DECLARATION CUM INDEMNITY

I, Mr. Ashok Ramji Pawar, being an Adult, Indian Inhabitant and presently residing at A-1/7,
B E S T colony, S V road, Santacruz West, Mumbai 400054 solemnly affirm, Declare, state
and Indemnify on solemn affirmation as hereunder

1) I, state and declare that by virtue of Deed of Mortgage dated 11/04/1952 executed by
and between Ratnabai Dosabhai Patel and Mr. Ramzan Allauddin Mistry the said
2) RatnabaiDosabhai Patel created mortgage in favour of Mr. Ramzan Allauddin Mistry in

respect of the property bearing Non Agricultural serial no 326, and bearing corresponding

plot bearing CTS no’s C/904, admeasuring 111.2 square meters, and CTS bearing no

C/905 admeasuring about 310 square meters and CTS bearing no. C/906, admeasuring

about 1244,2 square meters and in all area admeasuring about 1656,4 square meters and

being situated at Village Bandra, Taluka Andheri and located at ZIGZAG road, Bandra

West, Mumbai and in the registration District of Mumbai Suburban, (herein after being

referred to as the said Property and a more better particulars of the same are described in

the Schedule hereunder written).

3) The aforesaid Deed of Mortgage is registered with the Sub Registrar of Assurances under

serial no BOM-R 854 /1952 registered as on 12/03/1953. A copy of the aforesaid Deed of

Mortgage dated 11/04/1952 is being attached hereto and the same is marked as “EXH A”

4) A copy of Index II of the aforesaid Deed of Mortgage is also attached hereto and the

same is marked as “EXH B”.

5) In the circumstances and by virtue of the aforesaid deed of Mortgage dated 11/04/1952,

aforesaid Mr.Ramzan Allauddin Mistry is well and sufficiently entitled to the said

property more particularly described in the Schedule herein written.

6) I am duly authorised to by the virtue of Mr. Ramzan Allauddin Mistry to incorporate his

name in the revenue names and represent him before all concerned authorities.

7) I am making this declaration for the purpose of submitting the same before the concerned

land revenue authorities for effecting the transfer of names in respect of the said property

in favour of Mr. Ramzan Allauddin Mistry and Mrs. Sakina Ramzan Mistry in respect of

the said property more particularly described in the Schedule herein written.

8) As per the property register cards, area of the said property is approx. 1656.4 square

meters. The copies of Property Register cardsare attached herewith and the same is

marked as “EXH C”.


9) Whatever stated herein above is true and correct.

THE SCHEDULE OF THE PROPERTY ABOVE REFFERED TO

ALL THAT PIECE OR PARCEL OF OWNERSHIP LAND bearing Non Agricultural serial no

326, and bearing corresponding plot bearing CTS no’s C/904, admeasuring 111.2 square meters,

and CTS bearing no C/905 admeasuring about 310 square meters and CTS bearing noC/906,

admeasuring about 1244,2 square meters and in all area admeasuring about 1656,4 square

meters and being situated at Village Bandra, Taluka Andheri and located at ZIGZAG road,

Bandra West, Mumbai and in the registration District of Mumbai Suburban District.
