MUTUAL SEPARATION AGREEMENT

Entered into between

QUAD OCCUPATIONAL HEALTH (PTY) LTD


(“HEREINAFTER REFERRED TO AS THE COMPANY”)

AND

NOBOMI FUYANA

PASSPORT NUMBER: GN042449


(“HEREINAFTER REFERRED TO AS THE EMPLOYEE”)

1. PREAMBLE:

1.1 In that prior to initiating retrenchment procedures, the parties agreed to part ways by means of
Mutual Separation.

The parties hereby agree as follows:

2. AGREEMENT:

2.1 The Employer will pay the employee:


2.1.1 Her salary to date (21 April 2020).
2.1.2 4 weeks’ notice pay (Up to and including the 19th of May 2020).
2.1.3 1 week’s Severance pay.
2.1.4 13.88 annual leave days.
2.1.5 Medical aid allowance of R800.

2.2 The total gross amount payable to the employee is R29 339,78.

2.3 The total severance package will thus be paid out when SARS gives feedback on the Tax
directive.

2.4 The payment will be made directly into the Employee’s current bank account.

2.5 The Employer will also apply for an IRP3 (a) document in order to obtain the monies as
stipulated in sub paragraph 2.1.3 Supra, tax free. The Employee understands that the
Employer has no control over SARS’s decision and will abide by their final decision.

2.6 The Employer will issue the Employee:


2.6.1 A good reference pertaining to her work performance.
2.6.2 An Unemployment Insurance Fund letter (UI19).
2.6.3 A certificate of service.
2.7 The Employee hereby agrees that:

2.7.1 Her last “physical” day of work will be 21 April 2020.


2.7.2 The employee will complete her notice period at home up to and including Tuesday 19 May
2020.

3. FULL AND FINAL SETTLEMENT

3.1 Both parties hereby agree that they enter into this agreement out of their own volition and
behest.

3.2 This agreement constitutes a full and final settlement between the parties and no party may
discredit another in any forum whatsoever after signing this agreement.

3.3 It is thus confirmed that there are no outstanding labour and/ or civil disputes between the
parties after signifying this document.

3.4 No other document may waive the terms and conditions of this agreement.

3.5 This agreement is binding on both parties and the terms and conditions thereof must be
strictly adhered to.

3.6 By signifying this document, both parties agree that they read and understood all the terms
and conditions of this agreement and that they will abide by it accordingly.
