Jabalpur, Vasundra grah nirman Sahkari sameti, Jabalpur with located in
ward chaudital, municipal corporation Jabalpur ” along with present and
future super structures thereon and bounded as under:-
Towards East:- Neighbour’s place;
Towards West:- 20 ft side road;
Towards North:- house of khatri ji;
Towards South:- plot no. 20;

Hereinafter referred as “said property”

Dear Sir,

A) We have perused following documents given by you in respect of said


property for the purpose of giving my legal opinion for creating mortgage viz. :-

1. Photocopy of Registered Sale Deed dated 24.12.1996 stamped and


bearing Registration No. 1279(g) with sub-registrar of assurances at
BHOPAL made between Rajkumar khare S/o Mahesh Prasad Khare
R/o ABC Apartment infront of home science collage, Jabalpur AND
Shri Chandrahas soni S/o Tulsi Ram soni R/o 1667 Saraswati
colony ward Chaudital , Jabalpur , Shri Chitrasen Soni S/o Tulsi
Ram soni R/o 1667 Saraswati colony ward Chaudital alongwith
stamp duty receipt, registration receipts, and Index No. II.

B) ASSUMPTIONS:-
It is informed that, the documents given above are as per the originals
and it is further given to our knowledge that Shri Chandrahas soni
S/o Tulsi Ram soni R/o 1667 Saraswati colony ward Chaudital ,
Jabalpur , Shri Chitrasen Soni S/o Tulsi Ram soni R/o 1667
Saraswati colony ward Chaudital is/are in actual physical possession
of the said property and hence Title Opinion is given on the aforesaid
representations.

C) DEVOLUTION OF TITLE:-
We have gone through the photocopy of the documents stated in Para (A)
hereinabove in respect of the said property and on the basis of information
provided to us, it is found that;

That, initially Vasundhra Grah Sehkari Sameti Jabalpur panjiyan no. D


R/JBR/77/1975, has sold a a freehold open land situated on plot no. 21
having an area of 1500 Sq.ft located on part of Khasra no. 35, 36, 37/2, 36,
40, 41, 42 Jabalpur P.H.N 24/1, tehsil and district Jabalpur, Vasundra grah
nirman Sahkari sameti, Jabalpur with located in ward chaudital, municipal
corporation Jabalpur ” along with present and future super structures thereon
and bounded as under:-Towards East:- Neighbour’s place; Towards West:- 20 ft
side road; Towards North:- plot no. 22; Towards South:- plot no. 20; in favour
of Rajkumar Khare S/o Mahesh Prasad Khare R/o 562 kotwali ward , Jabalpur
vide registered sale deed dated 02.04.1990 which document is registered at the
office of Sub-Registrar Jabalpur at Book no. A-1, Volume no. 6637 From pg no.
……. at document no. 7/12. That therefore, Rajkumar Khare S/o Mahesh
Prasad Khare R/o 562 kotwali ward, Jabalpur become the owner of the said
property.
Than Rajkumar Khare S/o Mahesh Prasad Khare R/o 562 kotwali ward,
Jabalpur has sold free hold a freehold residential house situated on plot no. 21
having an area of 1500 Sq.ft located on part of Khasra no. 35, 36, 37/2, 39,
40, 41, 42 Jabalpur P.H.N 24/1, tehsil and district Jabalpur, Vasundra grah
nirman Sahkari sameti, Jabalpur with located in ward chaudital, municipal
corporation Jabalpur ” along with present and future super structures thereon
and bounded as Towards East:- Neighbour’s place; Towards West:- 20 ft side
road; Towards North:- house of khatri ji; Towards South:- plot no. 20; in favour
of Shri Chandrahas soni S/o Tulsi Ram soni R/o 1667 Saraswati colony ward
Chaudital , Jabalpur , Shri Chitrasen Soni S/o Tulsi Ram soni R/o 1667
Saraswati colony ward Chaudital, Jabalpur vide a registered sale deed Dated
24.12.1996 which document is registered at office of sub-registrar at Jabalpur
at Book no. A-1, Volume no. 8410 from pg no. 90-96, at document no.
1279(g).that Therefore, Shri Chandrahas soni S/o Tulsi Ram soni R/o 1667
Saraswati colony ward Chaudital , Jabalpur , Shri Chitrasen Soni S/o Tulsi
Ram soni R/o 1667 Saraswati colony ward Chaudital, Jabalpur has become
the of the said property.

Thus, Shri Chandrahas soni S/o Tulsi Ram soni R/o 1667 Saraswati colony
ward Chaudital , Jabalpur , Shri Chitrasen Soni S/o Tulsi Ram soni R/o 1667

Saraswati colony ward Chaudital, Jabalpur will absolutely seized, possessed of
and/or otherwise well and sufficiently entitled to the said Premises.

F) CONCLUSION:-
Subject to whatever stated above and on the basis of copies of the documents
furnished by you to us, we are prime-facie of the opinion that, said property
stands in the name Shri Chandrahas soni S/o Tulsi Ram soni R/o 1667
Saraswati colony ward Chaudital , Jabalpur and Shri Chitrasen Soni S/o
Tulsi Ram soni R/o 1667 Saraswati colony ward Chaudital, Jabalpur and the
title is clear and marketable. We further clarify that, we have not conducted
search in the office of concerned Sub-Registrar. We did not verify the Original
Agreements/Sale Deed/Conveyance with the concerned office of Sub-Registrar
and did not verify genuineness of the stamp duty affixed on the document in
question.
HDFC Credila is further advised to insist and collect the following
documents from the Applicants at the time of creation of mortgage in respect of
the said property.
The Applicant should sign the loan documents for the purpose of
creating an Equitable Mortgage / Register Mortgage.
