Introduction◌ঃ-

With the number of rape cases rising alarmingly high over the past few years in
Bangladesh and across the globe and the chestity of women being considered the topmost
important factor when it comes to tie the knot and live in the society with human-respect(in
terms of Bangladesh) regardless external beauty and property under the name. The civil
society and some human-rights observer groups have tuned their voice with the general
people demanding for the capital punishment to be brought on for the rapists citing many
reasons. However, there is a group of people who uphold conflicting views with the opinion
cited above. Now the question arises is that '​Should the rapists be hanged to death? ​or
should they be set free having undergone short-term punishment like imprisonment
and handing some amount of money to the victim instead?

Before we go deep in the discussion, we need to know the actual definition of rape as per
the Bangladeshi penal code, ​"Rape requires sexual intercourse with or without the
consent of a woman despending on certain situations​(Penal code, 1860)
Both sides' opinions advocating for and against the capital punishment for rapists pointed out
below will answer the questions above. Capital punishment are better for three reasons.

Firstly, ​a country should reserve the capital punishment, for whenever people get to see the
culprits of certain crimes be hanged to death, they will think repeatedly on whether they
should indulge in such crimes. In this regard people hold some of the middle-eastern
countries' rates of rape cases as an example to back up their claim for this punishment. For
example, the UAE has a population counting ​9, 890, 402 ​as compared to that of Bangladesh
164,689,383 ​and the rape rates and incidents have happened in both the countries so far in
the ongoing year read, For UAE ​1.50(rate), 72(incidents) ​in contrast with that of
Bangladesh ​9.82(rate), 11682(incidents) ​respectively.
In their opinion, that is, the UAE is an islamic country regulated by the sharia law, that hangs
a rapist to death within the seven following days after the occurence of the incident. But In
Bangladesh despite having the rule for this punishment, the rapists evade this in some way
or other most of the time.

Secondly,​ Death sentence is a must for rapists, its because, if they are sentenced to
imprisonment for a few years, after they walk out of the bar finishing their imprisonment term,
they tend to revenge the victims anyhow. Example in this regard can be cited of the recently
occured incident in the USA that a rapist despite raping an elderly woman previously, he
avoided the jail-term for a point of time owing to some reasons, he was in the custody for a
week or so though, on his leave he shot dead the woman for filing the rape compliant
against him.

Finally, ​taking the precedents into account, capital punishment seems to be the must option
for rapists as it on the one hand instil fear in those willing to have sexual intercourse with a
woman on the back of her will, will not most likely cause such a damage, on the other hand,
the rapist having made a woman his victim already will not be able to cause any further to
the woman and her family after his short-timed imprisonment ends up.
Opponents are of the view that if this punishment is put in place, the rapist might kill the
victim fearing to be nabbed once the his illegal act gets evolved, because the victims most of
the time are found familiar with the ultimate rapists.

Conclusion◌ঃ-

​There are many well-documented benefits of awarding death sentence to the culprit, it is effective
in many respects to prevent the alarmingly increasing number of rape incidents, so the law regarding
this trounce for rapists should be toughened and made sure its well-application.
