I, Challa Venkata Kala Sai Jayabharathi Devi w/o Ch. V.B. Krishna Rao

Hindu aged 44 years Housewife, House No.2-26 Bhogapuram Village, Via

Gollaprollu. Pithapuram Mandal. East Godavari District do hereby solemnly

and sincerely affirm and beg to state as follows:

1. I am the caveator herein and I am well acquainted with the facts of the

case.

2. I submit that I filed O.S.No. 264 of 1999 on the file of the Court of the

Principal Senior Civil Judge Kakinada, under Order 7 Rule 1 Code of Civil

Procedure which suit has been for partition of the joint family properties and

the said suit has been decreed in part on 17.9.2005. Against the judgement

and decree in O.S.No. 264 of 1999 on the file of the Court of the Principal

Senior Civil Judge Kakinada I preferred A.S. 173 of 2005 on the file of VII

Additional District Judge Kakinada and the respondent herein filed A.S.No.64

of 2006 on the file of VII Additional District Judge Kakinada. The two appeals

have been commonly disposed on by judgement and decree dated 8.3.2010

wherein the Hon'ble Court was pleased to allow A.S.No.173 of 2005 and

dismiss the appeal A.S.No. 64 of 2006. Aggrieved by the same the

respondent is contemplating to prefer second appeal before this Hon’ble

Court and is trying to obtain interim orders behind our back. I am interested

in opposing any Stay petition in S.A.

3. Hence, it is humbly prayed that this Hon’ble Court may be pleased to

issue notice to the Counsel for Caveators’ Mr. V.L.N.G.K. MURTHY & SUBBA

REDDY S., Advocate, before passing any orders in any C.R.P.M.P. in S.A.

filed by the respondent herein against the judgement and decree dated

8.3.2010 in A.S.No.64 of 2006 on the file of the Court of the District Judge,

Kakinada, East Godavari District and pass such other order or orders as are

deemed fit and proper.
