A RESOLUTION AMENDING RESOLUTION R-20-26


TO PROVIDE ADDITIONAL FUNDING FOR THE
NON-PROFIT GRANT PROGRAM

WHEREAS, the Charter of the City of Decatur, in Section


2.10(c), provides that the City Commission may adopt and enforce
any and all ordinances, resolutions, bylaws, rules, regulations and
restrictions, consistent with state law, that it may consider advisable
and necessary for the health, prosperity, comfort, safety, security, good
order, welfare and proper government of the City and the inhabitants
thereof; and

WHEREAS, through Resolution R-20-26, the City Commission


established a non-profit grant program (the “Non-Profit Grant Program”),
using $300,000 of CARES Funds (as that term is defined in R-20-26), to
provide grants to non-profit organizations serving the Decatur community
that have been adversely affected by the COVID-19 public health emergency;
and

WHEREAS, on or before the November 16, 2020 deadline, thirty


non-profit organizations timely submitted applications for non-profit grants,
which applications were all determined to be complete and eligible for grants
under the Program; and

WHEREAS, because the Non-Profit Grant Program was


oversubscribed, a blind draw of all timely, qualifying applications was
conducted and the applications of twenty-two organizations were selected,
leaving eight organizations that did not receive grants; and

WHEREAS, the amount requested by these eight organizations


totaled $193,670.37; and

WHEREAS, because a portion of the CARES Funds originally


intended to be used for projected personnel and technology expenses are not
needed for such purposes, $193,670.37 is available to fund the eight
applications that were not selected in the blind draw.

NOW THEREFORE, BE IT RESOLVED, and it is hereby


resolved, by the City Commission of the City of Decatur, Georgia, that
Resolution R-20-26 is hereby amended as follows:

1. The following sentence is added at the end of Section 1.a.:

“An additional $193,670.37 is available for qualifying


applications that were not selected in the blind draw.”

2. A new Section 8A is added as follows:

“Grants are hereby awarded to the eight non-profit organizations


that submitted timely, qualifying applications but that were not
selected in the blind draw (“Additional grant recipients”), in the
amounts listed in the attached Exhibit A.”

3. A new Section 9A is added as follows:

“Additional grant recipients shall be required to enter into a grant


agreement prior to receiving grant funds, which shall include: (a) a
sworn attestation that grant proceeds will be used for the purposes
set forth in the grant application and that recipient will abide by
post-award requirements of the grant; (b) a sworn attestation that
the grant proceeds will not be used for expenses addressed by
other CARES Act assistance received by recipient; (c) an
agreement to provide a report by no later than May 31, 2021, on a
form promulgated by the City Manager or her designees,
describing how the grant proceeds were expended and any
deviations from the applicants’ proposed spending plans shall be
submitted to the City; (d) an agreement to provide documentation
of such expenditures, upon request by the City; (e) an agreement
to be subject to follow-up auditing by the City, the State of
Georgia and/or the Federal government with respect to use of
grant proceeds; (f) an acknowledgement that in the event the City,
the State of Georgia or any Federal agency makes a determination
that the grant and/or the use of the grant proceeds was not an
eligible expenditure under the CARES Act or any other applicable
law, the recipient may be required to repay the grant proceeds; and
(g) an indemnification of the City if a claim for return of the grant
proceeds is made against the City by DeKalb County, the State of
Georgia, or any Federal agency.”

4. A new Section 10A is added as follows:

“Any additional grant recipient who fails to enter into the grant
agreement and provide additional, necessary documentation by
March 31, 2020, may forego their award funds.”

FURTHER, BE IT RESOLVED, and it is hereby resolved, this


resolution shall become effective immediately upon its adoption.
