Reason for Referral: Both parents died in a vehicular accident. No known

The name of the child as indicated in the birth certificate is Roberta C.


Bayag, who was born as a healthy baby girl. She is fondly called by
everybody with her nickname “Bobbie”. Roberta or Bobbie to many, was
born July 13, 2015 at Brgy. Kalunasan Health Center, Cebu City.
She is the legitimate daughter and only daughter of Honey Boy Bayag
and Jeanette Cruz-Bayag who are married to each other as evidenced by the
marriage certificate. Honey Boy Bayag and Jeanette C. Bayag are residents
of Brgy. Kalunasan, Cebu City. Prior to their accident that caused their
demise they live in a rented apartment and can be considered as middle
income earner family based on the standard of our living in the city of Cebu
as both parents are income earners and regular to their jobs.

On the death of her parents, Bobbie's custody was given to the DSWD
which was received by Rebecca P. Geamala who is the director of DSWD
Field Regional Office 7, Cebu City, Region 7. Bobbie was then housed in
Sunny Bright Children’s Home, an accredited home for children by DSWD
which homes children that are legally available for adoption.
It was then on December 29, 2019, where spouses Ethan Del Rosario
and Joy Marie Abella Fabregas-Del Rosario decided to visit Sunny Bright
Children’s Home with the hope of finding a child that they can adopt. Upon
interview of the spouses, a few matches for their preference were found.
After the interview, the spouses were given the chance to meet the children
personally and small introductions were made with the chosen matches.
However, the attention of the spouses was caught by Bobbie. At first she
was shy due to the trauma of losing both of her parents but at the same time
after a short chat with Bobbie the spouses discovered that she has this
positive and bright personality of which they decided that this was the child
that they wanted to adopt.
On January 17, 2020, the Pre-Adoption Placement Authority of
Bobbie was approved with Rebecca P. Geamala as the director of DSWD. It
was also approved and given consent by Sr. Mary John Trinidad, the head
of the Sunny Bright Children Home. After the arrangement and consultation
and briefing of the both parties the custody of Bobby was then given to
prospective parents for the trial custody period which started January 27,
2020. A court social worker was then assigned who is in-charged in matters
relating to adoption assessment to conduct the assessment report of the three
(3) month trial custody period for the compatibility of the adoptive parents
and the adopted child and to established if the family will be the for the best
interest of the child.

II. SOURCES OF INFORMATION AND


CIRCUMSTANCES OF THE REFERRAL

On October 15, 2019, Barangay Captain Lito Bandera of Brgy.


Kalunasan Cebu City, approached Rebecca P. Geamala, Department of
Social Welfare Field Office Region 7 Director to surrender the custody of
the child Roberta Cruz Bayag fondly called as Bobbie, who was orphaned
upon the death of both of her parents on October 9, 2019 vehicular accident
in Metro Cebu Express Highway. The jeep her parents rode upon going
home was rammed by an over speeding panel truck which lost its control
hitting the jeep which was ahead of the said panel truck killing the driver
and the passengers due to impact. Among the identified passengers were
Bobbie’s parents, Honey Boy Bayag and Jeanette Cruz-Bayag.
During the period of the wake of her parents, Bobbie was taken care
of the family of the landlady they are renting, Mrs. Anja Durias. Mrs. Durias

also helped facilitate the burial of the spouses Bayag as there were no known
family members of her parents in the barangay. According to the
information, Barangay Captain Lito had gathered from the neighbors, friends
and colleagues of the couple Bobbie’s mother Jeanette or Jea to many, came
from Guinan, Eastern Samar and the only child. She lost both of her parents
in Bagyong Yolanda who hit the Easter Visayas area which includes Guinan
on November 8, 2013. In the middle of 2014 she decided to move to Cebu
City to look for a brighter future and rebuild a life away from the painful
memories where she then met his husband. The father Honey Boy or was
commonly called as Honi by people who knew him, was born and raised in
Argao, Southern Cebu. He is the only child of his parents and his father was
known to have involvement in illegal drugs in the town and during a raid
made by the Philippine Drug Enforcement Agency and PNP his father was
killed in the accident. This incident also leads to his mother’s heart attack
which killed her. Due to the unfortunate events that have happened, Honi
stopped attending college in the University of Visayas and decided to look
for a job to support himself.
In the period of the burial, no relatives visited Honi and Jea which led
to the conclusion that they have no known relatives. With this information
Barangay Captain Lito and Mrs. Anja Durias has decided to give Bobbie’s
custody to the DSWD since no one is capable of taking care of the child.
They are also afraid that if they give Bobbie to anyone who claims to raise
her, they might only abuse her and this is the best decision they could come
up with. In giving her custody to the DSWD she had a high chance to have a
better family who would give her the family she once lost.

III. BACKGROUND INFORMATION

A. The Child
1. Description of the Child Upon Admission
Bobbie is a four year old girl who is shy and withdrawn and does not
immediately take to strangers. She prefers the company of her parents and
Mrs. Anja Durias, their land lady, and her family who took care of her
during the wake of her parents. However, upon admission Bobbie already
understands that she lost both her parents and returned to heaven and that
she is to be taken care of by good people who will help her find a new mama
and papa. Mrs. Anja Durias, who also was present upon admission of
Bobbie explained that despite being reserved Bobbie is actually a positive
and bright child. She also explained to Bobbie why she has been referred to

Sunny Bright Children’s Homes and that she also understands why she is put
for adoption.
During her referral Bobbie was 26 inches in height, weighs 15.4
kilograms head circumference of 15 inches and chest circumference 25
inches which is normal to a child of 4 years old. Bobbie also prefers loose
garments. According to Rebecca P. Geamala, the director of DSWD Field
Office 7 who received her, Bobbie was wearing a white shirt with a Dora the
Explorer print on it. The shirt was paired with a little jean skirt and pink
sandals. Bobbie is clean and bathed daily according Mrs. Anja Durias who
temporarily had the custody of the child during the wake of her parents until
the turnover to this institution.
At the interview Bobbie does not respond to social worker’s questions
and statements, but took a piece of candy when offered by the social worker.
After some encouragement from her temporary family, the child finally
responded to some of the social worker’s questions. She can understand the
Bisaya language as well as the English language. According to Mrs. Anja
Durias, she must have picked her learning in the English language in
watching cartoons in English language for Bobbie was usually left in her
care when her parents are both at work.
It was also noted that Bobbie is well-developed and well-nourished
for her age. The child’s name was given to her by her biological parents and
she was named after her maternal grandmother, who is now deceased.

2. Medical History of the Child


During a medical examination and interviews the following are the
health concerns that are noted in Bobbie upon admission:
a. Bobbie was allergic to shellfish such as shrimps and crabs as
Bobbie disclosed and as confirmed by Mrs. Anja Durias. This causes
her itchiness and difficulty in breathing.
b. She has no physical defect and is well-developed in terms of her
physical body.
c. Upon the admission of Bobbie in the Sunny Bright Children’s
Home, she was in good health, with one bout of common cold
infection. Subsequently she recovered from the said infection without
the need for hospitalization and is currently reported to be in good
health.
d. She was given paracetamol for kids i.e. Calpol and Nasatera for
Kids, for her medication on her common colds and occasional rise of
temperature.

e. She has not gone to any laboratory tests for any sickness or
diseases.

Salient information of the child’s development history prior admission


established through her birth certificate and evidences available in the
barangay where she was born:
a. She was delivered in natural vaginal birth.
b. Child’s weight and length at the time of birth was 19 inches long, 7
ounces.
c. Child has received complete immunizations for BCG, DPT, OPV,
Hepatitis B, Measles, and Vitamin A.
d. To date, the child has not been subject to laboratory screenings.
e. She was born in Brgy. Kalunasan health Center, Cebu City.

Medical condition of the child upon the time she was in the care of
Sunny Bright Children’s Home:
a. She is healthy. There are no notable health problems.
b. In her second month in the care of the around November she got a
common cold accompanied by fever due to the bad weather. However,
it was not serious and was treated immediately by cold medicine.

3. Development History of the Child


Bobbie was already 4 years old when brought to the foster home and
had control over her motor skills. She can steadily hold the pen, her cup and
books. She was able to walk, run and jump upon admission like any normal
four (4) years old of his age.
Bobbie had already learned some of the alphabet when she was
brought into the children’s home. With some coaxing the child finally
learned the alphabet but she is still too shy to recite it in front of strangers.
She did not enjoy socializing or playing with the other children in the home,
preferring to keep her own company. However, she does enjoy puzzle games
and building blocks at her age of 4.
Bobbie was referred to Sunny Bright Children Home on October 16,
2019. On January 17, 2020, the Pre-Adoption Placement Certificate was
ordered and issued. However, during the period of October 2019 up until
January 27, 2020 where she was officially given the custody to her
prospective parents where she was placed in pre-adoption placement, Bobbie

has significantly improved her basic education with the in-house teacher for
the children in Sunny Bright. She was able to master in writing the alphabet
and construct simple words such as “cat”, “dog”, “ball” as among others.
She was also able to master the numbers 1-10 and is currently learning the
20 and above numbers to write and memorize. It was also noted that she has
good drawings for her age and good on colors as being illustrated in her
drawings. Although she cannot read yet, she enjoys browsing the children’s
book which has different colors and characters. She is also attentive to
storytelling time in their classes.
Since Bobbie is shy and reserved she never got in trouble with other
children nor gave a headache to her teachers and wards of the Sunny Bright.
In fact everybody would agree that despite her reserved attitude she is
respectful and tries to help in her small ways to the children who are
younger than her and give assistance to their wards.

4. Current Functioning
Bobbie is physically well-developed for her age, and has not
experienced sickness during her time in the agency, except for a bout of the
common cold. She is also mentally active and learns her lessons easily
according to her teachers. She appears to be emotionally scarred by the loss
of her parents and sometimes asks questions about them. She has a few
friends in the agency of her own age, but prefers to be left alone most of the
time. She responds to basic chores and games with the other children
according to the warden of their room.
Bobbie is able to utter a short introductory sentence: “Ako si Roberta,
upat ka tuig ang edad” (translation: I am Roberta, 4 years of age). She
appears to be physically fit, climbing the stairs without help. She is also able
to climb up and down her bed without help. She is steady when walking but
does not run very fast and seems to tire easily when running. She is able to
write her name and to color basic shapes and lines when given a crayon.
She appears to be most fond of the warden of their ward, Mrs. Rosario
Parque, whom she calls ‘nanay’. She appears to have formed a close bond
with the warden and sometimes calls for the warden when she has
nightmares. She is shy and reserved around other children, especially
strangers, but responds to games and treats with her friends around.
Mrs. Rosario Parque, warden of the child’s ward, has stated that she
has begun to talk to Roberta about the possibility of adoption. Mrs. Parque
states that Roberta seems eager about the prospect and was very excited to
meet (prospective parents) when they visited her for the first time. Ms.
Christina Manua, Roberta’s teacher, states that the subject of Roberta’s
drawings in class often involve family settings and a home. Roberta seems
eager to be adopted, but is also not looking forward to the idea of leaving
Mrs. Parque and her friends. The child seems to have a basic grasp of what
adoption means when asked by the social worker.
One possible challenge is getting Roberta to open up to her adoptive
family as she does not take easily to strangers and to unfamiliar
surroundings. However, the same behavior was also observed when she was
first brought into the home and she has since overcome it.
The child seems to be fond of playing with puzzle games and dolls
and has placed an affinity for the doll prospective parents gave her. She
dislikes being made to do chores, but is obedient to the orders of her warden.
She has been observed to become visibly sad and distressed when asked
about her birth family. To calm her, the warden and the social worker
offered some candy and ice cream which seemed to cheer her up.

Roberta is a bright pupil and gets good marks from her teachers. Her
teachers report however that Roberta can sometimes appear distracted and
sad, especially during her first days at the home. Psychologists who had
examined Roberta state that such behavior is normal and that child is ready
for adoption (see attached form).

5. Description of the Child’s Present Environment


Physical description of the child caring agency or the foster home
where the child is currently staying or being cared for:
Sunny Bright Children’s Home was established in 1997 through the
aid of a generous benefactor, Mrs. Trinidad. The compound is located in
Sitio Riva Ridge, Brgy. Tisa, Cebu City on a one-hectare plot of land. There
are five buildings in the compound: the Wards, the Infirmary and Offices,
the Chapel, the School and the Dining Areas. The Ward building is the
largest of all, composed of three storeys. Each story contains five rooms and
each room can accommodate six children. The children are arranged
according to age. Roberta’s ward is Room 2B, which she shares with four
other children her age. The ward matron is Mrs. Rosario Parque. Room 2B
has five beds and each child is given a space in the cupboard for their
personal belongings. The room has its own bed and bath as well.
The furniture in the room are all second-hand, but they are well-
maintained. The rooms are always kept clean, and the wardens are very strict
on keeping maintenance. If a child gets sick, he/she is moved to the
infirmary to avoid infecting other children. Meals are served on a communal
basis in the dining halls, which is a separate building. Children are strictly
forbidden from bringing food into their wards.
The school is divided into seven rooms, one for each grade in the
elementary level plus kindergarten children. The kindergarten room, where
Roberta is enrolled, is furnished with storybooks and reading materials,
which the children are allowed to use during study time. Children are
forbidden to bring any toys back to their wards, except for those given as
gifts to them.

B. The Family
Mother’s Background
Jeanette Cruz-Bayag is commonly known as Jea to her friends,
colleagues in work and neighbors. Before the accident she worked at SM
Seaside as a Sales Lady in the Supermarket Division. She was born on

February 14, 1996 in Guinan, Eastern Samar Visayas and grew up there until
after the Bagyong Yolanda that lay waste on the area. As a survivor of the
tragedy left with no more home and family to return to, she decided to find a
new life in Cebu City and work in the city. Because of the tragedy she only
finished her high school degree, but it was not a hindrance as she found
work as a sales lady in SM City. She was later transferred to SM Seaside
with many years of work experience in SM as a sales lady despite lack of
educational background the management promoted her to Customer Sales
Associate in the Supermarket Division of SM in late 2018.
Jea is described as having natural Filipina looks with brown
complexion, hair mostly black and with brown eyes in almond shaped and
low bridged nose in her oval shaped face. Jea has the short stature of 5’0’ in
height, a normal height to all Filipinos with the normal body shape and
without any deformities except that she has a long scar on her right arm
which she acquired during the Bagyong Yolanda. She was raised in a
farmer’s family with income enough to support one child in the family of
three and have a normal provincial childhood and teenage years.
Despite the tragic event in November 2013, Jea was known to have a
positive outlook in life. She is hardworking and has a pleasing personality
that is likeable as testified by her previous boss and workmates. As to
earning prior death, she was a regular employee in SM as a sales lady and
combined with her husband earning economically they are stable in the
standard of middle income earners of the Filipino family.

Father’s Background
Honey Boy Bayag, commonly called to many as Honi, was born on
February 15, 1995 in Argao, Southern Cebu. According to his friends,
Honi's life growing up was actually normal. Both his parents are earning as
his mother was a teacher in a public school and his father works construction
as laborer and such was enough to the family. He graduated in Argao
National High School and was able to enroll in University of Visayas, Cebu
City in BS-Education.
Unfortunately, while he was away from his parents his father was
involved in illegal activities which later led to his demise in a raid conducted
in Argao by the PDEA. This unfortunate event caused the cardiac arrest of
his mother too. Since both of her parents are not native in Cebu but came
from Negros Occidental, Honi was not able to meet any of his relatives.
Because of the unfortunate turn of events Honi decided to permanently
reside in Cebu City and stop his schooling and find a job to help sustain his
needs.

In year 2014, he met Jea, who eventually became his wife while both
of them work as Sales in SM Cebu City. However, in October 2015, he was
offered a better paying job as a technician in Globe Communications which
eventually after 6 months he become a regular worker. He is the a 5’3 in
height as estimated by his colleagues with that typical Pinoy look as they
described him. He has a shallow set eyes and flat nose due to absence of
brow bone and nose-bridge. He has light brown skin complexion and black
hair with sundadont teeth pattern.
A kababayan from Argao, working and residing in Cebu City, who
attended their wake relates that Honi childhood is like any boy growing in
their small town which favorite past time is hanging out in the beaches of
Mahayahay along with friends swimming and catching fishes to bring home.
He recalled that being classmates in elementary and high school he is like
any average students. Unfortunately, upon entering college he rarely goes
home because of his father. He only return to Argao if her mother requests
and just focus on studying. Though he was often tease that he might end up
like his father as rumor is spreading at that time that his father has something
to do with illegal drugs he made promise that he will not be like that and
become successful so that her mother will be proud of him.
Mrs. Anja Durias, the landlady of the couple also said that prior
marriage with Jea, Honi was already renting in her apartments. When he got
married they moved to a much bigger size apartment. Although there are
times that the couple delay payment on their due but it was nothing serious
as they always made payments immediately as they promised. Mrs. Durias
said that he was actually nervous because she learned about the death of his
parents. Fortunately, there was no problem and when he met Jea, she could
see that the couple was happy. Jea has been a good influence to Honi and
never did she hear the couple had a serious fight over the topic of money or
infidelity.

IV. TERMINATION OF PARENTAL RIGHTS/FACTS OF


ABANDONMENT
As established by interviews made thereof to the people who
personally known the deceased couple Honey Boy Bayag and Jeanette Cruz-
Bayag it was established that they do not have any known immediate family
that would take care of their only daughter Roberta Cruz-Bayag or fondly
called as Bobbie to everyone who knows her. Both the maternal and paternal
grandparents of his parent has been established to be dead and that being
both only child and their respective family Bobbie has no uncle or aunt to
care for him.

Under Republic Act No. 8552 also known as the Domestic Adoption
Act of 1998 and its Implementing Rules and Regulations Section 3.
Definition of Terms. (g) “Dependent Child” refers to the one without a
parent, guardian or custodian or whose parents, guardians or other
custodians for good cause desires to be relieved of his care and custody and
is dependent upon the public for support. It is believe that the death of his
parents cause by the tragic accident Bobbie is not a dependent child who is
one without a parent as both parents have died on the same accident, with no
known relatives there can be no guardian or custodian for Bobbie.
Accordingly, Bobbie was available for adoption and assessed to be a
child adoptable one the second week of her stay in the Star Bright Homes as
issued by the head of the children’s home that she is fit and ready to have a
new home.

V. PRE-ADOPTION TRIAL REPORT

An intervention activity is an instructional or a specific program or set


of steps to help prospective parents and children to improve in an area of
need. They last over a certain number of weeks or months and are reviewed
at set intervals. This is usually set-up to help monitor the progress of the
family.

The Pre-Adoption Trial Report is in compliance with the three month


trial custody of the prospective adoptive parents and the child. Supervise
under the social worker in charge in order to determine the relationship
during this period and as well as to give intervention necessary for both the
prospective parents and the adopted child in order to strengthen their
connection emotionally and mentally. This will also help build the
foundation of the family to live harmoniously and in peace.

The intervention is given on the first day of the week and assessment
is made at the end of the week. This is to determine what is the impact of the
activity conducted and how it affects the child’s entire week spending with
her prospective parents and experiences she had and how that affects her
life. These activities are daily activities of a family. This is what usually
children of her age do with their parents. This will also help the social
worker to see how the child is being treated in the prospective parents and
how they treat her.

VI. ASSESSMENT/EVALUATION
Roberta Bayag is a sensitive child who places importance on the
relationships she has, like her family and friends. The death of her parents
caused trauma to the child, but she is starting to overcome this with the help
of the center. Roberta Bayag is the type of child who will benefit from
strong family ties with loving and caring parents. She will be shy and
reticent at first, but with love and care she grows to love the people around
her. The prospective parents of Roberta should focus on her social and
emotional habits. She should be made to feel secure in her life and she
should be taught to address her emotions. She will need help psychologically
to deal with her trauma, and this can be done within the loving arms of a
new family.
She is a good child with a pleasing personality once she opens up. She
never gives trouble to people around her and is good at understanding the
situation despite the young age. She is also a positive girl who looks forward
to the future despite all the bad things that happened to her life. She will be a
great addition to a family as a loving daughter.

VII. RECOMMENDATION
It is strongly recommended that Roberta Bayag be adopted by a
loving family who will be able to provide for her needs and wants. The
results of the child study report show that Roberta will respond to the family
to having a mother and father figure, and allowing her to be adopted will
accomplish this. Roberta will be able to lead a new and happier life with her
adopted family if she is given the chance.
