SYNOPSIS OF THE CASE:

The petitioner is the resident of Bhubaneswar. He works as a banker and has a good
reputation in the society. He got married on 06/07/2000 in Cuttack. Then they got
shifted to New Delhi where he came to know about the relationship of his wife and
accused. Even after the objection of the petitioner, the respondent in turn blamed
him for suspecting. On 28/12/2004, Sanya Behera was born out of their wedlock in
New Delhi. Later on, he got transferred to Chandigarh along with his family in 2008.
But the accused started visiting Chandigarh too for which the respondent started
neglecting the child which was strongly opposed by the petitioner. In july 2009, they
got transferred to Hyderabad, where the respondent still continued to make contact
with the accused. In 2011, the petitioner was posted to Bhubaneswar along with his
family, but there also the respondent kept on going to Delhi in the context of visiting
her family and kept physical relationship with accused. Soon after some period, the
petitioner reealised that the respondent is 3-4 months pregnant and gave birth to
Devanshi on 17/5/12. then againi in June 2013, she conceived with a baby and gave
birth to a buy named as Kavyansh on 21/11/13. The respondent was careless
regarding the upbringing of her children and also did not maintain a good
relationship with her husband. On 17/10/17 suddenly the respondent disappeared
with her two younger children leaving Sanya behind with the petitioner. On
18/10/17 the petitioner filed a missing report and later the respondent was traced
down in a hotel named Shuhul located in Delhi. On 19/2/18 the respondent was
apprehended when the accused claimed that he had kept them since 18/10/17.
