DEED OF DONATION

KNOW ALL MEN BY THESE PRESENTS

This Deed of Donation is made and executed by and between:

The PROVINCE OF NEGROS OCCIDENTAL, a local government unit duly organized and validly
existing under and by virtue of the laws of the Republic of the Philippines, with principal address at
the Provincial Capitol Building, Gatuslao Street, Bacolod City, represented in this instance by the
Governor, HON. ALFREDO G. MARAŇON, JR., authorized under SP Resolution No. 0541 Series
of 2010, and hereinafter referred to as the DONOR;

and

The OFFICE OF THE MUNICPAL MAYOR, MUNICIPALITY OF CANDONI, likewise a

local government unit duly organized and validly existing under and by virtue of the laws of the
Republic of the Philippines, with principal address at the Office of the Municipal Vice Mayor,
Municipality of Candoni, hereby represented by its Municipal Mayor, Hon. Mayor, Cicero D.
Borromeo, hereinafter referred to as the DONEE;

WITNESSETH THAT:

Whereas, the DONOR is the absolute owner of a Hyundai H-100 2.6L Diesel M/T vehicle more particularly
described as follows, hereinafter the “Vehicle”:

Color: Creamy White

Whereas, the Donor is duly authorized to donate the Vehicle, while the Donee is duly authorized to accept
such donation;

NOW THEREFORE, for and in consideration of the moral and social responsibility which the DONOR has
for the DONEE, and the desire to improve the delivery of basic services in the City/Municipality/Barangay, the said
DONOR by these presents, transfer and conveys by way of this donation, unto and in favor of the DONEE the
Vehicle, which donation the Donee hereby accepts, subject to the following terms and conditions:

1.0 The Vehicle shall be primarily used by the DONEE for the following activity/ies:

(1) As a Service Vehicle for the City/Municipal and Barangay Officials in the conduct of their official
functions;
(2) During Emergency situations;
(3) In the maintenance and repair of City/Municipal/Barangay road networks;
(4) In the conduct of peace and order patrol operations;
(5) In the delivery of other programs and services for the constituents.

2.0 The DONEE binds itself that it shall cause to and comply with the following conditions:

(1) Set a policy for the use of the vehicle;

(2) Provision of a permanent operator/driver to the unit;
(3) Allocation of budget for the maintenance and repair of the unit.
(4) It shall have the vehicle covered by the comprehensive vehicle insurance annually based on its
current value to answer for any damaged caused by it and to any third party.
(5) It shall register the vehicle and pay the annual registration fees thereof every year thereafter with
the nearest Land Transportation Office within thirty(30) days from execution of this agreement,
copies of the registration and receipt shall be furnished of the DONOR within the same period.

3.0 The DONEE does hereby accept the donation of the Vehicle and does hereby express its gratitude for the
kindness and liberality of the DONOR.
4.0 In case the DONEE shall fail to comply with the terms and conditions set forth in this Deed of Donation, the
donation shall be deemed automatically revoked.

IN WITNESS WHEREOF, the DONOR and the DONEE have hereunto set their hands in this ____ day of
