owners of all that piece and parcel of land or ground bearing Plot No. 11
area admeasuring 616 sq. yards, i.e. to say 515.1 sq. mtrs. out of
Dist. Pune, within the Limits of Lonavla Municipal Council and in the
Plot”;
and 3) Mrs. Vimal Narayan Navalkar have sold, transferred and conveyed
Vijayakar, 2) his wife Dr. (Mrs.) Ishwari Vidyadhar Vijayakar and 3) his son
The said Dr. (Mrs.) Ishwari Vidyadhar Vijayakar being the wife of the
leaving behind her Last Will & Testament dated 25 thNovember, 1984
her Executors;
granted to the said Shri Madhukar Yashwant Talpade and Sau. Pramila
Talpade probate of the said Last Will & Testament of the said Dr. (Mrs.)
By, for the reasons and for the consideration recorded in the Release
Assurances at Vadgaon, Maval under Sr. No. 3788 of 1989, the said Shri
Vijayakar and Rohini Chandrakant Vijayakar all the undivided rights held
by the said Dr. (Mrs.) Ishwari Vidyadhar Vijayakar in the said Plot at the
time of her demise in her capacity as one of the heirs and legal
while by, for the reasons and for the consideration recorded in the
Release Deed dated 19th July, 1989 registered at the office of the Sub-

undivided rights held by the said Sanil Vidyadhar Vijayakar in the said
Plot in his capacity as one of the heirs and legal representatives of the
Vijayakar, 2) his wife Reeta Pravin Vijayakar, 3) his son Aneesh Pravin
legal heirs;
21stFebruary, 1999 leaving behind her last Will & Testament dated
24thOctober, 1998 bequeathing her entire share in the said Plot in favour
AND WHEREAS the Vendors thus now are seized and possessed of
and are well and sufficiently entitled to all that piece and parcel of land
area admeasuring 510 Sq. Mtrs situated at village Valvan, Taluka Maval,
Dist. Pune, within the Limits of Lonavla Municipal Council and in the
Vendor No. 1 and Vendor No.3, Vendor No. 2 will not receive any amount
from the Purchasers but Vendor No. 2 is giving his absolute consent to
this Indenture of Sale. Vendor No. 2is having no objection for the said
document, Vendor No. 2 will assign, release, transfer and convey his all
the rights of the said plot to the Purchasers without accepting any kind of
consideration.
Purchasers have agreed to purchase from the Vendors said Plot more
lump sum price of Rs. 79,50,000/- (Rupees Seventy Nine Lakh Fifty
execute the conveyance in their favour for which the Vendors have
Lakh Fifty Thousands Only) paid by the Purchasers to the Vendors Nos. 1
Doth hereby admit and acknowledge and of and from the same and
every part thereof doth forever acquit, release and discharge the

absolutely and forever All that piece and parcel of Non Agricultural land
area admeasuring 510 Sq. Mtrs situated at village Valvan, Taluka Maval,
Dist. Pune, within the Limits of Lonavla Municipal Council and in the
registration sub district of Maval, Taluka Maval Dist. Pune and more
thereof now or at anytime hereto before for usually held, used, occupied
relating to the Said Plot or any part thereof in possession of the Vendors
AND ALSO TOGETHERWITH ALL THE estates, right, title, interest, use,
law and in equity of the Vendors into out of or upon the Said Plot or any
part thereof free from encumbrances TO HAVE AND TO HOLD the Said
Plot and all the singular hereby granted, released, conveyed, intended

members, and appurtenances UNTO AND TO THE USE AND benefit of the
all rents, rates, taxes, assessments, dues and duties now chargeable upon
full and free right liberty and benefit in common of the use of the roads
and open spaces shown in the lay-out for all purposes with or without
persons seeking access to the Said Plot AND the Vendors DOTH hereby
suffered to the contrary, THEY the Vendors now hath in themselves good
right, full power and absolute authority to grant, convey, release, and
assure the Said Plot hereby granted, released and assured or intended so
AND it shall be lawful for the Purchasers from time to time hereafter
peaceably and quietly to hold, enter upon, have occupy, possess and
enjoy the Said Plot hereby granted with its appurtenances and receive
the rents, profits, issues thereof and every part thereof for their own use

and benefits without any suit, lawful eviction, interruption, claim and
to claim by from under or in trust for them ANDTHAT free and clear
defended kept harmless and indemnified of from and against all former
claim by from under or in trust for them AND FURTHER that the Vendors
Said Plot hereby granted or any part thereof by from under or in trust for
them the Vendors or any of them shall and will from time to time and at
all times hereafter at the request and costs of the Purchaser do and
execute or cause to be done and executed all such further and other
assurances in law whatsoever for the better further and more perfectly
and absolutely granting and assuring the Said Plot and every part thereof
hereby granted unto and to the use of the Purchaser in manner aforesaid
cesses and/or other outgoings payable in respect of the said Property till

the date of execution of this Sale Deed whether the demand in this
subscribed their respective hands and seals the day and year first
hereinabove written.
