TERMS OF REFERENCE
FOR THE IMPLEMENTATION AND COMPLETION OF THE
PROPOSED
1.0 INTRODUCTION
1.1 The Government of Malaysia (Ministry of Education), has decided to appoint Consultants
to undertake
1.2 “Consulting Engineer” (hereinafter referred to as “the Consultant”) means the Mechanical &
Electrical consultant engaged by the Government to perform the professional services as per
mentioned under Section 3.0 and Section 4.0 of the Terms of Reference.
1.3 The Government has agreed to appoint the Consultant to provide professional services in the
discipline of Mechanical and Electrical Engineering including other associated engineering
works, to enable the Government implements project successfully. Relevant services required
from the Consultant include Mechanical and Electrical Engineering analysis, environment
impact, design and drafting, preparation of work and material specifications, acting as
submitting person and coordinator on behalf of the Government in obtaining related M&E
planning permission from relevant Local Authority, preparation of tender and construction
drawings, monitoring and supervision on site.
In order for the physical implementation of the Government’s project to be on schedule, the
deliverables such as the Mechanical and Electrical drawings, calculation sheets, review
reports all duly signed by the Consultant together with the relevant specifications must be
ready before tender stage.
2.1 The main objective of this appointment is to assist the Government to implement the Project
within the time schedules as instructed by the Government.
2.2 The Consultant is required to produce designs and provide supervision as directed by the
Government.
2.3 In addition, the professional services rendered should also allow the following objectives to
be achieved:
2.3.1 Safe, functional and stable M&E System.
2.3.2 Value engineering, buildable and economical to install.
2.3.3 Durable and economical to maintain.
2.3.4 The planning, designing and physical development of the Project must
conform to the project briefs, schedule of accommodation, current procedures,
government circulars and guidelines, standards, norms, bylaws, conditions of
relevant professional codes of practice, including requirements by the relevant
Local Authorities.
A brief description of the project (Project Brief) and the Project Scope of Services are given in
APPENDIX A1, APPENDIX A2 and APPENDIX A3 attached.
4.1 General
The Consultant shall undertake all works herein described to achieve the objectives
mentioned under Section 2.0 of the Terms of Reference unless such works has been
implicitly excluded in his appointment. In carrying out this work the Consultant shall
cooperate fully with all Government Department/Agencies and other consultants appointed
for the project.
The Consultant shall plan and perform the work in manner so as to ensure all facilities are
perfectly coordinated both from the point of view of logical progression of design, etc and
the most rapid implementation of physical work. To this end, the consultant shall provide a
bar chart of both the works called for and the implementation of construction.
The scope of work to be carried out by the Consultant shall be inclusive but not limited to the
following:
(e) Within 2 weeks after the appointment, the Consultant is to submit his
proposed Implementation Schedule for the Works, as per APPENDIX B.
4.3.1 All engineering design and specifications shall conform to the rules and regulations
of all relevant authorities including, but not limited to, the following :
(a) Jabatan Keselamatan dan Kesihatan Pekerjaan (JKKP),
(b) Suruhanjaya Tenaga (ST),
(c) Pemasangan Elektrik untuk peraturan pendawaian IEEE,
(d) Piawaian Malaysia (MS),
(e) Piawaian British (BS),
(f) International Electromechanical Commissioning (IEC),
(g) Jabatan Kerja Raya,
(h) Jabatan Bomba dan Penyelamat,
(i) Undang-undang Kecil Bangunan Seragam (UBBL),
(j) Majlis Perbandaran/ Tempatan,
(k) Jabatan Alam Sekitar,
(l) All other local Authorities / Organization having jurisdiction over the
installation of the works.
4.3.2 The Mechanical systems design and specifications shall generally comply with the
latest relevant Malaysian Standards or British Standards or codes of practice and
Jabatan Kerja Raya guidelines. The other relevant standard codes of practice to be
complied with are:-

(a) N.F.P.A, USA
(b) F.O.C, UK
(c) Australian Standards (AS)
(As spelt out in the Uniform Building By-Laws 1984)
4.3.2.2 Air Conditioning and Mechanical Ventilation System
(a) ASHRAE
4.3.3 The metric system of units shall be adopted in all design calculations, specifications
and drawings. Drawings shall be A1 size i.e. 594cm x 841cm and transparencies are
to be prepared in ink on stable reproducible material and have title blocks approved
by the Government.
Only web-based ELV system shall be undertaken by ICT specialist. The Design and
drawing shall be based on recent technical specification and guidelines, if available.
The ICT specialist shall communicate with the electrical consultant for the electrical
works connected to it.
The Consultant shall make every endeavour to optimise the design in the interest of
future electrical load growth and economy of design and also negotiate with the
Supply Authority for the optimum possible tariff structure.
The title panel is to be placed at the bottom right hand corner of the drawings. All
drawings, whether preliminary or final shall be signed by the Professional Electrical
Engineer of the Consultant and all plans submitted for approval shall also bear the
Professional Engineer’s (of electrical discipline) seal.
The Consultant shall submit a preliminary cost estimate to the Government for budgetary
purpose immediately after the completion of the preliminary design work.
On completion of the final design work, the Consultant shall prepare a detailed Bill of
Quantities (BQ) for all items required, inclusive of all quantities and measurements. The Bill
of Quantities shall follow the format practised by the Government and as approved by the
Government. The practice of putting “lump sum” quantities shall be avoided.
The Consultant shall also prepare a detailed cost estimate based on the Bill of Quantities. The
detailed cost estimate shall be signed by the Consultant (Mechanical and Electrical
discipline) and submitted to Government under confidential cover. The estimates shall be
based on realistic current market prices.
4.6.1 The Consultant shall prepare complete tender documents based on the standard
government Conditions of Contract, Form of Tender, Schedule of Accommodation
and other documents currently in use for Mechanical & Electrical Engineering
works. Prior consultation with the Government will be necessary before the tender
documents are drawn up.
4.6.2 The Consultant shall prepare the necessary specifications which shall be submitted
to the Government’s approval. The specifications shall be complete and clear and
shall cover the various aspects of the work.
4.6.3 Two (2) draft copies of the tender documents shall be submitted for the
Government’s review at least 4 weeks before the date scheduled for the calling of
tenders. Final tender documents shall only be printed after the draft documents have
been approved by the Government. The Consultant shall be informed of the number
of copies he has to furnish to the Government.
4.6.4 A complete set of the tender documents and drawing (AutoCAD format) shall also
be submitted to the Government in compact disc.
4.6.5 The Consultant must ensure that Contractors are made aware of the commissioning
requirements and the extend of demonstrations they will be required to complete
prior to acceptance of their works in his specifications.
The Consultant shall be required to evaluate tenders submitted. The Consultant shall put up
his evaluation reports and recommendations within
two (2) weeks after receiving the submitted tender documents from the Government.
Where required and relevant to the Project, to carry out site inspection, m a k e a s s e s s
m e n t and submit report of abandoned works to the Government. This to include;
(a) To determine the overall scope and quantum of actual work done on site prior to its
abandonment.
(b) To determine the current status of work in terms of safety, quality and quantum of
work on site that has been damaged or diminish in value due to neglect,
weathering, wear and tear, theft, vandalism, misuse etc; and
(c) To determine the overall scope and quantum of new works required to be carried
out to bring the Project to its final completion.
If necessary and so required by the Authorities, the Consultant at their own expense may
engage and appoint suitably qualified third party/parties to render services for such as
research, data collecting etc. The fee for such appointment/s must firstly be deemed to be
reasonable and finally agreed upon by the Government. It should be done in accordance to
guidelines of the respective third party/parties Professional B o a r d s t o g e t h e r with a
formal, legal and separate agreement mutually agreed upon and signed by the third pa r t y
/parties a n d t he C o n su l t a n t . The Government shall reimburse the Consultant all
claims for these services upon receipt of claims supported by invoices, receipts and all
relevant and necessary documents.
To act as the coordinator between the Government and other Local Authorities/Statutory
Bodies personnel, work force or contractors for utility diversion, reinstatement,
reconstruction, investigation and maintenance and for all works outside the Project boundary.
To manage, administer and supervise the physical, financial and contractual aspects of the
Project, including recommendation for payments, finalizing accounts etc. all in accordance
with the standard Government conditions, rules and regulations.
In the course of implementing the Project, the Consultant shall be paid for basic services
rendered as per schedule of fees laid out in APPENDIX D.
4.13 Site Supervision
4.13.1 To advertise, interview and evaluate suitable and qualified candidates for the
purpose of appointing them as Site Staff/s to supervise and monitor the Project
from Site Possession stage till the first 3 months of Defect Liability Period (DLP);
subjective to Government’s approval. The Government shall determine and
establish the number of staff, experience, qualification, tenure of service, time
inputs, date of commencement of service and remuneration of the Site Staff/s to
be appointed.
4.13.2 Upon final approval of the appointment/s of the Site Staff/s by the Government,
the Consultant shall officially appoint the successful candidate/s. The appointed
Site Staff/s shall understand and responsible to all duties and job scope as per
mentioned in APPENDIX E.
4.13.3 The Consultant shall be responsible for the supervision of the Mechanical and
Electrical works including certifications of all works.
4.13.4 The Consultant shall ensure that the supervisory staff is stationed on site as soon
as the M&E construction works commences and at all time until the
construction is completed.
4.13.5 The Consultant shall follow strictly the instructions issued by the Superintending
Officer (S.O.)/S.O Representative of the Project in carrying out the supervision of
the works.
4.13.6 The Consultant shall endorse As-Built Drawings submitted by the Contractor at
the end of the project.
4.13.7 The Consultant shall show proof of the validation of the design inputs.
The various activities of work to be carried out are described below. The Consultant’s duties
shall include, but not necessarily be limited to:-
The Consultant’s supervision staff shall be skilled and experienced in construction works and
contract procedures to coordinate construction and maintenance activities on site.
(a) Provide full sets of handing over documents (bind in hard cover with thickness not
exceeding 100mm per volume) including records, manuals, drawings, technical data
and warranties as are necessary for operation and maintenance for the handing over
of the Project (refer APPENDIX F).
(b) Provide and handover of the above documents and drawings to the Government
within three (3) months from the date of Practical Completion (CPC).
(c) It must be signed and sealed (with original signatures) by a certified Professional
Engineer, registered with the Board of Engineers, Malaysia, certifying that the
drawings are correct and accurate.
(d) All drawings/files shall also be submitted in soft copy using AutoCAD and PDF
in CD-ROM prepared to the drafting standard specified.
5.1 The duties and responsibilities shall be in accordance with the “Memorandum of
Agreement” between the Government and respective consultants and the code of ethics of
respective Professional Institutions and Boards.
5.2 The Consultants are expected to execute their duties and responsibilities with due care, best
engineering practice, value engineering, best standard of skill, diligence and efficiency so as
to achieve standard of work.
5.3 The Consultant shall at all times act in a manner so as to protect the Government’s interest,
indemnify and defend at their own expense, the Government and its agents from and against
all actions, claims, liabilities arising out of acts of omission by them or their agents in the
performance of their services. Consultant are bound to Akta Rahsia Rasmi 1972 (Akta
88) on all information acquired during project implementation.
5.4 Should the Consultants be found to commit acts of omission by producing incorrect,
incomplete, unworkable, unsafe design, details, calculations, data and specifications in terms
of architectural, engineering drawings and bills of quantities which result in an additional
cost of the Project to the Government, the said cost shall be deducted from their consultancy
fee at a percentage or the whole cost whichever deem appropriate by the Government in
accordance with ‘1PP PK8/2013’ and ‘1PP PK3.1/2013’ together with APPENDIX B.
5.5 The agency may put Liquidated and Ascertained Damages (LAD) on consultant if there are
delays in Implementation Schedule that have been agreed in the agreement. LAD is made
through the progress payments based on the following formula (refer ‘1PP PK3.3/2013’ para
5.3):
5.6 The Consultants must avoid being a party contributing, in whole or in part, to any form
of delay or inaction during the administration of the contract resulting in the eventual
completion delay of the Project. Penalty shall be taken in accordance to ‘1PP PK8/2013’
together with Consultant Monitoring System of the Government. The delays or inactions
would include among others;
(a) Failure or delay to meet targeted datelines or milestones during all phases of the
implementation of the Project.
(c) Failure or delay in administering the issuance of certificates for Variation Orders
(VO), Extension Of Time (EOT), Certificate of Non- Completion (CNC) and
Certificate of Practical Completion (CPC) at the appropriate time according to the
contract.
(d) Failure or delay in administrating and getting all necessary approvals, clearances,
endorsements, waivers and calling for testing, inspections from all relevant
approving authorities for all works necessary for the purpose of handing over of the
Project and the issuance of Certificate of Completion and Compliance (CCC).
5.7 Should the Consultants be found to commit such delays or inactions, they shall be held
responsible and liable for any claim for loss of use and opportunities, inconveniences and
other related losses deem appropriate by the Government. The Government thus, reserves
every right to withhold or deduct a percentage from the Consultant’s fee to the amount
deem appropriate and through all legal avenues available to the Government.
(Notes: Implementation Schedule and Work Schedule for Mechanical and Electrical
must be bind within the MOA and used as a guide for LAD purposes)
All materials and workmanship shall be specified to comply with Malaysians Standards and Codes
of Practice. Where these are not available then British Standards or its equivalent may be adopted
instead. If departure from the Malaysian or British Standard or Code of Practice is considered
desirable, prior consultation with the Government is necessary. Materials of Malaysian origin are to
be specified throughout in preference to imported materials and the use of proprietary names is to be
avoided in the specification. Where this is unavoidable or where materials of foreign manufacture
have to be specified, the prior approval of the Government has to be obtained.
The Government may wish to assign one or more professional staff to the Consultant for ‘on job
training’ experience with the works. A decision will be taken on this matter at the time of contract
negotiation and Consultant shall be prepared to accommodate the Government requirement in this
regard.
8.1 Prior to appointment, the Consultant are required to submit their Technical and Financial
Proposals to the Government. Since time is an essence, the Consultant shall, when
submitting, comply closely to the proposed Implementation Schedule.
8.2 The Consultant shall cooperate with the lead Consultant in coordinating with all other
supporting consultants and submit a proposal covering both Technical and Financial, in two
(2) hardcopies and one (1) soft copy (in CDROM) under sealed cover to the Ministry of
Education on the following manner:-
8.2.1 Schedule A – Organization Set Up
The overall organization of the Project team in the firm, giving names,
designations, salaries, time input, etc. supported by relevant documents as proof.
8.3 All claims from the Consultant shall be included with original invoice. Failure to do so, the
Government entitles to not make any payment for the said invoice. The Consultant are
bound to Seksyen 18 Akta Pencegahan Rasuah Malaysia Tahun 2009.
8.4 In the course of completing the Project, the Consultants, shall provide free of charge to the
Government the followings:
(b) All communication expenses such as telephone, postage, courier services, facsimile,
normal correspondences between the Consultants, Contractors and the Government.
(c) The cost for preparing and submitting two (2) hardcopies and one (1) softcopy
(in CDROM) of their Technical and Financial Proposals.
(d) Six (6) copies of their Memorandum of Agreement including stamp duty for all
six (6) copies.
8.5 The Government shall however, reimburse the Consultants for the following services if
necessary: -
(a) Traveling and subsistence allowances for supervisory staff as stipulated in ‘1PP
PK3.1/2013’ and ‘1PP PK3.2/2013’ or other current edition of the same issued by
the Ministry Of Finance, Malaysia.
(b) Any extra sets of drawings/documents required by the relevant Authorities or the
Government. (In the course of carrying out their
work at all stages of the Project, each Consultant and Contractor is entitled and
limited to use one (1) set of drawings/documents fully paid by the Government.
Each Consultant and the Contractor are at liberty to request for additional set/s of
drawings/documents but this additional set/s shall be at the Consultant’s or
Contractor’s own cost).
8.6 No other claims for extra remuneration will be entertained as such cost will be deemed to be
included in the Consultant fees.
8.7 All claims including claim for reimbursable must be submitted to the Government not more
than three (3) months from the event. Any claims beyond the stipulated time will not be
considered.
Within two (2) weeks after the appointment of the Consultant, he is to submit his proposed
Implementation Schedule for the overall design of the project for approval by the
Government. The items should include the following:
The Consultant shall make every effort to complete their assignments before the dates
stipulated in the Implementation Schedule.
The Consultant shall submit two (2) copies of the preliminary report and drawings to the
Government before carrying out the detailed design of the works. These shall be submitted
according to the Implementation Schedule agreed upon in Clause 9.1 and shall generally be
not later than four (4) weeks after the appointment of the consultant.
The Consultant shall submit two (2) copies of progress report to the Government within the
first week of each month, showing the progress of his work. The first report is to be
submitted within four (4) weeks after the appointment of the Consultant.
9.4 Initial Design
The Consultant shall submit an initial design and the related reports together with drawings to
the Government before starting the detailed design work. The document shall be submitted in
duplicate copies.
Two (2) copies of the final reports including all detailed drawings and calculations shall be
submitted to the Government. All design calculations shall be properly bound and set out in
an orderly manner. The design calculation submitted must be complete and be legible. Where
computer results are used, a full description of the computer programmed used, its input and
assumptions made must be included.
All reports, calculations and associated drawings shall be signed and sealed by the
Professional Engineer’s of the Consultant.
Failure to comply will render the report unacceptable and the same will be returned to the
Consultant for resubmission.
9.6 Test Record Sheet and Declaration Form for Construction Stage and T&C Stage
Two (2) copies of the Test Record Sheets, Final Acceptance Record Sheets together with the
appropriate calculation to prove the final result, and the related Declaration Forms (Refer
APPENDIX G1-G10) shall be submitted to the Government on the day of hand over of the
works. The final Acceptance record Sheet and the Certificates of Completion shall be in
format approved by the Government. They shall be signed by the Consultant.
Upon completion, the Consultant shall also recommend to the Government, the Competent
Persons necessary for the routine inspection and daily operations of the installation according
to the Law. The recommendation shall be complete with number and class of personnel
required including its cost implications.
The Consultant shall furnish two (2) sets of the as-built drawing of the works designed and
supervised by him within three (3) months of the date of final completion together with
two (2) sets of operation and maintenance manuals for each system and service.
9.8 A complete set of the test records, final acceptance record sheets, as-built document and
drawing (AutoCAD Format) shall also be submitted to the Government in compact disc.
10.0 PROJECT COORDINATION
The Consultant shall liaise and coordinates very closely with the Architect, C&S Engineer and the
Quantity Surveyor for the work.
The Consultant shall attend all the coordination and site meeting and also to ensure that the works
proceed smoothly.
All reimbursable items, especially out of pocket expenses, shall be claimed on a monthly basis.
Any reimbursable claims which are outstanding after three (3) months shall not be entertained.
12.0 AGREEMENT
The Consultant shall prepare Six (6) sets of agreement (BEM/JKR Form A {Revised 1/83}) for
signing not later than three (3) months after the date of the Letter of Appointment.
The Consultant shall be responsible for any damage to life and property that may arise out of their
works and they shall take all necessary insurance cover to indemnify the Government from any
claims for compensation that may arise through their negligence.
After the conclusion of the successful negotiation/tender and thereafter the appointment, the
Consultants shall make all necessary arrangement to commence their services not later than two (2)
weeks from date of issuance of the Letter of Appointment and complete the services within the
periods indicated in the Implementation Schedule proposed by the Consultants or any extended
period as and when approved by the Government / Client.
The Consultant is obliged to follow the Government instruction at any time and must liaise with
other consultants.
The Consultant must ensure that the system can be installed without difficulties. In other
words the Consultant has to consider this aspect in his design so that the cost is not
unnecessarily increased due to poor consideration for construction.
In cases where special technique will be required and it is not available locally, the
Consultant must inform and get the approval of Government before proceeding with the
design. In asking for such approval the Consultant must come up with the proposals and cost
estimates.
The Consultant must ensure the adequacy of the design. In cases of construction failure the
Consultant will undertake to give advice and detailed repair proposal. Any failure due to
design inadequacy shall be borne by the Consultant.
In the event of failure of the system after installation, the Consultant will bear the cost of
remedial work if the failure is due to his negligence in design.
The Consultant should take into consideration the maintenance aspect of the system in their
designs. In principle the system should be easily and practically maintained. Where
specialized maintenance is anticipated, the Consultant should advice the Government on the
matter and to seek approval before proceeding with the design.
17.0 DISPUTES
17.1 Any disputes that arises between the Consultants and the Government in their appointment
and performance of their services should be referred to the following circular/s issued by the
Ministry of Finance Malaysia or any other current circular/s in relation to it issued by The
Government of Malaysia;

Note :
C. "Works" means the Works in connection with which the Government has engaged the
Consulting Engineer to perform professional services, and which may comprise:
1. Type A Works, namely - civil and structural engineering Works (other than structural
engineering works in buildings) and mechanical engineering works and electrical
engineering Works (other than engineering systems in buildings); and/or
2. Type B Works, namely - structural engineering works; and/or
3. Type C Works, namely - engineering systems in buildings
* The Pactual (actual percentage) to be used shall be a value within the range P(min) to P(max), and shall be
agreed to between the client and the consulting engineer prior to the engagement. Selection of the actual
percentage shall be based on the complexity of the works.
The Consultant shall ensure that at specified time shown in Schedule C while undertaking the Project,
the Resident Engineer acceptable to the Government shall take charge of the operations of the Project.
The Resident Engineer shall be responsible for liaison between the Consultant and the Government. The
duties of the Resident Engineer are as follows:
a) He shall organise and phase the duties of his staff to suit the construction programme.
b) He shall supervise the permanent work to ensure that it executed to the correct line and level, and
that the materials and workmanship comply with the specification.
c) He shall execute or supervise test carried out at the site, and he shall inspect materials and
manufacture at source.
d) He shall issue instructions and drawings to the Contractor’s Agent.
e) He shall agree departures from the contract documents upon in consultation with the Project
Manager.
f) He shall draft variation orders and pass them to the Project Manager.
g) He shall keep a diary constituting a detailed history of the work of the construction and of
significant happenings at the site, and submit regular periodic progress reports to the Project
Manager.
h) He shall keep records of inspections, variations, testing and point of contention.
i) Where the Contractor claims payment for additional work, he shall check with the Contractor and
record all relevant circumstances, including the cost of labour and materials, seeking agreement on
matters of fact before any question of principle has to be decided by the Project Manager or an
Arbitrator.
j) He shall record and check the progress of the work against the programme.
k) He shall assist in measuring, in agreement with the Contractor’s staff, the quantities of the work
executed, and he shall check daywork and other accounts for interim and final payments due to the
Contractor.
l) He shall examine methods proposed by the Contractor for executing the work, and temporary work.
m) He shall redesign work to the extent that this may be delegated by the Project Manager.
n) He shall record on drawings prepared for the purpose, the actual level and nature of all
foundations, the strata encountered in excavation, and full details of any deviations from the
working drawings which have been made
during the execution of the work.
o) He shall observe the behavior of t h e f i n i s h e s works, recording movements, settlements etc.
p) He shall keep all Project Manager’s staff fully informed on matters which may affect their work,
including copies of the relevant site instructions and correspondence.
1.0 GENERAL
2.1 To assist the Site Manager / Resident Engineer to check and coordinate all drawings
inclusive of Civil and Structure Drawings, Mechanical & Electrical Drawings, shop
drawings, and Bill of Quantities and specification to ensure the conformity for
construction purposes.
2.2 To assist the Site Manager / Resident Engineer to check and ensure all materials are
used for construction are according to specification and approved quality.
3.1 To monitor, coordinate and to ensure the construction works are according to drawings,
specifications and Conditions of Contract.
3.2 To ensure the progress of work is according to approved programme of Work and to be
completed accordingly.
3.3 To prepare the daily report and report to Site Manager / Resident Engineer on daily basis
of the progress work.
3.4 To coordinate the aspect of architectural works and related scope of works.
3.5 To check all materials related to architectural works are according to drawings,
specification and approval before the installation.
3.6 To witness all tests and construction works related to M&E works.
3.7 To attend all related meetings, discussions, site visits, auditing sessions and so on.
3.8 To evaluate and report on the progress of work executed by the Contractor.
3.9 To carry out all instruction given by S.O / S.O’s representatives, Site Manager and
Resident Engineer as required.
3.10 To witness all test and construction of all M&E works according to detail drawing
approved by Local Authorities and conforms to Architectural, Civil and Structural
Scope of Works.
4.0 OTHERS
4.1 To administer and coordinate other related Scope of Works on site as required.
4.2 To maintain site diary.
