1. The Department of Education issued DepEd Order No. 12 s. 2020 entitled


"Adoption of the Basic Education Irarning Continuity Plan Ior School Year 202G

provisions of learning opportunities for learners through blended distance leaming
modalities.

2 In view of the plans that are geared towards such modalities, and through the use of
different communication platforms, such as use of social media, to communicate
with leamers and parentt and to facilitate leaming and other school related tasks,
this Office craJted these saJeguarding standards to govide guidance in:

a- Saleguarding leamers'rights to a safe leaming environment against potential


abuse, and to observe a code of conduct during on-line interaction with co-
learners ald teachers;

b. Advocating the desired demeanor and mtions of teachers whmever they are
dealing with or conmrmicating with learnels during the conduct of online
school activities and with parmts/guardian6 when discussing school related
mattels;

c. Enioinirg parents/guardians to abide by identfied applicable nomrs and


behavioral standards as they play an important role in saleguarding their
clildren s access witl social media plafforms and in co-Iacilitating their
children s distance leaming and coordilation with teacheN.

3. The standards provided herein are based on various rules and issuances, such as the
Child and Youth WelJare Code, as a.arended, DepEd Cfld Protection Policy and the
Code oI Conduct for Professional Teachers.

1. INTRODUCTION AND RATIONALE:


The Department of Education issued DepEd Order No. 12 s. 2020 entided
"Adoption of the Basic Education l€arning Continuity Plan for School Year
2O2U2027 in the Ught of the COVID-19 Public Health Emergency", which
emphasized provisions of learning opportunities for leamers through
blended disqnce learning modalities.

Likewis€, in support to stategies in implgmenting blended learning delivery


modalities contaired under DepEd issuances, which calls on schools to
shengthen the implementation of the DepEd Child Protection Policy, this
standard shall contribute to the realization oI said sEategies.

With rules and processes generally governing face-tGface interaction among


learners, school personnel and stakeholders, and in view of situations where
said face-to.face interaction could not be made, there is a need for standards
for online interactior! con5idering that it is one of tlle most viable means of
communication and interaction.

Thus, in view of the plans that are geared towards blended leaming and the
use of different communication platforms for interaction between teachers,
leaners, parents and other stakeholderg such as but not limited to use of
social media, to facilitate learning and other school related activities, these
safeguarding standards are formulated to provide guidance to:

a. Safeguard leamers' rights to a sale learnirg environment, against


potential abuse, and to observe a code of conduct during online
interaction with co-leamers and teachers;

b. Advocate the desired demeanor and actions of teachers, with due


regard to relevant rights, whenever they are dealing with or
communicating with learners and parents on-line for school related
activities/matters; and

c. Enjoin parents/guardia$ to abide by ident'rfied appticable norms ard


behavioral standards as drey play an important role in co-facilitating
thet children's distance leaming and coordination with teachers.

issuances, such as the Child and Youth Wellare Code, as anended the Code
of Conduct for Professional Teachers, DepFd Order No. ,!0, s. m1 or the
DepEd Child Protection Policy, DepEd Order No. 55, s. 2013 or the
Implementing Rules and Regulations of Republic Act No. 10627 (Anti-
Bulying Act), Republic Act No. 11313 or the Safe Spaces Act and DepEd

Order No. 18 s.2015 DepEd Guidelines and Prmedures on the Management
of Children-at-Risk (CAR) and Children in Conflict with the Law (CICL).
'Ihese standards are primar-ily intended to prevent any forms of abuse
against leainers, and to facilitate a conducive online intetaction among
learners, teachers, and parents.

After consultation with representatives of leamers, teachers, parents, school


heads, child protection coordinators and specialists, legal officers, Dvision
Offices and Regional Office representatives and in coordination with the
Staiway Fourdatio& Inc., these Safeguarding Standards during Online
Interaction is being promulgated.

1. COVERACE:

These standards applies to all forms of online communication plaforms,


such as tlrough the various social media plafforms and other non-online
messaging technology, so far as the prirrciples set forth in this stardards are
applicable. Thc same shatl be applicable to all public schools in the National
Capital Region. Private schools are likewise encouraged to adopt the same.

2 DEFINITION OF TERMS:

The folloling terurs as used herein shall mean:

lL Onlirc lnteraction: refers to commuflication between teachers, learners,


parents and relevant staleholder using of any social media pladorm,
as well as, any instant messaging applicatioo so far as applicable.

B. Social Medic is a web-based platforrn of communicatio& with many


applications, that enables online interaction and (acilitates users to
generate and share specific contents. There are various classilications
of social media platforms and one can be dassified under the "social
networking sites" such as Facebook,.

C. Social Medis Croup: an online space for small group communication


artd for people to share their common interests and express their
opinion. Groups allov/ people to come together around a common
cause, issue or activity to organ2e, express objectives, and discuss
issues, po6t photos and share rel,ated content.2

D. Safeguanling Standatds: is a specfic set of dested behaviors that are


placed as a basic guide.

School Heads, tfuough the Guidance Counselor/Teacher and Schoot Child


Protection Coordinator, must ensure that all teachers in their respective
schools are fumished with a copy of thes€ Standards and are oriented on its
contents before conducting separate or joint orientation activities with
learners, parents and other stakeholders, to be done in thet dested manner.

5. RIGHTS AND RESPONSIBILITIES OF PARENTS DURING ONLINE


INTERACTION:

RIGHTS OF PARENTS:

A. With Regard to Teachers and the School Community:

a- Parents have the right to be inJormed of relevant aspects


concerning their children's scholastic performance as well as
behavior during tearning and any school related session.

B. As co-facilitators in the learning of theil children:

a, The parents shall have the right to tlrc company of their children
and, in relation to all other persons or institutions dealing with the
child's development, the primary right and obligation to provide
for their upbringingl.

b. Parents have the right to discipline the child as may be necessary


for the formation of his good character, and may thcrcfore rcquirc
from him obedience to iust and reasonable rulet suggestions and
admonitionsr.

using their laptops, personal computers, mobile devices

iii. Motivate their children and have their children be on time


and well<onditioned for learninp (i.e. relaxed, inspired,
having eaten thei meal/snack, and has already answered

iv. Ensure that thet children are appropriately groomed and


dressed during on-line interaction.

& Do not create social media accounts for their children who are
below the required age (i.e. for Facebook, those below L3 years
old). Nonetheless, parents must give consent to the creation of any
social media account by their child who is still a minor.

6. RTGHTS AND RESPONSIBILITIES OF TEACHERS DURING ONLINE


INTERACTION:

RIGHTS OF TEACHERS:

A. WITH RECARDS TO PARENTS:

a. Teachers has the basic right to be respected, acknowledged ard


treated with dignity as a person engaged in a noble profession of
molding the nation's future.

b. Teache$ have the right to due process of l,aw and to


confidmtiality of information relative to any investigation.

B. WITH RECARDS TO LEARNERS

a. Teachers shall exercise secondary parental authoritys and shall


have the right to determine the best manner to teach in accordance
with the prescribed curriculum standards.

b. Teachers shall exercise necessary means to impose discipline


during online interaction. They shall use positive verbal and non-
verbal communication when dealing with behavioral challenges
witl leamers5.

GIVEN THE ABOVE RIGHTS, TEACHERS ARE CALLED UPON TO


EXERCISE THE FOLLOWING RESPONSIBILITIES:

A. BEFORE ONLINE INTERACTION:

a- Teachers can only hteract with leame$ online when consented by


the parent/ guardian.

Written consent of the parent/s must be s€cured firsl with regard


to tlle online interaction of the learner with theh teachers and to
the use or processing of any video or image taken during
interaction.

The consent may be submitted personally or through email or any
messaging techrology or medium to the school head or teacher-
adviser of the learner, lnhich shall be valid throughout the school
year.

Standardized consent form is attached as Annex "A"


b. Teachers are encouraged to use their DepEd email accounts to
create their social media accounts for online interaction witlr
leamers. They shall use thet recent profile picture and ensure
that their image therein is suitable to the dignity of their
profession.

c. Teachers shall inform t}te parents on the schedule of t]le online


classes/ interaction.

d. Teacherc must be appropriately groomed and wear prescrihd


attire/ presentable clothes.

e. Ensure that background view is neat, clean and child safe

B. DURING ONLINE INTERACTION:


a, Teachers shall call tleir leamers by their nanes. Terms of
endearment or pet names are highly discouraged. Iabeling and
smart shaming shall not be committed.

b. Teachers shall use age appropriate examples and humors. They


shall avoid profanity and using sexually charged jokes or humort
and sexual imuendos, even when not diected towards a learner.

c. Teachers shall only assign academic-related tasks to leamers

d. Teachers shall encourage tlle observance of quarantine and safety


measures- They sha.tl refrain from requiring learners to pe orm
activities or proiects when it entails violating the health protocols
by activities the Deparbnent of Healtfr (DOH) or any govemment
agency.

e. Teachers shall respect the private spaces of leamers. They shall not

group video calls or chat areas with his/ her leamets. Teachers
shall keep in confidencc learners' sensitive and personal/private
information or circumstances, knowrr to them by reason of their
work.

f. Teachers shall maintain safe communications with learners. They


must not participate in one (1) on one (1) private messaging with

D. They should understand and be emphatic to the situation of otlers.


They shall not engage in online bullying and report any bullying
incidences to his/her adviser, when they become aware of it.

proceedings, or the sentence of any court in such proceedingslt;

Any learner who violates this provision shall be subjected to


intervention programs by the CPC/Anti-Bulying Committee (ABC)
and other adminishahve pr<xeedings before the School Head,
pursuant to exi,sting DepEd rules and regulations, when warranted.

8. GENERAL PROCEDURE BEFORE, DURING AND AFTER ONLINE


TNTERACTION WITH LEARNERS AND TEACHERS:

A. BEFORE ONLINE INTERACTION:

a. Schools must first conduct orientation with parents and discuss


basic matters regarding:

B. DURING ONLINE INTERACTION:

a. Teachers, parents and leamers shall comply with their resPective


resporuibilities during online interaction as herein Provided.

b. Teachers must, as much as possible, always inculcaE and remind


learners of their responsibilities under this standard.

C. ONLINE INTERACTION BETWEEN PARENTS AND TEACHERS:

a. Teachers must inform parenls, during scheduled sessions,


regarding their child's performance and behavior.

b, Teachers, must as much as poosible immediately, bring to the


attention of the parents any behavioral challenges that the latte/s
children exhibits and any recommended action on said behawior.

c Teachers and Parents should always remember their respective


rights ard tleir concomitant responsibilities as provided herein,
whenever tley are interacting with each other online.

9. SAFECUARDING STANDARDS FOR LEARNERS'DATA AND PRIVACY:

,A- Consent ftom parents is needed before school personnel can post
images/videos of leamers on social media plafforms.

B. The consent shall be s€cured at the start of the school year, and shall
be in writing. Consent form is attached as Annex 'A'.
C. The consent shall cover all irrages/videos taken for the school year
and shall be used only for school documentation pu{,oses and other
legitimate purpodes.

D. Once perurission has been provided, the preceding standards shall

a. The image(s)/videos must neither mislead the viewer as to the
actual situation of the subiect of the pictures nor distort reality.

b. Ensure that data/inforrration on the firll name, address, age,

pe$onal circumstances are not seen or be publicly accessibie.

envionment and pose are taken-

d. Leamers must not be depicted in an awkward, compromising,


discriminating, or dangerous situation.

e. kamers must not be depicted in a sexual or sexualized manner


or context that can constituE images of abuse.

f. Inages taken shall not depict violence, pomography, or crime.

E Provision of Crrrective Measure Process:

a. Any person (teacher/parent/learner) may report any issue as to


the use of any leamer's data/information contained in any posted
material \^.ith the school head/guidance counselor.

b. The school head, tfuough the guidance courselor, shall validate


whether there has been a violation of the Data Safeguarding
Standards.

c. Once, determined, the school head shall instruct the responsible


rhool personnel to take down the po6ted material/content
immediately.

When the school personnel fails to abide by these directives,


he/ she shall be subjected to disciplinary procedures.

2 SAFEGUARDING STANDARDS FOR MODERATED PRIVATE SOCIAL

Such social media groups shall be UNDER PBJVATE SETTING AND
PROPERLY MODERATED because the same will contain records of an
official interaction between and among learners and teachers, hence, such
social media groups shall be called as "MODERATED PRMTE SOCIAL
MEDIA/ LEARMNG GROT'PS".

The folowing standards are as follows:

AGE AS A FACTOR TO CONSIDER:

,4- The use of Moderated Private Social Media Groups/l-earning Groups


(Group) shall be applicable to Junior and Senior High School learners,
in accordance with common social media pladorrr's policy in terms of
age usage (13 and above).

B. ff High School learner b below 13, then he/she shall not be

part of the moderated social media group, but instea4 shall receive
communication via other means identified by both the teacher, the
parents/ guardians.

C. For Grades 1 to 6, teache$ shall employ either messenger group chats


or Facebook groups with the parents of the leamers.

CONSENT OF SCHOOL HEAD NEEDED:

D. The teacher/adviser shall inform the principal and the guidance


couruelor of his/her intention of creating a class moderated social
media group for his/her class.

E Once consent has been given, the adviser shall create the group using
her DepEd email account and set the privacy setting to a private
group.

F. The adviser, school hea{ or his/her representative shall be co-


administrators of said class group.

ADMIN ISTRATORVMODERATORS:

G. All moderated rhool sociat media groups shall always have the
following as moderators:

a. 1 Suidance couruelor/teacher or grade [eve[ chairperson or


coordinator; and

b. 1 leamer class representative (High School)

H. Under no circumstances shall any of the aforementioned
administrak rrls and moderators be removed from the class social
media group.

l. The guidance couruelor/Suidance teacher/grade level coordinato/s


interaction shall be limited only to observation tasks to ensure that
potential cause of harm to anyone is prevented ard not committed
within the gloup.

J. Guidance Courselo$ may immediately inbrvene on actionable


reports or posts seen in said group.

K Moderators and Adminishators shall be guided by the following:

a. Administrator/s or Moderator/s shall be aware of basic social


media etiquette in relation to the Code of Conduct and Ethical
Stardards, when dealing with all sta.keholders during social
networkin&

b. AdminGtrator/s may officially respond to queries and other


matters posted in the group, in a mamer that may be dtected by
the adviser or school head. Moderator/s cannot represent the
rhool and provide any official statement. Nonetheless, both
administrator/ s and Moderator/ s can answer basic queries.

c. Adminisbator/ s or Moderator/ s shall maintain the


confidentiality of the reporter and any private messages tlat may
have been sent in thefu respective private accounts regarding
reports of child abuse/bullying and forward the same to the
guidarce counselor within 24 hours;

d. Administrator/s or Moderator/s shall not be allowed to delete


any message posted in the goup udess, dtected by the Head of
Office or the latter's authorized representative. They rnay
however immediately use "hide" functions for posted messages
r,r'hich are offensive on its face; and

e. The School Head shall forward to the Regional Irgal Unit's email
address: legal.ncr(@deped.gov.ph any message/s relating to
reports on child abuse committed by teaching personnel. On the
other hand, reports on child abuse committed by non+eaching
personnel shall be reported to the Division l,egal Unit.

L. One (1) representative of the Homeroom frfA may be invited as


member-observer of the group. As observer, the PfA representative
shall sign a confidgntiality agre!4entl! ard he/she is not allowed to
interact with any leamer in the group.

information and class announcements and as suclr, the class advisers
shall find ways to relay information to leamers who would not have
dccess to such channels/ technologies;

ENCOURAGED AND PROHIBITTED POSTS:

O. Posts in the Croup shal be limited to:

a. Authentic nens that may affect tlle class;

b. Information rel,ative to the class/ school activities; and

c. Official school announcements.

d. All otler relevant matters for leaming.

P. Posting/sharing of fake newE unverified informatio& offensive


materials, commercial advertisements and any material that does not
promote learning, shall not be allowed in the group and
administrators/ moderators must hide said po6ts immediatel,
without preiudice to removal as may be directed.

3. REPORTING PROTOCOLS FOR REFERRAL AND ACTIONS ON


VIOLATION OF THE STANDARDS AND RELATED POLICIES.

A. DepEd Order No. 40. s. 2012 reportorial and referral protocols:

Reported acts of child abuse committed by a school peEonnel must be


reported to the appropriate disciplinary authorities.

The victim<hild shall be subiect for intervention and referred to the


appropriate government agencies by the Child Protection Committee.

B. DepEd Order No, 55, s. 2013 reportorial and referal protocols:

Repo ed acts of bnllying comnritted by leame$ against co- learners


shall be investigated according to the administrative procedures
under the Implementing Rules and Regulations of the Anti-Bullying
Act.

The victim-child and the bully shall be subiected for intervention and
referred to the appropriate govemment agencies by the Anti-
Bulying/Child Protection Committee, when necessary-

C. DepEd Order No.1& s.2015 reportorial and refeEal protocolsr

When a child has been identified as a Child-At-Rbk (CAR) or a Child


in Conflict with the Iaw (CICL), the school guidance office shall male
tlle necessary referral to the DSWD, and appropriate intervention
prograns shall be made.

4. MONITORING AND EVALUATION:


Schools Division Offices, through the ioint efforts of the Division l€gal Unit,
Dvision Child Protection Coordinator, and the School Governance and
Operations Divisior! must ensure compliance by School Heads as to the need
to advocate and orient learners, parents and teachers relative to the following:

a. Their respective rights and responsibilities under this standards;

b. The standards and limib in the creation of Moderated Private


Social Media/ l€arning Groups;

c. The basic protocols on the referal ard reportorial actioru in case


of violation of any established rules; and

The Schools Dvision Office, through the Division Legal Unit arrd the Division
Child Protection Coordinator shall continuously gather fuedback in the
implementation of these standards and shall submit to the Regional Office,
tfuough the Regional Legal Unit a report as to recommended matte$ to be
developed within one (1) month from the opening of classes for SY 20m-2o21.
A monitoring tool shall be issued thereafter.

5. MISCELLANEOUSPROVISIONS:
,A- The provisions of these standards may be further localized and
adopted by school in then Chitd Protection and Anti-Bullying Policy
with Student Code of Conduct.

B. These standards shall be effective immediately

C. These standards shall be regularly reviewed and updated
