AFFIDAVIT FILED BY THE CAVEATOR

I, Vakacherla Malleswara Rao S/o Apparao, Hindu, aged 50 Business, Kakinada do

hereby solemnly and sincerely affirm and state as follows:-

1. I am the 1st caveator herein and well acquainted with the facts of the case. I submit

and pray that the Hon'ble court may be pleased to read the caveat filed by us as part of this

affidavit.

2. The 1st respondent preferred A.S.No.244 of 2004 on the file of VII Additional District

Judge, Kakinada. The said appeal has been dismissed by the Hon’ble court. We are

apprehending that the respondents may initiate appeal before the Hon'ble court and obtain

exparte order by misrepresenting the facts of the case since few days. We are ready to

appear through our advocate. If the respondents obtain any exparte order, we will be put to

irreparable loss. Hence, in the interest of justice I submit and pray that the that the

Hon'ble court may be pleased to lodge the caveat and orders notice on all applications filed

or going to be filed against the judgement and decree dated 31.10.2006 in A.S.No.244 of

2004 on the file of VII Additional District Judge, Kakinada before granting exparte order by

the Hon'ble court to our advocate Sri V.L.N. Gopalakrishna Murthy, Advocate, 106 Expresso

Apartments, A Block, Laki-di-ka-pool, Hyderabad. Else we suffer serious and irreparable

loss.
