AFFIDAVIT OF DESISTANCE

I, GERD EWALD SAYNISH, of legal age, German National, and

a resident of 183 Dona Juana St., Poblacion West, Lupao, Nueva Ecija,
after having been sworn to an oath in accordance with law, depose and
state;
That sometime on August 2019, herein affiant filed a complaint for
Estafa under Article 315 par 1 (b) of the Revised Penal Code before the
Department of justice, National Prosecution Service, Office of the
Provincial Prosecutor, Province of Nueva Ecija against Regina C. Adora
and was subsequently docketed as I.S. No. 09-INV-19H-01781.
That I am no longer interested in pursuing the case against the
respondent and have absolutely and unequivocally exonerated her from
any concomitant liability whatsoever in connection with the incident as
stated in my complaint mainly by reason of the fact that the respondent
has paid in full her obligation with herein affiant;
Worthy to note is the fact that prior to the filing of this case, both
parties herein were friends with each other hence, it is the desire of
herein affiant to make peace with the respondent and the payment of the
amount involved in this case has pressed herein affiant without
reluctance to withdraw the case for the good of herein affiant and the
respondent.
That I am executing this affidavit of desistance to withdraw my
interest in the case mentioned herein and settle amicably with the
respondent. Furthermore, herein affiant vouched that the execution of
this affidavit was made absent any force or intimidation against me but
my own free will.
