OPERATIONAL CONTROL PROCEDURE MANUAL

Refusal of Unsafe Work

A worker has the right to refuse unsafe work that they feel will put their lives or the lives
of others (workers or the public) in danger.

A person must not carry out or cause to be carried out any work process or operate or cause
to be operated any tool, appliance or equipment if that person has reasonable cause to
believe that to do so would create an undue hazard to the health and safety of any person.
A worker who refuses to carry out a work process or operate a tool, appliance or equipment
must immediately report the circumstances of the unsafe condition to his supervisor or line
manager.

The worker must immediately inform his supervisor of the motives for this decision.

The immediate supervisor must then evaluate and make a decision for or against the work
procedure and must attempt to redress the situation to the satisfaction of the worker.

If that is not possible, he must contact their Line Manager and the Site Safety Officer so that the
later may give his opinion with regards to the application of safety regulations and
Occupational Health & Safety Manual.

A supervisor or line manager receiving a report, must immediately investigate the matter and
ensure that any unsafe condition is remedied without delay, or If in his opinion the report is
not valid, must so inform the person who made the report.
