AFFIDAVIT OF WITNESS

I, HARDEN TUI, Filipino, of legal age, single, Filipino citizen, and a

resident of No. 111, M. Roxas Street, Lower Tondo, Nu Yourk City. After
having been duly sworn to in accordance with the law, hereby depose and
say:

1. That I personally know the defendants HANI R. AKOL and RAMBO

OSOKA.

2. That HANI R. AKOL is my board mate.

3. That last August 12, 2015, I arrived home from work at around ten
o’clock in the evening.

4. That at around ten twenty that evening, RAMBO OSOKA arrived at

the house and they invited me to have drinks with them.

5. That I declined and stayed home because I was too lazy to go out for
drinks.

6. That I joined them for drinks in the house at around midnight.

7. That we continued drinking until the morning of August 13, 2015 and
slept afterwards.

8. That I woke up at around nine in the morning of August 13, 2015 and
saw RAMBO OSOKA leaving.

9. That I am executing this affidavit to attest to the truth of the foregoing

statement and to support for the dismissal of the case filed against
HANI R. AKOL and RAMBO OSOKA.
