Contract Documents used in Construction

 A pre-requisite to start working on the site is an


understanding of the documents used in construction.

Contract documents are the written and graphic


documents prepared by the A/E, for:

 Communicating the project design for construction.


 Administering the construction contract.

 The contractor signing the agreement with the owner is


responsible for completing the work according to the
contract documents.

Contract Documents used in Construction

 Contract documents include:


1 Drawings: include graphic illustrations of the
physical form of the work to be performed.


2 Specifications: include the quality requirements for
products, materials, and workmanship performance
of the project.


3 Contracting Requirements: include the agreements,
the general and supplementary conditions,
revisions, modifications and change orders.

Contract Documents used in Construction


Drawings

 Drawings illustrate the relationships between the


elements, as well as their quantities, locations,
dimensions and shapes.

 Paper drawings are two-dimensional by their nature.

 Plan views are drawings that show the horizontal


layout, as if one is looking down on the subject.

 Plan views do not convey information about the vertical


dimensions.

 Other views such as elevations and sections provide a


view looking perpendicular to the horizontal plane.

Drawings
 Communicating the information accurately may require
multiple views.

 A 3D paper drawing can show the elements in a single


view (isometric or perspective views), but one cannot
see every view possible in one drawing.

 The limitation of a single view leaves many portions of


the work unseen.

 These types of views require the user to imagine what


is happening in the three dimensions of the space.

Types of Drawings

 There are several types of drawings.

 Each type serves a different purpose.

These types of drawings include:

 Contract drawings
 Shop drawings
 Coordination drawings
 As-built record drawings

Drawing Types – Contract Drawings

 Contract drawings are those named in the agreement


between the owner and the contractor.
Example: The compete set of drawings for a project may include:

 8 Architectural Drawings
 9 Structural Drawings
 5 Mechanical Drawings
 3 Electrical Drawings

 They document the extent of the scope of work (either


removal or construction of work).

 They are complementary with the specifications.

Drawing Types – Shop Drawings

 Shop drawings are


prepared by manufacturers,
suppliers, sub-contractors,
and contractors to illustrate
a detailed portion of the
work to be incorporated into
the project.

 They are required by the


specifications, and are
reviewed by the A/E.

Drawing Types – Coordination Drawings
 The information provided by sub-contractors and the
contractor are brought together to coordinate the
utilization of limited space.

 Coordination drawings are used for MEP (Mechanical,


Electrical and Plumbing) systems, and they illustrate
the actual dimensions of the elements.

 These drawings help determine how the elements will


actually fit in the space available.

Drawing Types – Coordination Drawings
 Without coordination drawings, the installation of each element
may require that the next element fit in the remaining space.

Drawing Types - As-built Record

 The owner may require the development of as-built


record drawings by the contractor to reflect the actual
performed construction.

 The contract documents indicate the type of


information required on the record drawings, such as
concealed conditions and utility locations.

 These as-built record drawings are submitted through


the A/E to the owner as a permanent record of the
actual conditions of the completed work.

Specifications

 Specifications are written description of the work to be


performed and are prepared by the A/E.

 The specifications may be simple notes on a drawing


or more detailed descriptions.

 The specifications are organized in accordance with


the Construction Specifications Institute (CSI)
MasterFormat.

 The MasterFormat establishes the organizational


structure for the documents that will be used to realize
the project. It is organized into 50 divisions.

Specifications

The specifications serve to:


 Identify the specific requirements for each material or
component along with the relevant standards.
 Indicate the required submittal information.
 Specify the QC provisions.
 Indicate the requirements for product storage, handling,
and installation.
 Indicate specific sequencing or scheduling requirements.
 Specify product warranties.
 Indicate the requirements for preparation and protection
of work.

Contracting Requirements - Agreements

 The signed documents by the owner, A/E and the


contractor are legal agreements that binds these
parties to the contract.

 Typical agreements included in the contracting


requirements include:
 Owner-A/E agreement: refers to the role, responsibilities
and expectations of the Owner and the A/E.

 Owner-contractor agreement: refers to the role,


responsibilities and expectations of the Owner and the
Contractor.

 The conditions of the contract consist of the general


conditions and the supplementary conditions.

 The general conditions of the contract include:


1. General provisions and definitions.
2. Owner's responsibilities.
3. Contractor's responsibilities.
4. A/E's responsibilities.
5. Sub-contractors (definition and relationships).
6. Construction by owner or separate contractors.
7. Changes in the work.
8. Contract time.
9. Payments to contractor and completion of work.

10. Protection of persons and property.


11. Insurance and bonds.
12. Correction, removal, or acceptance of defective work.
13. Suspension of work and termination of the contract.
14. Claims and disputes.

 The contract parties should be familiar with the terms


of the general conditions of the contract.

Contracting Requirements - Conditions

 The standard general conditions are normally modified


for the specific project by the supplementary
conditions.

 The supplementary conditions of the contract include:


1. Work performance.
2. Progress payments.
3. Wage rate requirements.

 The contract parties are required to understand their


responsibilities to ensure their adherence to the
general and supplementary conditions.

Revisions (Addenda Items)

 Typically, an addendum is issued before receiving the


quotations for the project to describe any revisions
made before signing the agreement.

 Addenda are written or graphic information issued to


clarify, revise, add to, or delete information in the
original procurement documents, or in previous
addenda.

 Addenda items should be enforced by the A/E during


the administration of the contract.

Modifications (Change Orders)

 Contract modifications include modifications after the


construction agreement has been signed and may
include additions to, deletions from, or modifications of
the work to be done.

 These are accomplished by change orders.

 Change orders can be issued at any time during the


contract period.

Contracting Requirements - The Bid Proposal Form

 Once the drawings and the specifications are prepared


by the A/E, and the owner becomes aware about the
project cost and duration, a bid proposal form is
designed by the A/E.

 The bid proposal form contains an explanation of the


construction services offered by the contractor at an
estimated cost to the owner.

 It is used to indicate the contractor’s intent to bid for a


contract to complete the work specified.

Contracting Requirements - The Bid Proposal Form

 When the bid proposal form is signed and submitted by


the contractor, it can be accepted as a bid in the
contracting process.

 The bid proposal form includes key points related to


the completion of the project, including the time for
completion, total cost, and materials needed to
complete the project.

 The prices at which the work will be completed can be


stated either as a lump-sum or as a unit-price figures.

Contracting Requirements - The Bid Proposal Form

 The proposal form indicates also that the contractor


should begin the work within few days after receiving a
written notice of award of contract.

In fact, the details provided in the bid proposal form are


designed to provide sufficient information to allow the
contractor to make a decision on whether to bid or not
to bid for the project.
