ORDER

The Mining Engineer Udaipur, State of Rajasthan

present before us, submits that steps with regard to

compliance of the earlier orders, inter-alia, filling of the pits

are being taken and the same would be completed soon.

The Learned Counsel for the applicant has informed us

that mining is still going on in the catchment area of

Jaisamand Lake, including in the rivers bed of rivers

Makredi, Gomati and Jhamri. In support of the submission,

she has placed before us some photographs taken since

15.10.2019, by the applicant in a mobile.

 Therefore, we direct the Director, Mining and Geology,

State of Rajasthan to file a personal affidavit in respect of

the allegations made by the Counsel for the applicant that

mining in the aforesaid areas is still continuing. He shall

also depose as to why mining operations have not be

completely stopped in the entire catchment area of

Jaisamand Lake. He shall also give the special reasons

which prevented them from not fully complying the order

passed by the Tribunal in respect of stoppage of mining. So

far as the amount of environmental compensation is

concerned, the officer informs that the same has been

deposited with the authority concerned.

List the matter on 06th November, 2019.
