The Syariah Court in states and the federal territory employs a hierarchy of a three tiered court
system, which, consist of Syariah Appeal Court,Syariah High Court and Syariah Subordinate Court. For
Syariah Appeal Court, the chief judge is appointed by the Yand di Pertuan Agong on the advice of the
minister and consultation of Majlis Agama Islam. The qualification of a Chief Syariah Judge is stated in
Section 41 of Administration of Islamic Law Act 1993,where the Chief Syariah Judge must be a
Malaysian Citizen and should have 10 years of experience as a Syariah High Court Judge or practices
the field of Syariee. The Syariah Appeal Court is presided by the Chief Syariah Judge and two judges
are selected by the Chief Syariah Judge from the panel of seven judges as prescribed under section 42.
Syariah Appeal Court has jurisdiction over Appellate cases and Supervisory and re visionary.For
appellate cases, the Syariah Appeal Court may hear cases from Syariah High Court only,however the
Syariah Appeal Court may hear cases from Syariah Subordinate Courts if allowed by Syariah High
Court. For revisionary and supervisory, the court may call to examine records of proceedings of the
Syariah High Court.
