
responsibility in event of open storage and subsequent damages if any on the supplied goods.

9. WARRANTY:
The material to be supplied against this Offer will be warranted against any manufacturing
defect or such defects arising out of bad workmanship or bad design, not otherwise, for a period
of 12 months from the date of commissioning or 18 months from the date of its supply
whichever occurs earlier.

10. TEST CERTIFICATE/CUSTOMER INSPECTION:

BHEL Test Certificate shall be submitted.

11. TRANSIT/STORAGE INSURANCE:

Transit Insurance of the materials shall have to be arranged by CUSTOMER only.
BHEL shall, however furnish the brief dispatch particulars immediately after the dispatch to
CUSTOMER’s underwriters / consignee. Please inform the details of CUSTOMER’s
underwriter while placement of PO without which BHEL will not be in a position to execute the
PO. Claims towards shortage/Damage; if any during the transit of goods shall have to be
claimed from CUSTOMER’s underwriters and not with BHEL. Any visible damage or
tampered packages of a consignment shall be properly surveyed by the CUSTOMER’s insurer
and claim made and at no point of time BHEL, shall be held responsible. No recovery on
account of Transit loss/Damage or during storage at CUSTOMER’s Stores/Plant shall be made
on BHEL.

12. REPLACEMENT OF GOODS BROKEN OR DAMAGED IN TRANSIT:

In the event of goods broken or damaged in transit then CUSTOMER will have to recover such
losses from the insurance company since the transit insurance is in CUSTOMER’s Scope. The
payment of damaged or broken goods should not be withheld till the replacement/rectification is
made. It should be released as per our payment terms only.

Claims if any on account of BHEL must be made within 15 days from the date of receipt of the
consignment, else the responsibility on the part of BHEL ceases. Damaged or broken goods
shall be replaced/rectified by BHEL at an extra cost and against a separate Purchase Order only
from CUSTOMER. Return of Goods mutually agreed between BHEL and CUSTOMER for
Replacement/Rectification by BHEL shall have to be booked to the Consignor on Freight
Prepaid and Door Delivery basis together with the Original Transporter Copy of Excise Invoice
of the earlier supplies for availing the Modvat

Benefits or reversal of the taxes/Duties paid, else the payment of Taxes/Duties shall have to be
made twice by the CUSTOMER. The Return of goods shall be done with the consent of BHEL
and within 45 days from the date of receipt of the consignment. BHEL shall not own the
responsibility in the event of any delay in this regard.
