COUNTER AFFIDAVIT

I, , of legal age, filipino, married, and a resident of, Philippines after having
been duly sworn to in accordance with law hereby depose and state THAT;

1. I am the respondent in the above entitled case docketed as NPS Attempted

Murder;

2. I am executing this Counter Affidavit as a reply and comment to the Criminal

Complaint of the private complainant

a) That, I denied all allegations enumerated in the complaint and

sworn statement of the complainant.

b) That, the accusation of the complainant is baseless and

unfounded.

3. I did not kill or cause any harm to the victim. The testimony of the private
complainant cannot be given merit given the fact that she was not actually present
at the time the incident took place. She has no personal knowledge of the actual
facts and circumstances surrounding the incident. She is not competent to testify
on matters pertaining to actuations of the parties before, during and after the
incident.

4. I have no idea of the turn events of our mediation in the barangay. All things
happened on the spur of the moment. All I wanted during that time was for us to
be settled in the barangay.

5. As admitted by the witness of the private of complainant the mediation was well
going until an altercation happened. 1

6. There was no qualifying circumstance that would qualify the death of the victim
to murder as the case was just a result of an heated arguments between the parties.

7. Premises Considered, the complaint for murder should be dismiss for lack of
merit.

8. This Counter Affidavit is being executed to attest to the truth of all the
foregoing facts and events and to disclaim all the accusations against me.
Furthermore, this affidavit was explained to in a language and manner which is
known to me.
