J&T EXPRESS TERMS AND CONDITIONS

1. GENERAL PROVISIONS

J&T Express, the Sender and Consignee are bound to the terms and conditions of this contract.
This contract is NON-NEGOTIABLE. The Sender acknowledges that he/she is the owner of the
goods transported or is the authorized agent of the owner of the goods, and that he/she hereby
accepts the terms and conditions for himself, or on behalf of any person having interest in the
declared shipment.
The final interpretation rights and copyright belong to the HQ Customer Service Department alone.
No employee, agent, or any representative of the company has authority to alter, waive or modify
any provision of this contract unless they were commissioned to do so.

2. GENERAL PROVISIONS OF THE SENDER

The Sender must prepare the package properly based on the J&T Express packaging guidelines in
order to protect the goods during the delivery process. If any loss or damage arise due to improper
packaging, the loss or damage resulted from the negligence of the Sender to properly package the
item is the responsibility of the Sender.

The shipment must be properly marked and both the addresses of the Sender and the Receiver
must be written accurately and clearly. All information given must be true and correct. In the event
that the address provided by the Sender is incorrect, the corresponding charges for re-forwarding or
return will be charged to the Sender.

The Sender must declare accurately the content and value of the package. J&T Express will not be
held liable to compensate any loss or damage arising from the discrepancy due to false, inaccurate
or incorrect declaration made by the Sender which is stated in the waybill. It is solely the responsi-
bility of the Sender if there will be losses or damages not covered due to inaccuracy of information.

3. PROVISIONS FOR SENDING ITEMS

J&T Express may have to open and check the package prior to acceptance of the parcel for deliv-
ery in the presence of the Sender or authorized representative to ensure that the package contains
no hazardous or prohibited content. J&T Express reserves the right not to accept parcels which, in
its discretion, would violate its internal policies and pertinent government laws.

J&T Express has the right but is not obliged to check each packages to ensure the goods to be
delivered do not violate all applicable law. If the Sender sends items which are prohibited and
restricted, without J&T Express’ knowledge, the Sender hereby frees J&T Express from all damag-
es, losses or other costs and demands which will be incurred from any party.

4. PROHIBITED / RESTRICTED ITEMS

J&T Express does NOT allow delivery of items such as: corpses or its parts; living or dead

animals; drugs; weapons; ammunition; flammable materials; high-value non-aesthetic or

aesthetic items; and other items prohibited and restricted by the government.

The sender warrants that:

•The shipment contains no hazardous, prohibited and/or restricted items such as but not

limited to drugs, pirated items, guns, air soft guns, toy guns, explosives (solid, liquid, or gas),
ammunitions, flammable solids, organic peroxides, lottery tickets, wet ice (frozen water), animals,
plants, cash or any equivalent (coins, currency, paper money, negotiable instruments equivalent to
cash such as endorsed stocks, bonds, cash letters, checks), valuable documents such as but not
limited to original copies of passport, visas and land titles, as well as valuable items such as but not
limited to jewels and the like.

•The following are J&T’s unacceptable items for shipment: items that are fragile, liquid,
perishable and subject to inherent melting such as but not limited to baked goods, anything with
glass, home appliances, computers, electronics, shampoo, watches, etc. If the sender continues to
send these items, the sender will be liable. J&T will not be liable for damages incurred by shipping
perishable or breakable items as well as inherent damage and spoilage incurred during pick-up,
transit and delivery of these items.

•This shipment does not contain anything that, its carriage is prohibited by Philippine law,
statue, or regulations. In such case that an item prohibited shipped by Philippine Law is sent
through J&T, the company holds the right to report the sender to the police and for the item to be
confiscated.

•In any case the shipper and/or consignee sends/receives anything prohibited by Philippine
law, only the shipper and/or consignee shall be liable for any legal action resulting to these.

5. GENERAL LIABILITY

J&T Express shall transport and deliver goods safely to its destination, but shall not be liable for
damages, losses, destructions or deterioration of goods due to any of the following causes: (a)
flood, storm, earthquake, or other natural causes or disaster or calamity, (b) act of war, acts of
government authority, whether international or civil (c) act of omission of the sender (d) character of
the goods or defects in packaging or containers.

J&T Express shall compensate items only if the Sender has paid the valuation fee and has declared
the goods value of the shipment. The valuation fee is 1% of the total declared value, paid by the
sender on top of the shipping fee. J&T Express shall not compensate items with no valuation fee.
Valuation fee is 1% of the declared value regardless of the maximum claims settlement, which is
Php 30,000.

J&T Express will only compensate losses and damages if the declared value is stated and if valua-
tion fee is paid.

6. LIABILITY

The minimum valuation fee to be paid is Php 5.00 and the maximum amount for liability is Php 30,
000 per shipment.

• For total loss of items, J&T Express shall be liable for the shipping fee and the declared
value.

• For partial loss and damage of items, J&T Express shall be liable for the shipping fee and
the declared value, divided by the number of items in the shipment.

 •For loss and damaged items with POD (Proof Delivery) scan and/or delivery signature ID,
J&T Express shall be liable for the declared value of the shipment only.

• For damaged items with no POD (Proof of Delivery Scan) and/or delivery signature ID, J&T
Express shall be liable for the shipping fee and the declared value of the item.

• J&T Express shall not be liable for delays in delivery, loss of profits and income due to
delayed delivery.

J&T Express will not compensate shipments of more than Php 30,000.00. In case the sender has a
shipment of worth more than the Php 30,000.00, the Sender acknowledges that J&T Express will
not be liable for any damage or loss that the shipment would incur, that is higher than the said
amount. The Sender will have to ship the item on his own risk.

7. CLAIMS VALIDITY

Sender is the only authorized to send claims and or complaints. Further, claims and/or complaint
that were submitted beyond the lead time, also without any valid and/or complete documents, will
not be accepted by J&T Express.

• Complaints for loss shipments are valid and will be processed if submitted 30 days after
the date of shipment.

• Complaints for damaged shipments are valid and will be processed if submitted 7 days
after the date of delivery (POD).

• Damaged shipments that are found under J&T Express premises, whether that is in the
branch, delivery center or distribution centers, will automatically be processed for claims,
except for when the applicable provisions and circumstances mentioned.

8. EXECUTION

This document will be released on November 1, 2019 and will be final and statutory, based on J&T
Express’s policies and regulations. J&T Express will continue to receive cases of damaged and lost
for shipments prior to November 1. Absolute implementation will commence on November 1, 2019.
As of November 30, customer may still submit claims cases for lost and damaged items prior to
November 1 shipment.
