The forgoing exposition suggests that there is a robust legal and institutional framework

governing the ASGM sector In Guyana. Given the prevalence of the Annex C “worst
practices” which were evident during an initial field visit, the inherent weakness in the
system could very well be one of enforcement. The subsequent deliverables will
therefore necessarily engage in a more in-depth review and analysis of the existing
regulatory framework with a view to identifying existing constraints, barriers, and gaps
in the legal and institutional framework, and make recommendations for addressing
same. This exercise will be undertaken against the backdrop of espoused best practices
for regulating the ASGM sector which include:
i. Designing the regulatory framework in line with a human based approach and
ensure that it properly accounts for the institutional, financial, socio-
economic (including gender), and geo-environmental dimensions of the
sector.
ii. Developing regulations that respond to the unique conditions of the sector
and the capacity of ASGM actors.
iii. Providing ASGM actors and others with information about the legal
framework in the culturally compatible and timely manner.
iv. Ensuring that stakeholders have the opportunity to contribute to developing
public policy.
