AFFIDAVIT OF WITNESS

I, ARIEL CHAVEZ, age, civil status, resident of Unit 2A, Marvilla

Residences, Arellano Avenue corner C.M. Ayala Street. Manila, Philippines. after
having sworn in accordance with law, do hereby depose and state THAT:

1. On April 30, 2020, I was shocked to read the malicious posts, comments,
conversations and remarks imputed against ATTY. MELANIE OBRIQUE-
GUEVARRA by my FB friends, respondents MARYJANE L. DAGOHOY,
CHERRY LYN S. DACASIN, JENNY ANNE S. CHUA and ANNIE LIZA
LABINDAO YEBAN, who were maliciously chatting with co-respondents
JESILLA GUANTIA aka JZHYLLE AITNAUG and GERTRUDES P.
BILLIONES aka SABEL KULOT BILLONES.

2. For six (6) days from April 30, 2020 to May 5, 2020, I also started receiving
screen shots of those libelous remarks posted by respondents against Atty.
Guevarra on their facebook accounts from several FB friends. In fact, my
said FB friends kept on asking me if what the respondents were saying
against Atty. Guevarra were indeed true.

3. So, I read further the public conversations of respondents posted on their

facebook accounts and saw that Atty. Guevarra was made by respondents to
be their laughing object and the subject of their ridicule with a clear
intention to embarrass, humiliate and destroy Atty. Guevarra.

4. Respondents called Atty. Guevarra tanga, pulpol, brenda, brainless,

shameless and told everyone on facebook that Atty. Guevarra is suffering
from mental disorder and nervous breakdown, ang utak nasa talampakan”,
“kailangan ng total rehab”, dinidilaan ang bakas ng iba para mabuhay,
nangangapitbahay para maghagilap ng makakain and a pathetic loser.

5. Further, Atty Guevarra was portrayed to be a lawyer with no client, no

income and a lawyer who never wins her case.

6. I got so upset because I have some clients referred to Atty. Guevarra. In fact,
I really got bothered at first because I feared she might really be suffering
from mental disorder and could not be able to handle her cases.

7. Even though I knew that Atty. Guevarra was never committed in any mental
hospital, since we have been friends for a long time, still, respondents’ daily

 posts on facebook telling everyone that Atty. Guevarra was suffering from
mental disorder, created doubts in my mind as to Atty Guevarra’s mental
state.

8. But upon gathering facts why the respondents started posting those
disturbing remarks against Atty. Guevarra, I realized that they just got angry
when Atty. Guevarra posted the public speech video of our Mayor in
Buruanga Aklan.

9. I also realized that respondents were out merely to destroy the reputation of
Atty. Guevarra despite the fact that Atty. Guevarra did not do anything to
provoke them. Posting a video on facebook with a mere caption “Speech of
Mayor Concepcion Labindao during SAP Distribution in Poblacion,
Buruanga, Aklan” could never be a reason to attack and humiliate any
person in public.

10.So, amid their libelous posts, I called Atty. Guevarra and asked her to do
something about it because I feared that her friends and clients would doubt
her state of mind, character, status and condition if he would do nothing to
clear her name or to stand up for herself especially that she is a lawyer.

11.I executed this affidavit to attest the truthfulness of the foregoing facts
according to my own understanding of what I had read, and to support the
filing of Criminal Cases against ATTY. MELANIE OBRIQUE-
GUEVARRA for violations of Section 4 (c)(4) of R.A. No. 10175, also
known as the Cybercrime Prevention Act of 2012.

12.AFFIANTS SAYETH NAUGHT.
