The following Notification shall be published in the next issue of the Official
Gazette.

NOTIFICATION

The Administrator, Pondicherry is pleased to formulate a scheme to provide

financial assistance to the houseless poor below poverty line to construct a house and
for the said purpose hereby makes the following rules viz. “The Pondicherry
Perunthalaivar Kamaraj Centenary Housing Scheme for the Houseless Poor Rules,
2003” as appended at this notification.

THE PONDICHERRY PERUNTHALAIVAR KAMARAJ CENTENARY

HOUSING SCHEME FOR THE HOUSELESS POOR RULES 2003

1. Short title, extent and commencements:- (1) These rules may be called The
Pondicherry Perunthalaivar Kamaraj Centenary Housing Scheme with Sanitary Latrines
for the Houseless Poor Rules 2003

(ii) Shall apply to the whole of the Union territory of Pondicherry.

(iii) They shall come into force from the date of their publication in the Official Gazette.

2. Definitions:- In these rules, unless the context otherwise requires,-

(a) “Advisory Committee’ means the Committee constituted by the Pondicherry Slum
Clearance Board for the purpose of selection of eligible beneficiaries for allotment of
subsidy/financial assistance for the construction of houses with sanitary latrines for the
public who are Below Poverty Line in the U.T. of Pondicherry.

(b) “Board” means Pondicherry Slum Clearance Board established under section 21-A.

(c) “Chairman” means the Chairman of the Pondicherry Slum Clearance Board;

(d) “Secretary” means the Housing Secretary to Government;

(e) “Chief Executive Officer” means the Chief Executive Officer of the Pondicherry Slum
Clearance Board;

(f) “Deputy Collector” and “Sub-Collector” means the Deputy Collector and Sub-Collector
of the outlying regions of Mahe and Yanam,
(g) “Tahsildar” includes Deputy Tahsildar, Settlement Tahsildar and Settlement Deputy
Tahsildar;
(h) “Government” means the Administrator of the Union Territory of Pondicherry
appointed by the President under article 239 of the Constitution;

(i) “Union Territory” means the Union Territory of Pondicherry.

(j) “Family” in relation to a person means, such person and if married the wife or husband
as the case may be and the dependent children, and /or grandchildren of such person:

(k) “Form” means a Form appended to these rules;

(l) “Poor” means families identified as Below Poverty Line families by the government
from time to time.
(m) “Houseless” means person or persons (both husband and wife but none else) who
do not possess a pucca house on his / her/ their own plot/ land in urban or rural areas
and the ownership / title of the said plot shall have been acquired through any one of
the following modes namely”-

(i) House-site on free of cost assigned by the Government of Pondicherry.

(ii) Natham Patta / Kudiyiruppu Patta.
(iii) Acquisition of plot by purchase/partition/donation/settlement/inheritance etc, through
legally valid documents.

Explanation:- In the case of Natham Patta Holders, if the Pattadar is dead, then the
legal heir to the Pattadar is the owner of the hut.

(n) “Below Poverty Line” means a person whose annual family income is not more than
Rs.24,000/- (Rupees twenty four thousand only) or as prescribed by the Government
from time to time:
(o) “Resident” means a person having continuous residence for not less than 5 years in
the U.T. of Pondicherry;

(p) “House” means a house having a plinth area of not less than 18 square metres with
burnt brick wall in cement mortar, with plastering on both sides of the wall cement
mortar and the ceiling/flooring in reinforced cement concrete for Pondicherry, Karaikal
& Yanam regions.

3. Object:- The object of the scheme is to provide financial assistance of Rs.50,000/- (

Rupees fifty thousand only) to each of the Houseless Poor Below Poverty Line to
construct a house with Sanitary Latrine.

4. Eligibility:- To avail of financial assistance under these rules, the applicant shall be:-
i) A citizen of India:;
ii) A native/resident of Pondicherry.
iii) A poor person whose annual family income is not more than Rs.24,000/- or a
person who is having Red Ration Card.
iv) A houseless as defined in Rule 2 (m)

5. Making of applications:- (i) The application for the construction shall be submitted
in Form-I by eligible persons under rule 4 to the Chief Executive Officer, Pondicherry
Slum Clearance Board, Pondicherry in respect of Pondicherry and Karaikal regions and
to the Deputy Collector/Sub-Collector, as the case may be in respect of the other outlying
regions of Mahe and Yanam. The requisite application form may be obtained on free of
cost from the office of Pondicherry Slum Clearance Board, Pondicherry in respect of
Pondicherry and Karaikal regions and in the Office of the Deputy Collector in respect of
Mahe and Yanam region.
(ii) The application shall be submitted in Form-I along with the following
documents:-
(a) Income Certification obtained from an Officer not below the rank of Tahsildar
or Red Ration Card Issued by Civil Supplies Department.
(b) Original documentary evidence to prove that the applicant possess a free plot
issued by the Government or having own house site or having thatched hut
in his own plot/house site;
 (c) Certificate of Nativity by Birth or Residence, Ration Card and Election Identity
Card.
(d) In the case of physically disabled necessary certificates from the competent
authority of the Department. In the case of widow, death certificate of the husband
along with her marriage certificate and in the case of deserted person, necessary
order from the Family Court.

6. Maintenance of register:- (1) The applications received for the construction of house
for the Houseless under Rule 5 shall be entered by the Chief Executive Officer,
Pondicherry Slum Clearance Board in a register maintained in Form-II.

7. Verification:- (i) The Chief Executive Officer, Pondicherry Slum Clearance Board
shall conduct enquiries either personally or through his subordinates to ascertain
whether the applicant is a genuine Houseless Poor and further to ascertain whether the
applicant is eligible for the grant assistance of Rs.40,000/-.

8. Selection of Beneficiaries:- The Chief Executive Officer, Pondicherry Slum

Clearance Board shall convene a meeting of the Advisory Committee under the
Chairmanship of the Chairman, Pondicherry Slum Clearance Board and place the
applications recommended before them for the selection of the beneficiaries. While
selection, the percentage of SC beneficiaries shall be kept as prescribed by the
Government from time to time.

9. Award of Subsidy:- The Chief Executive Officer, Pondicherry Slum Clearance Board
shall submit a list of beneficiaries, duly approved by the Advisory Committee to the
Town and Country Planning Department, for approval and to obtain the expenditure
sanction from the Government with the approved list.

10. Mode of Payment:- The total subsidy of Rs.50,000/- will be given to the
beneficiaries after obtaining an undertaking in Form III. The subsidy amount will be
disbursed in three installments at rate of Rs.20,000/- towards first installment and
Rs.15,000/- towards second installment and Rs.15,000/- towards third and final
installment. Second installment will be issued only after completion of lintel level of
house and toilet. Third and final installment will be issued only after completion of roof.
11. Mode of Inspection:- The Person nominated by the Pondicherry Slum Clearance
Board shall make first inspection after 15 days from the date of intimation of selection to
the hut owner at the site of the hut and satisfy that the building work has been
commenced and as per the specification approved by the Advisory Committee and
submit a monthly progress report to the Government by the Chief Executive Officer,
Pondicherry Slum Clearance Board.

12. Power of Chief Executive Officer:- Chief Executive Officer, Pondicherry

Slum Clearance Board shall be in over all charge of implementing these rules and
necessary instructions with regard to their proper enforcement and accounting
procedure shall be issued by him from time to time.

13. Interpretation:- If any doubt arises as to interpretation of these rules the matter shall
be referred to the Secretary (Housing) and his decision thereon shall be final.

NOTIFICATION

The Lieutenant Governor, Pondicherry is pleased to enhance the financial assistance

to the houseless poor below poverty line for construction of house and for the said purpose
among others hereby makes the following rules further to amend the Pondicherry
Perunthalaivar Kamaraj Centenary Housing Scheme for the Houseless Poor Rules, 2003
issued vide Notification under G.O.Ms.No.17/2003-Hg dated 5.12.2003 of the Chief
Secretariat (Housing), Pondicherry, namely:-

1. Short title and commencement:- (1) These rules may be called the Pondicherry
Perunthalaivar Kamaraj Centenary Housing Scheme for the Houseless Poor (Amendment)
Rules, 2005.
(2) They shall come into force on and from the date of their publication in the Official
Gazette.
2. Amendment of Rule 2:- In the Pondicherry Perunthalaivar Kamaraj Centenary
Housing Scheme for the Houseless Poor Rules, 2003 (hereinafter referred to as the said
rules), in rule 2.
(a) in clause (a), after the words “for the construction of Houses”, the words “with
sanitary latrines” shall be inserted;
(b) for clause (p), the following shall be substituted, namely:-
(p) “house” in relation to:-
(i) the regions of Pondicherry, Karaikal and Yanam, means a house having a plinth area
of not less than 18 square metres with burnt brick wall in cement mortar, with plastering
on both sides of the wall with cement mortar and the celling/ roofing in reinforced cement
concrete.
 (ii) the region of Mahe, means a house having a plinth area of not less than 18 square
meters with burnt brick wall / laterite stone wall in cement mortar with plastering on both
sides of the wall with cement mortar and the celling/ roofing in reinforced cement
concrete or Mangalore tiles on wooden rafters as the case may be, and

(c) after clause (p) as so amended, the following clause shall be inserted, namely:-

(q) “sanitary latrine” in relation to:-

(i) the regions of Pondicherry, Karaikal and Yanam means a latrine having Indian Water
closet with septic tank having a minimum plinth area of 1.2 square metres and a
minimum width of 1 metre, side wall constructed with burnt brick in cement mortar with
plastering on both sides of the wall in cement mortar and celling / roofing in reinforced
cement concrete;
(ii) the region of Mahe means a latrine having Indian Water closet provided with septic
tank having a minimum plinth area of 1.2 square metre and a minimum width of 1 metre,
side wall constructed with burnt brick / latrine stone in cement mortar with plastering on
both sides of the wall in cement mortar and celling / roofing in reinforced cement
concrete are Mangalore tiles on wooden rafters as the case may be ;

3. Amendment of Rule 3:- In rule 3 of the said rules, for the words; figures and brackets
“Rs.40,000/- (Rupees Forty thousand only)”, the words, figures and brackets “Rs.50,000/-
(Rupees fifty thousand only)” shall be substituted.
4. Amendment of Rule 5:- In sub-rule (i) of rule 5 of the said rules, for the words “by
intending poor hut owners”, the words “by eligible persons under rule 4” shall be substituted.
5. Amendment of Rule 7:- In rule 7 of the said rules, for the word and figures
“Rs.40,000/-“, the word and figures “Rs.50,000/-“ shall be substituted.

6. Amendment of Rule 10:- In rule 10 of the said rules, for the words and figures
“Rs.40,000/-“, “Rs.15,000/-“, “Rs.15,000/-“, “Rs.10,000/-“ occurring therein, the words and
figures “Rs.50,000/-, Rs.20,000/-, Rs.15,000/- and Rs.15,000/-“ shall respectively be
substituted.

7. Amendment of Form –I :- In form – I of the said rules:-

(a) after serial number 26 and the entries relating thereto, the following shall be inserted,
namely:-

(b) for the form of recommendation appended thereto, the following shall be substituted,
namely:-
