AFFIDAVIT OF RECANTATION

I, NELSON L. ANTONIO, of legal age, Filipino, married and a resident of

Brgy. Puroc, Luna, Isabela, after having been duly sworn to in accordance with law, do
hereby declare that:

1. I am the private complainant in Criminal Case No. 2018-488, entitled, “People

of the Philippines vs. Bryan Siobal y Mesa and Jayson Cacayan y Cuizon” for Theft, which
is pending before the MCTC-Cabatuan-Luna, Cabatuan, Isabela;

2. On July 30, 2019, I testified in the above-entitled case wherein I stated that
four of my fighting cocks were stolen. I was able to identify my fighting cocks at the PNP-
Cabatuan, Isabela. I claimed those fighting cocks as mined because their physical
appearances were the same with my lost fighting cocks. I accused Bryan Siobal and Jayson
Cacayan as the perpetrators because the PNP-Cabatuan, Isabela has apprehended them
having in their possession my fighting cocks;

3. On August 08, 2019, I was surprised that my friend returned my fighting

cocks. There I found out that my fighting cocks were not really stolen as I testified in court.
One of my farm helper lent my fighting cocks to my friend without my knowledge and
consent.

4. In order not to frustrate the ends of justice, I hereby recant my previous

testimony in court and hereby disclose that my fighting cocks were not stolen but rather
were borrowed by my friend. It was a misapprehension of facts where I testify in court that
my fighting cocks were stolen. I am also retracting my previous testimony in court in order
to exonerate both accused as they have not stolen any of my fighting cocks;

5. The contents hereof were thoroughly explained to me in the manner and

language I speak and understand and I hereby certify that the statements made herein are true
and correct to the best of my knowledge and belief.
