CONTRACT OF SERVICES

(Hauling of Gravel, Sand and Boulders)

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT made this ____ day of August 2020 by and between the
following parties, to wit:

_______________________, a trucking corporation/partnership duly

registered with the Securities and Exchange Commission and issued a permit to
operate by the City Mayor’s Office with office address at
__________________________________, represented by
_______________________________________, hereinafter referred to as the
“FIRST PARTY”; and

______________________, of legal age, Filipino citizen, single/married, with

residence at ________________________, hereinafter referred to as the
“SECOND PARTY”.

WITNESSETH:

That the FIRST PARTY is engaged in the business of hauling/transporting

services from ______________ to any point in the Philippines;

That the SECOND PARTY desires to engage the services of the FIRST
PARTY in hauling construction materials, particularly gravel, sand and boulders,
hereinafter collectively referred as “MATERIALS”;

WHEREFORE, in consideration of the mutual covenants and agreements set

forth herein, the parties do hereby agree as follows:

1. This agreement shall be valid for a period of ___________ commencing

on _______________ 2020, and may be renewed thereafter upon
agreement by the parties;

2. The FIRST PARTY hereby agrees to furnish and operate his motor
vehicle with Make/Type:_____________________ and Plate No.
___________________ together with drivers to deliver gravel, sand and
boulders to be transported/hauled from ___________________ to
_________________ as may be specified by the SECOND PARTY;

3. That for the full and proper performance of each trip made by the FIRST
PARTY, the SECOND PARTY agrees to pay the former the rate of
______________ PESOS (P___________.00) per cubic meter of the above-
mentioned materials delivered, payable upon completion of the delivery of
said materials by the FIRST PARTY;

4. That the SECOND PARTY shall secure the services of the FIRST
PARTY at least ______ times a month from _______ AM to _______ PM;

5. That the FIRST PARTY binds itself to make available any of his vehicles
upon prior notice and whenever needed by the SECOND PARTY for the
transporting/hauling of the materials within the duration of this contract;

6. That the FIRST PARTY shall exercise the diligence required of him in
the conduct of his operations, and any loss caused to the SECOND PARTY
owing to delay, negligence or imprudence on the part of the FIRST PARTY

 or his agent/driver shall be at the expense of the FIRST PARTY, in
accordance with the existing laws governing and applicable to public
carriers;

7. This contract does not in any way create an employee-employer

relationship between the parties.
