1 INTRODUCTION
1.1 About Pimpri Chinchwad
Pimpri Chinchwad is the fifth most populated municipal corporation of Maharashtra. The
population of Pimpri-Chinchwad as per 2001 Census was 10 lakhs and has reached 17.29 lakhs
in the year 2011. Pimpri-Chinchwad has a thriving industrial belt, primarily consisting of
engineering and automobile industries. With over 6,000 industrial units in the large, medium
and small sectors dotting its landscape. Pimpri-Chinchwad is one of the best developed
industrial belts of Maharashtra accommodating many reputed industrial houses and business
conglomerates of the country.
Present day Pimpri Chinchwad is thriving suburbs of Pune situated along the NH-4 (Pune -
Mumbai Highway) and the areas developed due to emergence of Hinjewadi IT Park and the
NH- 4 Bypass. Nodes like Dapodi, Kasarwadi, Pimpri, Chinchwad, Pradhikiran and Nigdi, which
developed along NH-4 have a distinctly industrial feel due to the presence of large industrial
campuses and MIDC areas. Whereas areas like Wakad, Pimple Saudagar, Pimple Nilakh and
Sangvi developed later and are predominantly residential suburbs catering to the workforce
at Hinjewadi IT Park.
The Pimpri Chinchwad city is managed and governed by the Pimpri Chinchwad Municipal
Corporation (PCMC), established in the year 1982. The Maharashtra Municipal Corporations
Act, 1949 bestows the responsibility of providing basic infrastructure and services viz. water
supply, drainage, sewerage, roads and services such as conservancy, firefighting, street
lighting, education and primary health upon the PCMC.

1.2 Project Introduction


Effective parking management is an essential tool to facilitate the efficient use of road space
and to ensure free passage for pedestrians, cyclists, public transport, and motorists. In
addition, suitable parking fees can ensure that personal motor vehicle users compensate the
city for the use of valuable land on which they park their vehicles. In order to ease congestion
on the roads and to minimise the use of personalised vehicles by users, PCMC has prepared
Public Parking Policy in 2018. The purpose of this policy is to optimum use of existing off-
street and on-street parking in order to reduce supply of excess parking through the means
of enforcement. The Pimpri Chinchwad Municipal corporation pursues to implement a
modern Parking System to improve parking operations, optimise usage of the available
parking supply, and enhance the overall functioning of streets in the city.
As per the proposed parking policy, areas in PCMC limits are divided into various zones based
upon parking demands. In the first phase of operation, BRTS corridors, major roads and 5
railway stations have been selected for the implementation of parking policy. Other roads in
the corporation will be developed in subsequent phases.

1.3 Parking Management


The Service Provider will operate and maintain parking operations along the major corridors
identified within the jurisdiction of Pimpri Chinchwad Municipal Corporation for 3 years. List
of corridors is given in Annexure A. The Service Provider will collect parking fees using
electronic devices and share parking data with PCMC on a daily basis. The Service Provider
will ensure that vehicles are parked only within the designated parking spaces. The Service
Provider will cooperate with Pimpri Chinchwad Commissionerate Traffic Police and inform

them in the event of parking violations (parking in no-parking zones, haphazard parking etc)
for quick enforcement action.
1.4 Allotment of Parking Lot
Pimpri Chinchwad Municipal Corporation will assign specific roads to the Service Provider to
implement roadside parking. The Service Provider will be responsible for operating and
maintaining parking on these roads. The necessary marking and signage will be provided by
PCMC.

1.5 Parking Fee Collection


Service Provider will enable quick and hassle-free payment of parking fees through a
handheld electronic ticket machine and a mobile phone-based payment system. Service
Provider should provide all Payments options cash , credit card, net banking, mobile-based
banking systems, and other electronic mediums. Operator need to deposit cash daily into
Escrow account. All payments collected through electronic means and Cash will be deposited
directly into an Escrow account that will be operated by PCMC. System Generated
Challan/Receipt should be provided against each payment as per the format approved by
PCMC
1.6 Parking Enforcement
1.6.1 Paid Parking Lots
Parking areas will be demarcated by PCMC along the identified major corridors. The Service
Provider will provide ticketing staff who will provide parking attendants who will collect
parking fees as well as ensure appropriate parking of vehicles within allotted space.

1.6.2 No Parking Zones


If a vehicle user is parking or has parked in a No-Parking Area, the ticketing staff will cooperate
with the local Traffic Police and inform them accordingly for a quick enforcement action.

1.7 Scope and timeline


Phase 1 of the Pimpri Chinchwad Parking System will cover existing BRTS Corridors and major
roads in the city. The System will be expanded in subsequent phases. Detail list of roads is
included in Annexure F.

Pimpri Chinchwad Municipal Corporation hereby requests interested Parties to respond to


this call for Requests for Proposal (RFP) for the implementation of on-street parking on the
selected major corridors in PCMC

2 Definitions
In this RFP, the following word(s) shall have the meaning(s) assigned to them herein below:

“Base Parking Fee Rate” or “Base Fee Rate” is the Fee Rate at the Commencement Date.

“Bid Process” means the process of selection of the Successful Bidder through competitive
bidding and includes submission of Bids, scrutiny and evaluation of such Bids as set forth in
the RFP.

“Bid” means the proposals submitted by the Bidder(s) in response to this RFP in accordance
with the provisions hereof including, technical proposal and financial proposal along with all
other documents forming part and in support thereof.

“Bidder” means any firm, including a sole proprietor or a partnership firm or a company or a
Joint Venture or a Consortium, who submits a Bid along with Bid Security under this RFP
within the stipulated time for submission of Bids.

“Car Parking Slot” is an individual parking space for one (1) passenger car. Car parking slots
are as per IRC-SP-12:2015, Guidelines for Parking Facilities in Urban Areas.

“Collection” is a set of processes designed to the reception, consolidation, transportation


and deposit of the moneys derived from the initialization, charge and sale of the means of
payment in the points of sale of the PCMC Parking System.

“Financial Operations Date” or “COD” is the actual date on which the Parking Management
and Operations will begin to serve users under the Service Contract.

“Consortium” shall mean an association of two (2) or three (3) entities / firms formed
specifically for the purpose of bidding for this RFP.

“Equivalent Car Space Factor” or “ECS Factor” Equivalent Car Space Factor or ECS Factor is
the size of a Parking Slot for a type of vehicle expressed as a fraction of the size of a Car
Parking Slot, as defined in IRC-SP-12:2015, Guidelines for Parking Facilities in Urban Areas.

“Escrow Account” shall mean a common account set up through an agreement between
Pimpri Chinchwad Municipal Corporation and the service provider into which all revenue shall
be deposited and, thereafter, payments to the Service Provider, Pimpri Chinchwad Municipal
Corporation and other agencies shall be made.

“No-Parking Area” means any portion of a Block Face where parking is not permitted. All
footpaths and cycle tracks are No-Parking Areas.

“Paid Parking Lot” is a Parking Lot where a Parking Fee is applicable for one or more types of
vehicles.

“Parking Coupon” or “Coupon” is a prepaid card that a user can purchase from a third party
with a specified value that can be used toward Parking Fees and Fines. Each Coupon contains

a unique number that the user can relay to the Service Provider to initiate Fee or Fine
payment.

“Parking Duration” is the duration for which a vehicle is parked in a Parking Slot.

“Parking Fee” or “Fee” is an amount charged by Pimpri Chinchwad Municipal Corporation for
vehicle parking in a Block Face or Parking Lot.

“Parking Fine” or “Fine” is an amount charged by Pimpri Chinchwad Municipal Corporation


and Traffic Police for vehicle parking in a Parking Lot without paying the applicable Parking
Fee or for parking in a No-Parking Area.

“Parking Lot” is an off-street public parking area with one or more discrete entrances where
users may be allowed to park vehicles, for a fee or for free, depending on the notification.
Each Parking Lot is denoted by a unique identification code.

“Parking Fee Rate” or “Fee Rate” is the Parking Fee per hour applicable for a designated
vehicle, time, and place.

“Parking Slot” is a parking space for one (1) vehicle.

“Payment Period” is the period for which an invoice has been submitted by the Service
Provider for the service operated by the Service Provider. This shall be, unless otherwise
modified, be a period of fourteen (14) days.

“RFP” and/or “RFP Document” means this Document.

“Service Provider” means the successful bidder selected under this RFP with whom Pimpri
Chinchwad Municipal Corporation has entered into a Service Provider Agreement.

“Successful Bidder” shall mean the Bidder who qualifies the technical bid stage and the
financial proposal stage of this RFP and to whom a Letter of Acceptance is consequently issued
by Pimpri Chinchwad Municipal Corporation.

“System” shall mean the PCMC Parking System.

“Two-Wheeler Parking Slot” is defined as the individual parking space for one (1) motorised
two-wheeled vehicle.

“User Account” means a record with the Service Provider that includes a user’s mobile phone
number, one or more vehicle license numbers, and a prepaid balance from which the user
may pay for Parking Fees and Parking Fines.

“User” means the operator of a vehicle who parks in a Block Face or Parking Lot operated by
the Service Provider.

Any other term(s) not defined herein above but defined elsewhere in this RFP shall have the
meaning(s) ascribed to such term(s) therein and shall be deemed to have been included in
this Section.

3 Instruction to bidders
1. No Bidder shall submit more than one Bid for the Project. A Bidder applying
individually or as a Member of a Consortium shall not be entitled to submit another
Bid either individually or as a Member of any Consortium, as the case may be. A
Consortium will comprise of up to a maximum of 3 partners only (1 Lead partner+ 2
Consortium partners).
2. The Bidders are expected to carry out their own surveys, investigations and other
detailed examination of the Project before submitting their Bids. Nothing contained
in the Bidding Documents shall be binding on PCMC nor confer any right on the
Bidders, and PCMC shall have no liability whatsoever in relation to or arising out of
any or all contents of the Bidding Documents.
3. Notwithstanding anything to the contrary contained in this RFP, the detailed terms
specified in the Concession Agreement shall have overriding effect; provided,
however, that any conditions or obligations imposed on the Bidder hereunder shall
continue to have effect in addition to its obligations under the Concession Agreement.
4. The Bid should be furnished in the formats as specified in the RFP and signed by the
Bidder’s authorized signatory. The Successful Bidder may be subsequently invited for
award of the Concession. The Bidders should note that the formats specified in the
RFP have been provided for the convenience of the Bidders and may not exhaustively
enumerate or describe various information required to be provided by the Bidders
under the Bidding Documents. The Bidders should ensure that all the information
required to be provided by it in terms of the Bidding Documents is included in its Bid
whether or not a particular format specified herein makes provision for submission of
such information and/or whether or not a format for submission of such information
is incorporated in the Bidding Documents.
5. The Bidder shall deposit an EMD of Rs 4,75,000/- (Four Lakh Seventy Five Thousand
Rupees Only/-) through the e-tendering system of PCMC and in accordance with the
provisions of this RFP for the Bid submitted (“Bid Security”) EMD of successful bidder
will kept as security deposit. EMD of successful bidder will kept as security deposit.
EMD of unsuccessful bidders will be refunded after signing of contract with successful
bidder. The Service provider shall submit a Performance Security deposit in the form
of a Bank Guarantee in favour of PCMC by a Scheduled/ Nationalized bank for an
amount equal to Rs. 23,75,000/- within 15 (fifteen) days from the date of receipt of
Letter of Acceptance.
6. The Bidder in case of Bidding Company should submit a Power of Attorney, authorizing
the signatory of the Bid to commit the Bidder.
7. In case the Bidder is a Consortium, the Members thereof should furnish a Power of
Attorney in favour of the Lead Member.
8. Any condition or qualification or any other stipulation contained in the Bid which is
inconsistent with the terms of the Bidding Documents shall render the Bid liable to
rejection as a nonresponsive Bid.
9. The Bid and all related correspondence and documents in relation to the Bidding
Process shall be in English language. Supporting documents and printed literature
furnished by the Bidder with the Proposal may be in any other language (according to
UN Charter or Indian Constitution) if they are accompanied by appropriate
translations of the pertinent passages in the English language (Transliteration is not
allowed). Supporting materials, which are not translated into English, may not be

considered for fixing the qualification criteria. For the purpose of interpretation and
evaluation of the Proposal, the English language translation (no transliteration is
allowed) shall prevail.
10. The currency for the purpose of the Bid shall be Indian Rupees only. In case the
conversion is required, the conversion to the currency shall be based on the exchange
rate (RBI Reference Rate) as was applicable exactly 7 (seven) days prior to Bid Due
Date. In all such cases, the original figures in the relevant foreign currency and the Bid
currency equivalent thereof must be given. The date used and exchange rate thereof
shall be clearly stated. PCMC reserves the right to use any other suitable exchange
rate for the purposes of uniformly evaluating all Bidders.
11. The Bidding Documents including this RFP and all attached or other documents,
provided by PCMC are and shall remain or become the property of PCMC and are
transmitted to the Bidders solely for the purpose of preparation and the submission
of a Bid in accordance with the Bidding Documents. Bidders are to treat all information
as strictly confidential and shall not use it for any purpose other than for preparation
and submission of their Bid. The provisions of this Clause shall also apply with the
necessary changes having been carried out to Bids and all other documents submitted
by the Bidders, and PCMC will not return to the Bidders any Bid, document or any
information provided along therewith.
12. The Proposals would be evaluated based on the details and data furnished in the Bid.
Mere submission of information does not entitle the Bidder to meet an eligibility
criterion. PCMC reserves the right to verify any or all information submitted by the
Bidder. PCMC’s decision regarding any Bidder's eligibility or otherwise shall be final
and binding and PCMC would be under no obligation to inform any Bidder of the
grounds of such decision.
13. Bidders shall provide evidence of their continued eligibility; in accordance with the
“Qualification requirements” which is satisfactory to PCMC. The PCMC may request
additional information from the Bidder till signing of Concession Agreement. A Bidder
may be disqualified, if it is determined by PCMC at any stage of the bidding process
that the Bidder will be unable to fulfil the requirements of the Project or fails to
continue to satisfy the Qualification requirement. Supplementary information or
documentation regarding qualifications may be sought from the Bidders at any time
and must be provided within time frame period stipulated in such requests. If the
Bidder is unable to provide the information within the stipulated timeframe, then the
Bidder may be disqualified.
14. To assist in the examination, evaluation, and comparison of Proposals, PCMC may, at
its discretion, ask any Bidder for clarification. The Authority may utilize the services of
any consultant or other advisor of the Bidder for the examination and evaluation of
Bidders, Technical Offer and Financial Offer as per the due diligence process. However,
clarifications if any required from Bidder, shall be in writing (typed and duly signed by
authorized signatory) and shall be communicated by the Bidder to the Authority.
15. Information relating to the examination, clarification, evaluation and comparison of
Proposals and recommendations for the award of a contract shall not be disclosed to
Bidders or any other persons not officially concerned with such process until the
award to the “Preferred Bidder” has been announced. Any effort by a Bidder to
influence PCMC or any of its consultants and/or advisors processing of Proposals or
award decisions may result in the rejection of the Proposal.

16. PCMC or any of its consultants and/or advisors will check Bids determined to be
substantially responsive for any arithmetic errors. Wherever there is discrepancy
between the amounts in figures and in words, the amount in words will govern. In
case of difference between original and copies, the information/data/Bid provided in
the original would be considered correct and binding. Any such corrections made by
PCMC shall be considered as binding upon the Bidder and will be duly notified to the
Bidder in writing. If the Bidder does not accept the corrections in Bid, PCMC may reject
the Proposal and forfeit the Bid Security.
17. A Bidder shall not have a conflict of interest (the “Conflict of Interest”) that affects the
Bidding Process. Any Bidder found to have a Conflict of Interest shall be disqualified.
In the event of disqualification, PCMC shall be entitled to forfeit and appropriate the
Bid Security and/or Performance Security, as the case may be, as liquidated damages,
without prejudice to any other right or remedy that may be available to PCMC under
the Bidding Documents and/or the Concession Agreement or otherwise. Without
limiting the generality of the above, determining the Conflict of Interest shall be the
prerogative of PCMC.
18. Without limiting the generality of the above, a Bidder shall be deemed to have a
Conflict of Interest affecting the Bidding Process, if: the Bidder, its Member or
Associate (or any constituent thereof) and any other Bidder, its Member or any
Associate thereof (or any constituent thereof) have common controlling shareholders
or other ownership interest; provided that this disqualification shall not apply in cases
where the direct or indirect shareholding of a Bidder, its Member or an Associate
thereof (or any shareholder thereof having a shareholding of more than 5% (five per
cent) of the paid up and subscribed share capital of such Bidder, Member or Associate,
as the case may be) in the other Bidder, its Member or Associate, is less than 5% (five
per cent) of the subscribed and paid up equity share capital thereof; provided further
that this disqualification shall not apply to any ownership by a bank, insurance
company, pension fund or a public financial institution referred to in section 4A of the
Companies Act, 2013. For the purposes of this Clause, indirect shareholding held
through one or more intermediate persons shall be computed as follows:
• where any intermediary is controlled by a person through management
control or otherwise, the entire shareholding held by such controlled
intermediary in any other person (the “Subject Person”) shall be taken into
account for computing the shareholding of such controlling person in the
Subject Person; and subject always to sub-clause (i) above, where a person
does not exercise control over an intermediary, which has shareholding in the
Subject Person, the computation of indirect shareholding of such person in the
Subject Person shall be undertaken on a proportionate basis; provided,
however, that no such shareholding shall be reckoned under this sub-clause
(ii) if the shareholding of such person in the intermediary is less than 26%
(twenty six percent) of the subscribed and paid up equity shareholding of such
intermediary; A constituent of such Bidder is also a constituent of another
Bidder; such Bidder, its Member or any Associate thereof receives or has
received any direct or indirect subsidy, grant, concessional loan or
subordinated debt from any other Bidder, its Member or Associate, or has
provided any such subsidy, grant, concessional loan or subordinated debt to
any other Bidder, its Member or any Associate thereof; such Bidder has the

same legal representative for purposes of this Bid as any other Bidder; such
Bidder, or any Associate thereof, has a relationship with another Bidder, or any
Associate thereof, directly or through common third party/ parties, that puts
either or both of them in a position to have access to each other’s information
about, or to influence the Bid of either or each other; or Such Bidder or any
Associate thereof has participated as a consultant to PCMC in the preparation
of any documents, design or technical specifications of the Project.
Explanation: In case a Bidder is a Consortium, then the term Bidder as used in
this Clause 3.18, shall include each member of such Consortium. For Clause
3.18 of this RFP, Associate means, in relation to the Bidder/Member, a person
who controls, is controlled by, or is under the common control with such
Bidder/Member. As used in this definition, the expression “control” means,
with respect to a person which is a company or corporation, the ownership,
directly or indirectly, of more than 50% (fifty per cent) of the voting shares of
such person, or the power to appoint majority of the directors on the board of
directors of such company or corporation and/or the power to direct the
management and policies of such person by operation of law, agreement or
otherwise and with respect to a person which is not a company or corporation,
the power to direct the management and policies of such person by operation
of law, agreement or otherwise.
19. A Bidder shall be liable for disqualification and forfeiture of Bid Security if any legal,
financial or technical adviser of the Authority in relation to the Project is engaged by
the Bidder, its Members or any Associate thereof, as the case may be, in any manner
for matters related to or incidental to such Project during the Bidding Process or
subsequent to the (i) issue of the LOA or (ii) execution of the Concession Agreement.
In the event any such adviser is engaged by the Selected Bidder or Concessionaire, as
the case may be, after issue of the LOA or execution of the Concession Agreement for
matters related or incidental to the Project, then notwithstanding anything to the
contrary contained herein or in the LOA or the Concession Agreement and without
prejudice to any other right or remedy of the Authority, including the forfeiture and
appropriation of the Bid Security or Performance Security, as the case may be, which
the Authority may have thereunder or otherwise, the LOA or the Concession
Agreement, as the case may be, shall be liable to be terminated without the Authority
being liable in any manner whatsoever to the Selected Bidder or Concessionaire for
the same. For the avoidance of doubt, this disqualification shall not apply where such
adviser was engaged by the Bidder, its Member or Associate in the past but its
assignment expired or was terminated 6 (six) months prior to the date of issue of RFP
for the Project. Nor will this disqualification apply where such adviser is engaged after
a period of 3 (three) years from the date of Financial operation of the Project.

This RFP is not transferable and can only be used by the person to whom it has been issued.
Any award of Concession pursuant to this RFP shall be subject to the terms of Bidding
Documents.
3.1 Cost of Bidding
The Bidders shall be responsible for all the costs associated with the preparation of their Bids
and their participation in the Bidding Process. PCMC will not be responsible or in any way
liable for such costs, regardless of the conduct or outcome of the Bidding Process.

3.2 Site visit and verification of information


Bidders are encouraged to submit their respective Bids after visiting the Project Area and
ascertaining for themselves the site conditions, baseline of assets, location, surroundings,
climate, availability of power, water and other utilities, access to site, handling and storage of
materials, applicable laws and regulations, and any other matter considered relevant by
them.
It shall be deemed that by submitting a Bid, the Bidder has:
a. made a complete and careful examination of the Bidding Documents;
b. received all relevant information requested from PCMC; made a complete and careful
examination of the various aspects of the Project including but not limited to:
c. The area under planning, existing facilities and structures;
d. The conditions of the key sites in relation to transport accessibility;
e. Conditions creating congestion in transportation networks,
f. Past data available in relation to Comprehensive mobility plan;
g. All other matters that might affect the Bidders performance under the terms of this
RFP; and
h. Acquiring itself with local/central laws and rules & regulations thereto as well as other
applicable rules and regulations relevant of the Project.
i. Accepted the risk of inadequacy, error or mistake in the information provided in the
Bidding Documents or furnished by or on behalf of PCMC relating to any of the matters
referred above;
j. Satisfied itself about all matters, things and information including matters referred to
herein above necessary and required for submitting an informed Bid, execution of the
Project in accordance with the Bidding Documents and performance of all its
obligations thereunder;
k. Acknowledged and agreed that inadequacy, lack of completeness or incorrectness of
information provided in the Bidding Documents or ignorance of any of the matters
referred to herein above shall not be a basis for any claim for compensation, damages,
extension of time for performance of its obligations, loss of profits etc. from PCMC, or
a ground for termination of the Concession Agreement by the Concessionaire;
l. Acknowledged that it does not have a Conflict of Interest; and agreed to be bound by
the undertakings provided by it under and in terms hereof.

PCMC shall not be liable for any omission, mistake or error in respect of any of the above or
on account of any matter or thing arising out of or concerning or relating to RFP, the Bidding
Documents or the Bidding Process, including any error or mistake therein or in any
information or data given by PCMC.

4.2 Evaluation of Proposals

4.3 Evaluation of Financial Proposal


Financial proposals of only those Bidders who satisfy the pre-qualification criteria shall be
opened publicly on the date & time specified in the General Terms of Bidding, in the presence
of the Bidder’s representatives who choose to attend. The name of the Bidder, and their
financial proposal shall be read out aloud.

Department will correct any computational errors. When correcting computational errors, in
case of discrepancy between word and figures the former will prevail.
After opening of financial bid, the Bidder quoting the highest royalty to be given to PCMC in
terms of percentage of the collected parking fees will be awarded the tender. Only those
Bidders qualified in technical bid, will be considered for opening of financial bid. Quote will
be inclusive of applicable taxes, levies etc. This selected firm/consortium will then be invited
for negotiations, if considered necessary.

The Service provider shall submit a Performance Security deposit in the form of a Bank
Guarantee in favour of PCMC by a Scheduled/ Nationalized bank for an amount equal to Rs.
23,75,000/- within 15 (fifteen) days from the date of receipt of Letter of Acceptance.
The Performance Security in the form of Bank Guarantee will remain frozen during the entire
project duration of 3 years or up to the period of extended contract. It will not be released to
service provider before completion of this period.

5 SCOPE OF WORK
5.1 Terms of Contract
The Service Provider will implement, maintain, and collect parking fees on the selected major
corridors in PCMC.
The Service Provider shall carry out the following activities:
● Hardware, software, and facilities:
○ Install, operate and maintain an IT system for collecting parking fees in a cashless
manner and transferring the collected parking fees into an Escrow account into which
all revenue shall be deposited and, thereafter, payments to the Service Provider,
Pimpri Chinchwad Municipal Corporation and other agencies shall be made.
○ Procure software and hardware for the processing of customer payments via credit
card, net banking, mobile-based banking systems, and other media.
○ Establish the required facilities, equipment, and vehicles for the operations of the
Parking System.
○ All equipment used to establish the system must have been manufactured not earlier
than six (6) months before the date of signing of the Service Provider Agreement
between Pimpri Chinchwad Municipal Corporation and the Service Provider. The
equipment shall not have been put to Financial use anywhere prior to the
Commencement of Operations.
● Operations:
○ The service provider will provide one parking attendant per 25 ECS or for 500 m stretch
of the road to ensure an efficient parking operation and less hassle to users.
Depending upon parking demand of the area, the contractor might have to appoint
more than one parking attendant along busy stretches of the selected corridors.

○ Enter into an agreement with Pimpri Chinchwad Municipal Corporation to set up an


Escrow Account into which all revenue, shall be deposited. Payment to the Service
Provider, Pimpri Chinchwad Municipal Corporation and other agencies shall be made
from the escrow account.

○ Collect customer payments via electronic payment media and deposit the same into
an escrow account set up for the purpose of the Parking System. Bidder may use
handheld ticketing cum payment devices similar to those specified for PCMC Smart
City parking sites.

○ Collect applicable Parking Fees using an IT-based system from all users who park their
vehicles in Paid Parking Blocks or Paid Parking Lots assigned to the Service Provider.
The Service Provider will collect cash or other forms of direct payment on the street.

○ Monitor and report violation of on-street parking rules to Traffic Police.

○ Enlist trained professionals to operate the Parking System. The Service Provider will
prepare a Human Resources Plan specifying how personnel will be recruited, trained,

and paid. The Human Resources Plan must be approved by Pimpri Chinchwad
Municipal Corporation.

○ Bear all expenses towards operation of the Parking System through the entire period
and not claim any additional expenses.

○ Waive all rights to sell advertisement space on any elements of the Parking System,
which are retained by and shall vest only in Pimpri Chinchwad Municipal Corporation.
The Service Provider shall be obliged to carry advertisements as specified by Pimpri
Chinchwad Municipal Corporation. The Service Provider shall not carry out any other
Financial activities on or near Parking System facilities unless explicitly approved by
Pimpri Chinchwad Municipal Corporation.

● Customer service:

○ Coordinate with PCMC officials to solve the customer complaints received on PCMC
portal i.e. SARTHI or Parking Mobile App.

○ Service provider may choose to Carry out marketing activities to disseminate


information about the Parking System.

● Legal:

○ Bear all applicable National, State and local taxes on purchase of equipment.

○ Get the necessary licenses and clearances from relevant authorities, for processing
payments and running other operations to fulfil the requirements of the Parking
System.

○ Bear all applicable insurance, including vehicle insurance and passenger insurance as
required under:

■ Any Financing Agreements

■ Laws of India

■ Such Insurances as may be necessary in accordance with the Prudent


Utility Practices.

5.2 Training and testing period


During the Training and Testing Period, the Service Provider shall make available its staff for
the purpose of testing when scheduled by Pimpri Chinchwad Municipal Corporation. Pimpri
Chinchwad Municipal Corporation and Service Provider shall use this period to understand
the intricacies of operations and fine-tune the System. No fines shall be applicable during
this period.

5.3 Determination of parking areas


The following assignment of parking areas will be applicable on the Commencement Date:
● Pimpri Chinchwad Municipal Corporation will assign to the Service Provider a set of
Parking Zones.
● In each Parking Zone, PCMC will mark the on-street parking slots for parking
operations.
For assigned areas, the Service Provider will propose how to manage the parking lots in a
parking Management Plan. The Management Plan must be compliant with the Operating Plan
and is subject to review by Pimpri Chinchwad Municipal Corporation.
After a period of 90 days from the COD, parking areas may be modified as follows:
● Pimpri Chinchwad Municipal Corporation may designate additional locations as Paid
Parking Lots in the Zones assigned to the Service Provider. Such new areas will have
an average Occupancy such that the overall occupancy of Paid Parking Lots in the Zone
is at least 60 per cent.
● The Service Provider may request to have any Unpaid parking lots in a Zone designated
as a Paid parking lots, subject to Pimpri Chinchwad Municipal Corporation approval.
● The Service Provider may request to have a Paid Parking Lot designated as an Unpaid
Parking Lot if the average Occupancy of all Paid Parking Lots in the Zone falls below 60
per cent, subject to Pimpri Chinchwad Municipal Corporation approval.
Modifications in parking areas must be implemented within 30 days after approval is issued
by Pimpri Chinchwad Municipal Corporation.

5.4 Determination of parking fees and fines


● Pimpri Chinchwad Municipal Corporation will set Fee Rates, including the
determination of how Fee Rates will vary by vehicle type, location. As per standing
committee resolution no. 512, dated 26th February 2020, The parking rates per hour
for two-wheelers and autorickshaws will be Rs 5, for four-wheelers Rs 10, tempo and
mini truck Rs 15, minibus Rs 25 and trucks, containers and private buses Rs 100.

5.5 Payment by the Service Provider


The Service Provider shall submit an invoice at the end of each 14 days specifying:
● The total duration of Parking Events by each type of vehicle and by paid/unpaid and
legal/illegal status during the Payment Period.
● Applicable taxes for the period.
● Total parking revenue collection during the Payment Period.
● Any applicable surcharge or cess on it, payable on the amount.
● Supporting evidence, captured from the IT system, verifying the claim.

0The Service Provider shall also submit the daily parking data reports that include the hourly
parking data for the various vehicle types (2W, Rickshaw, 4W, Tempo, Mini Bus, Truck and
Private Bus) at the end of 14 days for review by PCMC along with invoice.

On receiving invoice from contractor PCMC will make the payment as per contract through
the ESCROW account. Payment of royalty fees to PCMC will be made through Escrow account
at the beginning of every month for contract duration.

5.6 Termination of Contract


1. Service provider or any staff working on pay and park site should not mis-behave with
public. If any complaints are raised against the staff, then he/she should be fired from the
position immediately. Service provider as well as his staff should be kind to the public
which is likely to use the pay and park facility. If the users have any complaints regarding
the parking place, then they should be asked to complain the PCMC without hesitating in
written format.
2. In case any Service provider or his staff found misbehaving with the public/users then
their contract will be terminated, and liable actions will be taken against that
misbehaviour.
3. While collecting the fare from parked vehicles, it is necessary to return them a valid
System generated receipt of the same amount.. The fare cannot be collected unless the
standard receipt as confirmed by PCMC is given to the customer. Parking fees need to be
collected through the means of electronic devices and parking coupons only. Fare can only
be collected from those vehicles which are parked in the standard marked area proposed
for parking.
4. Any lease/rent/sub-contracting/outsourcing or land cannot be given by the service
provider on rent further. If found so, then the Pimpri Chinchwad Municipal Corporation
has rights to terminate the contract.
5. As per the pay and park scheme, if any changes are required then the rights to update the
parking plan will be with PCMC. If these changes are not acceptable to the service
provider, then the contract will be terminated, and the sub-contract will be called for the
remaining tenure.
6. If the Service provider is ever dismissed within the contract duration, then its total
duration of contract will be calculated and it will be deducted from the total tenure, and
the suitable amount will be paid to the Service provider. However, due to any kind of
misbehaviour, illegal offense, or any activity not following the rules if observed, then
PCMC has rights, to recover these loss recoveries from Service provider.
7. Service provider is prohibited from unauthorised release of customer or system data. If
found so, the contract will be terminated.
8. Service provider is prohibited from doing any modifications of the design of road markings
and signage without prior authorisation from Pimpri Chinchwad Municipal Corporation.
9. The terms and conditions as stated if not followed by the Service provider, then the Pimpri
Chinchwad Municipal Corporation Municipal Commissioner has rights to terminate the
contract.
