Questions for Cross Examination of Lorna B. Mangat

Q01. In your judicial affidavit, you stated that you are an employee of XYZ
Bank?
A01. Yes

Q02. And you also stated that you are employed up to present?
A02. Yes

Q03. XYZ Bank has been established for more that 25 years, correct?
A03. Yes

Q04. It also issues documents when entering into transactions correct?


Yes

Q05. One of those transactions may include a contract of employment,


correct?
A05. Yes

Q05. But you did not present any document proving that you are or have
been an employee of XYZ Bank in your judicial affidavit correct?
A05. Yes

Q06. So, it can be said that you are not an employee of XYZ Bank since
there is no contract of employment, correct?
A05. Yes/No.

Q07. (If answer is No) But you have not presented a contract of
employment, you have no proof that you are indeed an employee of XYZ
Bank, and therefore, your testimony should not be admissible in evidence
for lack of foundation.

Q08. You said in your judicial affidavit that you knew Defendant Glenda
Huwebes in this case right?
A08. Yes
Q09. But you also stated that you only saw her once when she said came to
your office to transact a loan with you correct?
A09. Yes

Q10. You have not said in your judicial affidavit that you have seen her at all
after that correct?
A10. Yes

Q11. You also did not state that you met regularly with her?
A11. Yes

Q12. Then, by seeing her once, years ago, you can likely mistake her for
someone else, correct?
A12. Yes/No.

Q13. (If answer is No) Then, you can recall every client that goes in your
office just once to transact with you correct?
A13. No.

Q14. You said the defendant was able to obtain sums of money from the
Bank correct?
A14. Yes

Q15. You said it was in the amount of one million pesos, correct?
A15. Yes

Q16. Will you please read this portion of Section 68 in the Credit Rules
Handbook of XYZ Bank?
A16. “In case of a loan amount exceeding P 850,000.00, approval of the
general manager is needed in order for the said loan to be authorized.”

Q17. You, as the Loan Officer, approved the loan of Glenda Huwebes,
correct?
A17. Yes

Q18. In the Credit Rules Handbook of XYZ Bank, it is stated that when a
loan exceeds P 850,000.00, the signature of the general manager is needed.
But there was no signature of the general manager in the loan note, correct?
A18. Yes.
Q19. So, the loan should not have been approved, correct?
A19. Yes.

Q20. If the loan was not approved, Ms. Huwebes should not have received
any sum of money from the Bank, correct?
A20. Yes

Q21. You said in your judicial affidavit that you were one and a half meters
when the defendant affixed her signature in the loan note correct?
A21. Yes

Q22. But you did not state that you were facing her correct?
A22. Yes

Q23. You also did not state that you saw her actually sign the Loan Note
correct?
A23. Yes

Q24. You also stated in your judicial affidavit that you sent a second
demand letter to the defendant correct?
A24. Yes

Q25. But no attachments were made for the demand letter and its return
card in the judicial affidavit sent, correct?
A25. Yes
