2. It is fact that DM. Hamirpur has applied for extension in


working period of Lot No. 13,14 & 15/2017-18 vide his letter dated 10.5.2019.
The above letter of DM Hamirpur was misplaced inadvertently in Divisional
Office and could not be traced out after making best efforts, Keeping in view of
the position narrated above , the delay so caused in submission of case to your
office neither intentional nor willful. Hence, delay in this behalf may please be
regretted. Moreover, DM. HPSFDC, Hamirpur has already made a request vide
his letter No.Works-39/vol. IV/5717 datd 26.09.2019 ( photocopy enclosed) that
the extension in working period of above lots may be extended upto 31.12.2019
instead of 30.09.2019. Keeping in view of this, it is, requested that extension in
working period in respect of Lot No.13,14 & 15/2017-18 may kindly be granted
upto 31.12.2019, The statement showing the detail of lots duly signed is sent

service from 30.4.1994 has applied for the Proficiency Step Up. The case of said retiree
was sent to Pr. CCF, HP for the purpose, but the same has been returned with the
remarks that Shri Rajinder Suman was promoted as F.R. vide his o/o No. 251/83 dated
10.5.1983 and posted at HSD Yamunanagar. This office relieved him on dated 01.06.1983
F.N. as
Per entry at page 9 of his service book,he joined at Him sale depot YamunaNagar on 14-
06-1983(FN).As such his pay as Forest Ranger was required to be fixed w.e.f. 14.6.1983
with next date of increment on 01.06.1984. The pay allowed at RS. 775/- w.e.f. 10.5.1983
as per entry at Page-8 of the service book is not in order. Moreover the entry of pay
fixation order has not been made in the service book.
You are therefore, requested to attend the above observations and
made the necessary entry in the service book so that the case for the proficiency step-

2 In this regard it is submitted that RO Sadar was directed to inspect the
spot and submit the factual report to this office. As per report submitted by RO Sadar,
NTPC has constructed approach road to new bridge and power house diverted area. They
have constructed wire crates along the left bank on road to powerhouse. The wire crates
so constructed were found inadequate at some places. The mucks/debris found over
lapped the wire crates. The NTPC authorities were directed to take immediate
precautionary measures. The undersigned has also issued notice to the NTPC vide letter
No. 5703/RK dated 22.12.2003 (copy enclosed). This is for favour of your information

is no DR etc. is pending against her. Hence the case is hereby recommended for the
transfer of saw mill registration in the name of Smt.

Para-4 Admitted to the extent that vehicle was carrying Khair wood under export permit

No. 206/2003-04 dated 01.03.2004. However, the police has on checking found

the Truck No. HP-24-7783 transporting 1.7169 M3 excess Khair wood above the

permit/Challan. Hence it comes within the preview of illegal transportation of

forest produce. As such truck No. HP-24-7783 is liable to be confiscated to the

State of HP under IFA (HP IInd amendment) Act 1991.

2 In this connection it is intimated that the complaint was got
inquired into through RO Sadar and he has reported that as per demarcation of the area
given by the Forest Kanoongo, & Patwari, it was found that Sh. Babu Ram r/o Rajpura has
felled one Tun tree of IIB class and one dry Shisham tree of IV class illicitly from UPF
Rajpura, which is adjoining to his Malkiat land. (Photocopies of demarcation report and
revenue papers attached). In this connection, damage report was issued against Sh. Babu
Ram s/o Bhagwan Dass r/o Rajpura , and value of the trees, compensation & S/tax etc.
has been realized accordingly. The statements of Sh. Babu Ram and the complainant were
also recorded in the presence of the local people and complainant is satisfied with the

2 In this connection, it is intimated that the matter with respect to felling of
Safeda trees standing over the land of Animal Husbandry Department near the house of applicant, got
inquired into through RO Jhandutta, who has reported that two Safeda trees are standing over the land
of said department and these trees are of 25-30 years old, whereas the applicant has constructed the
house during 1998-99 and it seems that applicant has intentionally constructed the house adjoining the
said trees. Also the photos of the spot attached by the applicant clearly show that these trees are
standing on the spot prior to the construction of the house. Dy. Director Animal Husbandry, Bilaspur vide
his report dated 16.6.2004 (attached) has also verified these facts. Moreover, as per the report of RO
Jhandutta and Incharge, Animal Dispensary, Berthin (Photocopy enclosed), the grand father of the
applicant Sh. Barlaju Ram has encroached 1-15 Bigha land of the said department and a case is
pending in the court of law.
Keeping in view of the above facts the permission for the cutting of said
trees cannot be granted till the decision of the Hon’ble Court.

2) The certified copies of felling orders issued for felling of Khair trees from Swahan block of
Swarghat range by the order of Sh. HK Sarwata, IFS the then DFO Bilaspur during the year 2015-16 are
enclosed herewith (3 no). Besides this, no khair trees were felled from Govt. land of Swahan block
during the year 2015-16.
3) The felling of these private Khair trees during the year 2015-16 from Swahan block was not
under approved 10 year felling programme. As per felling order No. 8/2015-16 dated 17.12.2015, the
dry khair trees were allowed to fell from private lands of Swahan block in pursuance to H.P. Govt. letter
No. FFE-B(3) 4/99 dated 10.9.2002 (photocopy enclosed). Similarly, vide felling order No. 116/2015-16
dated 25.2.2016 and 208/2015-16 dated 14.3.2016, the khair trees were allowed to fell from orchard
land of various land owners of Swahan block in view of the instructions contained in HP Govt. letter No.
Fts.B-E(3)-10/98 dated 11.10.1999 (photocopy enclosed).
4) The departmental team for the enquiry of illegal felling of Khair trees from Govt. land in Naina
Devi Ji range is constituted and enquiry is going on. As and when the committee will complete enquiry,
the enquiry report will be supplied accordingly.

2. In this behalf, it is intimated that the land of applicants who have applied
for felling of khair trees falls within the jurisdiction of Bachhrettu block of Kalol range of this division
which was open for felling of trees from private land during the year 2014-15 under approved ten year
felling programme of Bilaspur forest division. Moreover, khair trees are standing on the land of these
applicants which could not felled since long time due to land dispute remain subjudice in the Court of
Law. Now the case has been decided and land owners have applied for felling of their khair trees
through above private sale contractor during the year 2018-19 in deviation of approved ten year felling
programme. But on the recommendations and suggestions made by CEC, the Hon’ble Supreme Court of
India vide its order dated 30.11.2009 passed in IA No. 2370 of 2008 has extended its order dated
8.5.2009 for felling of Khair trees from privately owned non forest areas with the following
conditions :-
1) No felling of trees including of khair trees from the forest area will be permissible in
violation of the Hon’ble Supreme Court order dated 12.12.1996.
2) No deviation from the ten year felling programme fixed by the Forest Department in
accordance with the provisions of the LPA, 1978 will be permissible.
3) No Katha/Kutch manufacturing until will be permitted to be established/allowed to
operate or to expand its capacity in violation of the Hon’ble Supreme Court orders dated
29/30-10-2002.
Further, as per advice of Law Department issued vide Govt. of HP letter
No. FFE-(B)-E(3)-38/2010 dated 7/12th Nov, 2013 copy received vide your office endst. No. D-VIII-
24(M)/6934-36 dated 27.11.2013, it has been clarified that felling of trees other than khair trees can be
carried out subject to the fulfillment of conditions mentioned in the order dated 8.5.2009/30.10.2009 or
in other words, no deviation from ten year felling programme fixed by the Department in accordance
with the provisions of Land Preservation Act, 1978 will be permissible in all circumstances. In this case
deviation from approved ten year felling progrmme is involved which is not permissible. Hence, this is
for favour of information and further necessary action please.

private land and there is no illegal trade/source of these logs, as such, you are advised to release these
logs in favour of said land owner and ensure that the land owner will use these 19 Khair logs having
26.6753M3 for his domestic use only. The land owner may strictly be restricted for commercial trade of
these logs.

Total 45 trees have been marked from Govt. land which are coming in
alignment of Chharol-Jattan to Manner road and have been handed over to
DM, HPSFDC for removal. But DM, HPSFDC, Hamirpur has reported that
some local people are claiming these trees on their private land. The matter
was got enquired by RO Sadar who has reported that these trees have been
marked from Govt. land duly identified by revenue authorities concerned as
per revenue record and no tree is marked from private land. At the time of
enumeration/marking of these trees none of local people have raised any
objection. Keeping in view of this DM, HPSFDC has again been requested to
exploit/fell these marked trees. Hence grievance is disposed of.

2 In this behalf, it is submitted that as per HP Govt. Notification No. Fts-


B-A (3)-1/77-III dated 19.10.2004, an amount of Rs. 250/- per quintal is to be realized on
account of export permit fee for export of Khair heartwood/Chips outside the State of Himachal
Pradesh. Similarly, Rs. 175/- per quintal is also levied for export of khair wood (with bark) out
of State. In case, the interested contractors are allowed to transport their khair wood to Kala
Amb Distt. Sirmour, HP through the shortest routes via Punjab and Haryana without being
realizing/levied the above export permit fee, then there are so many chances of pilferage above
export permit fee. As and when a vehicle loaded with khair wood will cross the boundaries of
the State and entered in Pubjab/Haryana State then there will be no check of the State Govt. to
ensure that the vehicle loaded with Khair wood will reach the factory established at Kala Amb
in HP or otherwise. The contractors who allowed export to Kala Amb via Punjab/Haryana
might sell their Khair wood in Punjab/Haryana States on higher rates other then offered by the
Katha Factory, Kala Amb Distt. Sirmour, HP without paying the above export permit fee to the
State. Resultantly, there will be huge revenue loss to the State. This is for favour of information
and further necessary action at your end please.

3. The reasons for stacking of these logs without prior permission of competent authority
for a long time i.e. from March, 2019 till date may also be explained.

lockdown period.

Memo:-

It is presumed that the field staff of your respective ranges is


undertaking regular visits to the forests under their control to protect plantations, to check the
cases of illicit felling, encroachments, illegal poaching and other forest offenses during the
lockdown period. In this regard directions were also imparted by the Pr.CCF (HoFF) during
video conference held on dated 16.4.2020 to ensure that the forest areas are regularly visited by
the forest field staff to preserve and protect forest wealth during the lockdown period.
Keeping in view of this, you are requested to obtain and keep on record
the daily reports of Deputy Rangers and Forest Guards containing details of areas visited and
cases of illicit felling, encroachment, illegal poaching and other forest offences and loss to the
forest wealth, if any noticed. It may please be ensured that the cases of illicit felling,
encroachment, illegal poaching and other forest offences, if any noticed may be reported to this
office along with action taken report thereon.
