AN ACT PROHIBITING PUBLIC UTILITY JEEPNEYS TO ENTER MAHARLIKA


HIGHWAY (BAMBANG BUSINESS CENTER) AND PROVIDING ALTERNATE
ROUTE AND PROHIBITING ALL PUJ COMING FROM NORTHBOUND AND
SOUTHBOUND TO USE INNER LANES , AND FURTHER, PROVIDING PENALTIES
THEREOF.
WHEREAS, Article II Section 5 of the 1987 Philippine Constitution states that, “The
maintenance of peace and order, the protection of life, liberty, and property, and promotion of
the general welfare are essential for the enjoyment by all the people of the blessings of
democracy”.

WHEREAS, due to the volume of Public Utility Jeepneys coming to the Municipality of
Bambang, heavy flow of traffic occurs. Loading and unloading slots cannot contain all Public
Utility Jeepneys.

WHEREAS, there are drivers of Public Utility Jeepneys that are undisciplined and disregarding
loading and unloading signs.

WHEREAS, the outer lane of Maharlika Highway Municipality of Bambang is being used as
parking slot or space instead of using for vehicular flow.

WHEREAS, it is imperative to respond to the need of the public for greater pedestrian and
vehicular mobility and for public safety.

NOW THEREFORE BE IT ORDAINED AS IT HEREBY ORDAINED BY THE


SANGGUNIAN BAYAN OF BAMBANG, BY VIRTUE OF THE POWERS VESTED IN
BY LAW, IN SESSION ASSEMBLED THAT:

Section 1: TITLE – This act shall be known as “Public Utility Jeepney New Route Act”

Section 2: DEFENITION OF TERMS – as used in this ordinance the term:

1. Business Center – shall start from the boundary of Barangay Macate and
Homestead Maharlika Highway to Barangay Baggot and Barangay
Magsaysay Hill Maharlika Highway.
2. Driver – is any person licensed to operate, drive and have control of the
directional and motive power of a vehicle.

3. Impede – to hinder in progress or action of motor vehicles

4. Operator – one who operates a motor vehicle.

5. Owner – the legal owner of a motor vehicle in whose name such vehicle is
duly registered with the Land Transportation Office.

Section 3: PROHIBITION – It shall be unlawful for Public Utility Jeepneys


owners/drivers/operators, to enter the Maharlika Highway (Business Center) in the Municipality
of Bambang and PUJ coming from north and south to use inner lanes.

Section 4: All roads and streets, as indicated, in this ordinance shall be, and hereby declared
exclusive for vehicle flow use only. In no instance shall parking or installed objects that obstruct
or impede the flow of traffic of any motor vehicles and objects be allowed or installed on the
street/roadway and/or sidewalk.

Section 5: Loading and Unloading Areas;

1. PUJ Coming from North Bound


 At the Back of Savemore (Milan St.)
 Rizal Boulevard, In front of Petron Gasoline Station (Methodist St) (Loading
Station)
 In front of Shell Bambang

Unloading Only
 In front of Jollibee Bambang

2. PUJ Coming from South Bound


Loading and Unloading
 Rizal Boulevard
 Heroes Boulevard (Lara St.)
 New Kasibu-San Fernando Road (Market Road) (Loading Station)
 In front of Pick and Save

Unloading Only
 In front of Transcycle
 In front of Jollibee Bambang

Section 5a – All unidentified streets and roads shall be considered as “NO LOADING
AND ULOADING AREAS”. Terminals shall only accommodate two Jeepneys at a time.
All Public Utility Jeepneys shall be given ten (10) Minutes time to load on designated
(Loading Stations.
Section 6: All Public Utility Jeepneys (PUJ’s) from Monday to Sunday shall take the following
routes as herein indicated;

1. Coming from North Bound

ENTRANCE: All Public Utility Jeepneys coming from north shall enter Milan Street
and right turn to Methodista Street.

EXIT: From Methodista Street, Public Utility Vehicles shall exit at Rizal Boulevard
and use outer lane.

2. Coming from South Bound

ENTRANCE: All Public Utility Jeepneys coming from south shall use outer lane
before entering Rizal Boulevard (Marker) and shall take Lara St.

EXIT: From Lara St. all PUJ shall exit at New Kasibu-San Fernando Road and shall
use outer lane.

Section 6: Upon Implementation of this Ordinance, there shall also be a posted traffic enforcer
or traffic police officer or any community brigade (Tanod) in the following roads and streets:

North Bound
1. Mormons (Hagod)
2. Boyie Street (Entrance)
3. Milan Street
4. Methodista Street
5. Rizal Boulevard (Exit)
6. Jollibee Bambang
7. Shell Gasoline Station Bambang

South Bound
1. Transcycle Bambang
2. Jollibee Bambang
3. Rizal Boulevard (Marker)
4. Lara St.
5. New Kasibu-San Fernando Road (Market Road)
6. Pick and Save Terminal
7. Mormons (Hagod)

Section 5a: All traffic enforcer, traffic police and community brigade officer particularly
assigned or detailed at the aforesaid streets and roads shall personally man and actively
direct the traffic at such vantage point preferably at the center of the crossing or street and
there strictly enforce the traffic laws upon all road users as earlier heretofore mentioned.
He must at all times have in his possession traffic tickets and/or citations.

Section 6: PENALTIES – Any violation of the provisions of this Ordinance, shall be subject to
penalty;

(a) Driver/Owner/Operator of Public Utility Jeepneys who will not use outer lane, shall
pay to the Municipal Treasurer’s Office of Bambang, Nueva Vizcaya, a fine of:

P500.00 – For First Offense

P1,500.00 – For Second Offense

P2,500.00 – For Third Offense

P2,500.00 and cancellation of permit – For Fourth and succeeding


Offense

(b) Driver/Owner/Operator of Public Utility Jeepneys who will exceed the Ten (Minutes)
loading time shall pay to the Municipal Treasurer’s Office of Bambang, Nueva
Vizcaya, a fine of:

P500.00 – For First Offense

P1,500.00 – For Second Offense

P2,500.00 – For Third Offense


P2,500.00 and cancellation of permit – For Fourth and succeeding
Offense

(c) Driver/Owner/Operator of Public Utility Jeepneys who willfully Load and Unload on
prohibited areas shall pay to the Municipal Treasurer’s Office of Bambang, Nueva
Vizcaya, a fine of:

P500.00 – For First Offense

P1,500.00 – For Second Offense

P2,500.00 – For Third Offense


P2,500.00 and cancellation of permit – For Fourth and succeeding
Offense
Section 7: IMPLEMENTING RULES AND REGULATIONS – The Municipal Mayor, the
Bambang Traffic Enforcers, the Philippine National Police, and Community brigades shall be
subject to promulgate the rules and regulations to carry out the regulations of this ordinance.
Section 8: REPEALING CLAUSE – Any existing Municipal Ordinance or any provision
thereof which is contrary to or inconsistent with this Ordinance is hereby repealed or amended
accordingly.
Section 9: SEPARABILITY CLAUSE – However, if, for any reason, any provision, section, or
a part of this ordinance is declared unconstitutional or invalid, the remaining provision, section,
or parts shall not be affected and shall continue to be in full force and in effect
Section 10: EFFECTIVITY CLAUSE – This Ordinance shall take effect after fifteen (15) days
after posting and publication and from its approval.
ENACTED BY THE SANGGUNIANG BAYAN OF BAMBANG, NUEVA VIZCAYA, in
its regular session.
WE HERBY CERTIFY to the correctness of the foregoing ordinance.
