AN ACT

STRENGTHENING THE BARANGAY UNIT BY PROVIDING FIXED


COMPENSATION AND BENEFITS TO BARANGAY OFFICIALS AND
WORKERS, AMENDING REPUBLIC ACT NO. 7160, REPUBLIC ACT NO.
7883, REPUBLIC ACT NO. 10742 AND PRESIDENTIAL DECREE NO. 1569,
APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES

Be it enacted by the Senate and the House of Representatives of the Philippines in


Congress assembled:

I. TITLE, DECLARATION OF POLICY, DEFINITION OF TERMS, AND


GENERAL PRINCIPLES.

SECTION 1. Short Title. - This Act shall be known and cited as the “Barangay
Officials and Workers Compensation Act”.

SEC. 2. Declaration of Policy. - It is the policy of the State to provide adequate social
services, promote full employment, improve standard of living and quality of life for
all. It is, thus, hereby declared the policy of the State to raise the social and economic
status of barangay officials and workers.

Towards this end, the State shall ensure that effective and enabling mechanisms and
systems that will strengthen the barangay unit will be established. The State
recognizes the necessity to devise policies and measures that will ensure that the
officials and workers at the smallest political unit of the government will be properly
compensated.

SEC. 3. Definition of Terms.- For purposes of this Act, the following terms are
hereby defined:
(a) Barangay Officials shall refer to the elective and appointive members of the
Sangguniang Barangay and Sangguniang Kabataan.

(b) Elective Barangay Officials shall refer to the elective members of the
Sangguniang Barangay and Sangguniang Kabataan.

(c) Appointive Barangay Officials shall refer to the Barangay Secretary, Barangay
Treasurer, Sangguniang Kabataan Secretary and Sangguniang Kabataan Treasurer.

(d) Barangay Workers shall refer to Barangay Nutrition Scholars, Barangay Health
Workers and duly appointed members of the barangay tanod brigades.

Sec. 4. General Principles. - The following are the general principles of this Act:

(a) As the nation’s frontline workers, the compensation given to barangay officials
and workers should commensurate to the vital roles that they play.

(b) The national government should give more attention to the barangay unit since it
is the basic political unit and base of the economy of the country.

II. COMPENSATION OF ELECTIVE BARANGAY OFFICIALS


Sec. 5. Compensation of Punong Barangay. - An amount equivalent to Salary Grade
15 based on the “Salary Standardization Law of 2019”.

Sec. 6. Compensation of Members of Sangguniang Barangay. - An amount


equivalent to Salary Grade 10 based on the “Salary Standardization Law of 2019”.

Sec. 7. Compensation of Sangguniang Kabataan Councilors. - An amount


equivalent to Salary Grade 1 based on the “Salary Standardization Law of 2019”.
III. COMPENSATION OF APPOINTIVE BARANGAY OFFICIALS
Sec. 8. Compensation of Barangay Treasurer and Secretary, SK Treasurer and
Secretary. - An amount equivalent to Salary Grade 1 based on the “Salary
Standardization Law of 2019”.

IV. COMPENSATION OF BARANGAY WORKERS


Sec. 9. Compensation of the Head of Barangay Health Workers, Barangay
Nutrition Scholars and Barangay Tanod. - An amount equivalent to Salary Grade 2
based on the “Salary Standardization Law of 2019”.

Sec. 10. Compensation of Barangay Health Worker, Barangay Nutrition Scholar


and Barangay Tanod. - An amount equivalent to Salary Grade 1 based on the “Salary
Standardization Law of 2019”.

V. ADDITIONAL BENEFITS
Sec. 11. Compulsory Coverage in the GSIS. - All barangay officials, elective and
appointive and barangay workers shall be included in the compulsory membership of
the Government Service and Insurance System under Section 3 of Republic Act. 8291.

Sec. 12. Philhealth Coverage. - All barangay officials, elective and appointive and
barangay workers shall enjoy Philhealth coverage, which shall include medical
examination and treatment in government hospitals, and fully subsidized by the Local
Government Units or through cost-sharing mechanisms between LGUs and other
sponsors.

Sec. 13. Free Legal Services. - All barangay officials, elective and appointive and
barangay workers shall enjoy free legal services from government lawyers or private
lawyers pursuant to Republic Act No. 9999 and Bar Matter No. 2012, for cases arising
from acts committed in the performance of duty. Provided, that such legal services
shall continue, even after the expiration of the term of the barangay official or worker,
until its final disposition.

VI. ADMINISTRATION AND ENFORCEMENT


Sec. 14. Rules and Regulations. - The Secretary of Department of Interior and Local
Government shall promulgate such rules and regulations as may be necessary to carry
out the provisions of this Act. The rules and regulations promulgated pursuant to this
Section shall take effect (90) days after publication in a national newspaper of general
circulation and by such other means as the Secretary of Local Government deems
reasonably sufficient to give interested parties general notice of such promulgation.

Sec. 15. Non-diminution of Benefits. - Nothing in this Act shall be construed to


remove or in any way diminish benefits, incentives or other entitlements provided to
or enjoyed by barangay officials and workers under other laws and issuances, at the
time of the promulgation of this Act.

Sec. 16. Appropriations. - The Secretary of Department of Interior and Local


Government shall submit to Congress the necessary budgetary estimates to properly
implement the provisions of this Act. Such estimates and other amount as may be
needed for the continued implementation of this Act shall be included in the Annual
Appropriations Act, of the city or municipality where the barangay is located, in the
fiscal year following the passage of this Act.

Sec. 17. Separability Clause. - If any provision of this Act is declared


unconstitutional or invalid, the remainder or any provisions thereof not affected shall
remain in force and effect.

Sec. 18. Repealing Clause. - All laws, executive orders, decrees, instructions, rules
and regulations contrary to or inconsistent with any provision of this Act are hereby
repealed and modified accordingly.
Sec. 19. Effectivity Clause. - This Act shall take effect fifteen (15) days after its
publication in a national newspaper of general circulation.
