NOTIFICATION

New Delhi, the 9th, December, 20 I0

No.N-12/1312/201o-P& D.- Whereas certain draft regulations further to amend the Employees'
r

State Insurance (General) Regulations, 1950, were published as required under sub-section (1)
of section 97 of the Employees'State Insurance Act, 1948 (34 of 1948), in the Gazette of India,
PartIll, Section 4, dated the 3<f' October, 2010 for inviting objections and suggestions from all
persons likely to be affected thereby till the expiry of the period of thirty .davsfrom the date on
which the copies of the Gazette of India in which the said notification was' published, were
made available to the public;

And whereas, the copies of the said Gazette were made available to the public on the
30th October, 2010;

And whereas no objection or suggestion has been received from any person in this
regard;

Now, therefore, in exercise of the powers conferred by section 97 of the Employees'

State Insurance Act, 1948, the Employees' State Insurance Corporation, hereby makes the
following regulations further to amend the Employees' State Insurance (General) Regulations,
1950, namely: -

1) These Regulations may be called the Employees' State Insurance (General)

(Amendment) Regulations, 2010.
2) They shall come into force from 1st January, 2011.

3) In the Employees' State Insurance (General) Regulations, 1950;

1. In Regulation 2, in sub-clause (I), the word "inspector" shall be substituted with the word "Social

Security Officer".

2. . After Regulation 31C, the following new Regulations shall be inserted:-

"31-D-Appellate Authority: The Appellate Authority under Section-45AA of the Act shall be the

Insurance Commissioner, the Additional Commissioner, Regional Director and Joint Director.

31-E. Interest on amounts refunded to the employer.

If an employer finally succeeds in the appeal under section 45AA, the amount deposited by him

with the Corporation, in full or part, as per decision of the Appellate Authority, shall be refunded

to him along with simple interest at the rate specified in Regulation 31-A."

3. In Regulation 32, the words and figures "Fonn T" shall be substituted with the words and figures
"Fonn 6".

4. In Regulations 65,66,68, 77,78 and 81 the words • insured person" wherever the same occur,

shall be substituted with the words " employee".

5. In Regulation 102,

(a) the words, " Joint Insurance Commissioner, a Deputy Insurance Commissione'" shall be

substituted with the words ·Additional Commissioner",

(b) the words, "Deputy Regional Director, Assistant Insurance Commissioner, Assistant Regional

Director" shall be substituted with the words, "Joint Director, Deputy Director, Assistant Director'

(cl the words, "Inspector- shall be substituted with the words "Social Security Officer-.

6. In Regulation 102-A, the words "an Inspector" shall be substituted with the words "a Social

Security Officer".

7. In Clause (2) of Regulation 103-8, after the words "has attained the age of superannuation", the

words "or retires under a Voluntary Retirement Scheme or takes premature retirement" shall be

inserted.

8. In Form-01;

(a) the existing column 11 shall be substituted with the following:-

"11. Whether manufacturing process is carried on and if so the nature of the same"

(b)in column-17, the words and figures" Rs.75OO'"shall be substituted with

the world and figures" Rs.1S,000".

(c) in column 18, t~e words "or more coverable employees under the ESIAct were employed for
wages" shall be substituted with the words "or more persons were employed".

(d) Footnote ** shall be substituted with the following;

"Score out whichever is not applicable. In caseof factory, the number applicable is 10 or

more persons and in case of an establishment the number applicable is 20 or more

persons,"

(e) Note-2, shall be deleted.

(f) in Note 7, in the paragraph below (iii), the words" or under the standing

orders of the establishment'" shall be substituted with the words "and includes such person engaged

as apprentice whose training period is extended to any length of time"'.

9. In FornH)1A, Column 7(b) shall be deleted .

10. In Form-l;

(a) in para-2 of instructions at the end of form-I, in the definition of"family", for sub-

clause (v) , the following sub-clauses shall be inserted, namely:-"(v) dependent parents, whose

income from all soUrces does not exceed five thousand rupees a month;

(vi) in casethe insured person is unmarried and his or her parents are not

alive, minor brothers and/or sisters wholly dependent upon the earnings of the

insured person.'"

11. In Form 1- A;

-in the Note at the end of the form-La, in the definition of "family", for sub-clause (v) r the

following sub-clausesshall be inserted, namely:-

"(v) dependent parents, whose income from all sources does not exceed five thousand rupees a

month;

(vi) in case the insured persen 1S unmarried and his or her parents are not alive, minor brothers

and/or sisters wholly dependent upon the earnings of the insured person,"

12. In Form 2;

-in the Note at the .endof the form-2, in the definition of "family", for sub-clause (v) , the

following sub-clauses shalJ be inserted, namely:-

"(v) dependent parents, whose income from all sources does not exceed five thousand rupees a

month;

(vi) in casethe insured person is unmarried and his or her parents are not

alive, minor brothers and/or sisters wholly dependent upon the earnings of the

insured person."

13. In Form 3, the figures "Rs.7SOO"shall be substituted with the figures "Rs.1S,OOO'"

14. in form-12

(a) After Column 26, the following new columns shall be inserted:-

"27. In case the accident happened while commuting from residence to the place of

employment for duty or from place of employment to residence after performing duty:-

(1) TIme and place of accident

(2) Duty hours.

(3) Mode oftransport.

15. In form-15,Jhe words "insured person" shall be substituted with the words "employee" wherever

it occurs.

16. In form 16

(a) the words "insured person" shall be substituted with the word "employee"wherever the

same occurs.

(b) in declaration(ii), after the words" Applicable in caseof minor male/female dependant"',

the words "other than legitimate or adopted son or daughter" shall be inserted.

(c) in declaration (iii), the words and figures "18 vears" shall be substituted with the words and

figures 1t25 years" and the words "unmarried" shall be deleted.

(d) after declaration (iii), the following shall be inserted; "namely, "(iv) I have not attained the

age of 25 years (Applicable in case of legitimate or adopted son)"

17. In form 24

(a) the words "insured person" shall be substituted with the word "employee" wherever the same

occurs.

(b) - in declaration (ii), after the words "Applicable in case of minor male/female dependant", the

words "other than legitimate or adopted son or daughter'" shall be inserted.

(c)- in declaration (iii), the words A'eighteen years" shall be substituted with the words "'twenty-five

years"

(d) - after declaration (iii) the following shall be inserted; namely, "(iv) I have not attained the age of

twenty-five years (Applicable in case of legitimate or adopted son)"
