❑The National Procurement Act (NPA) has
been passed by Parliament and will
apply from 1 January 2019.
• INTRODUCTION
Where the NPA conflicts with or is
inconsistent with an obligation or
undertaking of the State arising out of an
agreement with one or more states, or with
an international organization, the
provisions of the agreement shall prevail
over the provisions of the NPA in order that
the terms of the agreement are given full
force and effect.
• INTERNATION AGREEMENTS
This applies to agreements between the
State and with one or more states, or
with an international organization,
existing at the date of commencement of
the NPA and all agreements entered
into after that date.

For each procurement the NPC undertakes, the CEO shall appoint a TEFC.
A TEFC shall consist of the following members -
(a) at least one person appointed by the public or statutory body on
whose behalf a procurement is being undertaken, who shall be the
Chairman of the Committee; and
(b) a NPC member of staff with competence and experience in the
administrative management of procurements; and
(c) Works Secretary nominee;
(d) a lawyer appointed by the State Solicitor; and
(e) an accountant appointed by the Finance Secretary; and
(f) such other persons who, in the opinion of the CEO, have the necessary
technical or financial skills required for the technical or financial assessment of
the procurement.
• FUNCTIONS OF A TEFC
❑ All procurements shall be carried out in accordance with NPC Act, the
regulations, guidelines and instructions issued under the Act.
❑ NPC may issue Procurement Instructions or Guidelines, not inconsistent
with the Act, which are necessary or desirable for carrying out or giving effect to the
Act and in general for the better control and management of procurement.
❑ NPC may issue procurement manuals, not inconsistent with the Act, for
instruction and guidance on the implementation of any matter provided for in the Act
for the better control and management of procurement.
❑ All persons shall comply with the terms, conditions, requirements and
instructions of Procurement Instructions or guidelines and procurement manuals
issued under the Act.
NATIONAL PREFERENCE ALLOWANCE
NPC and public and statutory bodies shall not receive a bid
from or contract with any person that is not a qualified
bidder registered with the NPC.
(b) subject to the terms of the PFMA, negotiations for a loan or the
Procurement of a loan to a public or statutory body.

❑ Board may delegate, on such terms and conditions as it thinks fit, its
procurement function at a provincial, local and district level -
(a) at a provincial level, a Provincial Committee of the NPC; or
(b) at a local-level, a Local-Level Committee of the NPC; or
(c) at a district level, a District Committee of the NPC.
❑ NPC shall not delegate its functions unless the Provincial Government, Local-
Level Government or the relevant District Development Authority has been
certified under the Act that it -
(a) has the capacity to engage in the procurement processes; and
(b) it is sufficient to protect the use of public funds and ensure that good
public financial management practices are followed and applied by Provincial
Government or Local-Level Government, including the relevant District
Development Authority.

✓ The APC Committee and its Secretariat control all aspects of the timing
of the implementation of the NPC Act.
