MANIFESTATION WITH MOTION TO SUBMIT ADDITIONAL

DOCUMENTARY EVIDENCE

COMES NOW, RESPONDENT, to this Honorable Office, most

respectfully manifest and states that a copy of the Position was duly
furnished to the complainant in his address at the Legal Division, MCIAA,
Waterfront Hotel, Pusok, Lapulapu City, Cebu, Philippines, as indicated in
his complaint. But our mailed envelope containing our position paper was
returned to us with the notation “no longer connected with the said
address”, a machine copy of the mailing envelop is hereto attached as
Annex “A”.

Also the respondent is hereto attaching the Sketch Plan as prepared

by Filomeno S. Lipang, Geodetic Engineer, of Lot 3364, CAD 977-D, declared
in the name of my father, Anastacio Tapayan, situated in Lajog, Clarin,
Bohol, Philippines, of which the four (4) mahogany trees subject of this
administrative complaint were situated, a copy of the Sketch Plan is hereto
attached as Annex “B”.

WHEREFORE, considering the foregoing, it is most respectfully

prayed before this Honorable Office that the complainant in this case
cannot be served with a copy of our position paper as he is no longer
connected with the Legal Division, MCIAA, Waterfront Hotel, Pusok,
Lapulapu City, Cebu, Philippines and the Sketch Plan as prepared by
Filomeno S. Lipang, Geodetic Engineer, of Lot 3364, CAD 977-D be admitted
as an additional documentary evidence for the respondent.

Other relief’s, just and equitable under the circumstances are

likewise prayed for.
