1. Government of Nepal (GoN) has received a Loan from Single Envelope Procedure toward the cost of Consulting Services for
Owner's Engineer for Construction of Budhi Ganga Hydropower Project (20 MW) and intends to apply a portion of this
loan/credit/grant to eligible payments under the Contract for which this Expression of Interest is invited for International
consulting service
2. The Budhiganga Hydropower Project now invites Expression of Interest (EOI) from eligible consulting firms (“consultant”) to
provide the following consulting services: Procurement of Consulting Services for Owner's Engineer for Construction of Budhi

6. In case the last date of obtaining and submission of the EOI documents happens to be a holiday, the next working day will be
deemed as the due date but the time will be the same as stipulated.
7. EOI will be assessed based on Qualification 30.0 %, Experience 60.0 %, and Capacity 10.0 % of consulting firm and key
personnel. Based on evaluation of EOI, only shortlisted firms will be invited to submit technical and financial proposal through
a request for proposal.

Instructions for Submission of Expression of Interest
1. Expression of Interest may be submitted by a sole firm or a joint venture of consulting firms.
2. Interested consultants must provide information indicating that they are qualified to perform the services (descriptions,
organization and employee and of the firm or company, description of assignments of similar nature completed in the last 7
years and their location, experience in similar conditions, general qualifications and the key personnel to be involved in the
proposed assignment).
3. This expression of interest is open to all eligible consulting firm.
4. In case, the applicant is individual consultant, details of similar assignment experience, their location in the previous 4 years and
audited balance sheet and bio data shall be considered for evaluation.
5. The assignment has been scheduled for a period of 43 Months. Expected date of commencement of the assignment is 06-06-
2021.
6. A Consultant will be selected in accordance with the QCBS method.
7. Expression of Interest should contain following information:
(i) A covering letter addressed to the representative of the client on the official letter head of company duly signed by
authorized signatory.
(ii) Applicants shall provide the following information in the respective formats given in the EOI document:

8. Applicants may submit additional information with their application but shortlisting will be based on the evaluation of

9. The Expression of Interest (EOI) document must be duly completed and submitted in sealed envelope and should be clearly
marked as “EOI Application for Short-listing for the Consulting Services for Owner's Engineer for Construction of Budhi
Ganga Hydropower Project (20 MW).The Envelope should also clearly indicate the name and address of the Applicant.
Alternatively, applicants can submit their EOI application through e-GP system by using the forms and instructions provided by
the system.
10. The completed EOI document must be submitted on or before the date and address mentioned in the “Request for Expression of
Interest”. In case the submission falls on public holiday the submission can be made on the next working day. Any EOI
Document received after the closing time for submission of proposals shall not be considered for evaluation.

2. The Budhi Ganga Hydropower Project, Department of Electricity Development now invites
Expression of Interest (EOI) from eligible consulting firms (“consultant”) from all eligible
countries to provide the following consulting services: Owner’s Engineer for construction
of Budhiganga hydropower Project.
3. Interested eligible consultants may obtain further information and EOI document free of

4. Consultants may associate with other consultants to enhance their qualifications as
member/s of Joint Venture (JV). The number of consulting firms in a JV should not exceed three
including the lead firm. One consulting firm shall not associate with more than one JV firm.
5. Expressions of interest shall be delivered online through e-GP system
www.bolpatra.gov.np/egp on or before 11.59 am on 30 March 2021.
6. In case the last date of obtaining and submission of the EOI documents happens to be a
holiday, the next working day will be deemed as the due date but the time will be the same

7. EOI will be assessed based on Qualification 30 percent, Experience (including
domestic preference) 60 percent, and Capacity 10 percent of consulting firm and key
personnel. Based on evaluation of EOI, only shortlisted firms will be invited to submit

8. Top six ranked consulting Firms scoring minimum 60 Marks out of total 100 marks and
fulfilling specified minimum requirements for each evaluation criteria and sub criteria
shall be shortlisted.

C. Objective of consultancy services or brief TOR

BACKGROUND
Budhi Ganga Hydropower Project (BHP) aims at contributing to the social and economic
development of Nepal through increasing electricity generation capacity of the country which
will help to supply the electricity for load demand by developing the Project. The Government
of Nepal (GoN) has received the loan from the Kuwait Fund for Arab Economic Development
(KFAED) and Saudi Fund for Development (SFD) for the development of Budhi Ganga
Hydropower Project, 20 MW, in Achham district of Sudur Pashchim Province and to construct
about 81.7 km, 132 kV transmission line to evacuate the power from the project. In this regard,
the BHP intends to apply part of the proceeds of this funding to payments under the contract
for consulting services as Owner’s Engineer for Construction of Budhi Ganga Hydropower
Project.
The construction works of the project under the consulting service will be undertaken in three
(3) contract packages as follows:
i. Lot 1: Civil and Hydro-mechanical Works (Dam, Headworks including Intake and
Settling basin, Headrace Tunnel, Surge Tank, Penstock, Power House, Hydro-
mechanical works etc.)
ii. Lot 2: Electromechanical works
iii. Lot 3: Transmission Line and substation works
The type of contracts for construction works for Lot 1 will be executed according FIDIC
Conditions of Contract for EPC/turnkey Project (Silver Book) and Lot 2 and Lot 3 will be
executed according to FIDIC Conditions of Contract for Plant and Design Built Project (Yellow
book).
Thus, for successful execution of these contracts, BHP is seeking to engage a competent and
experienced consulting firm to work as the Owner's Engineer (also referred to as the ‘the
Consultant’). The firm should have adequate international experience in detailed design,
monitoring and supervision, project management and co-ordination of contractor(s) in
hydropower projects.
OBJECTIVE OF CONSULTING SERVICE

The Objectives of the Consulting Services shall include ensuring proper execution of Project’s
Construction Works with high standard workmanship and materials with in the schedule and
budget, in accordance with the specifications and acceptable quality as mentioned in the
Contracts, to acceptable environmental standards and in accordance with the Employer's
requirements.
SCOPE OF SERVICES
The Consultant shall be responsible for supporting the Budhi Ganga Hydropower Project for
project management and construction supervision including project administration,
contracting, management control, review and approval of design and drawings, procurement
of equipment, materials control, inspection of equipment prior to delivery, shipment,
transportation, control of schedule and quality, pre-commissioning and completion,
performance-guarantee testing of the completed facilities, inventorying spare-parts, training
of owner's/plant sub-system operating and maintenance, personnel of the project both during

construction and operation phase under Budhi Ganga Hydropower project. The Consultant
shall also assist BHP during the defect liability period.
The Consultant shall carry out the supervision of the construction throughout the contract
period under and in close cooperation with the Client's Project Office. The Consultant shall
act as the Employer’s Representative/ Engineer for Contract, carrying out such duties and
assuming such powers and responsibilities as are mentioned in those contracts in the
agreements. Hence, the main scope of the Consulting Services shall but not limited to the
followings:
i. Supports for preconstruction activities
ii. Examination and approval of Contractors’ engineering design for EPC and plant
design build contracts.
iii. Project management and site management
iv. Quality assurance of construction works, manufacture and delivery of equipment and
other hydro-mechanical parts
v. Certification of contractors' statements
vi. Management of variations, claims and disputes
vii. Maintenance of Environment, health safety and labour relations
viii. Approval of “as-built" drawings/construction drawings/working drawings.
ix. Commissioning of the works
x. Post –construction services/ supervision during the defect liability period
xi. Issuance of plant takeover and final acceptance certificate
xii. Training, Capacity Building and Technology Transfer,
CONSULTANT'S STAFF
To provide the consulting services for the duration of the Project, the Consultant shall ensure
a team of engineers and other specialists, experienced in the detail designing and supervision
of construction of the Project.
Emphasis is placed on the need for relevant contractors’ design check and management of
site in EPC and Design and build contracts. In particular, the Engineers concerned with the
design review and construction supervision of the civil works, Hydro-mechanical works and
electro mechanical, transmission and substation works shall have previous experience in this
type of construction. It is particularly important that the Team Leader and deputy team leader
shall have substantial previous experience in dealing with contractual matters and contract
claims under Conditions of Contract for Projects ,FIDIC (Silver and Yellow book).
Responsibility for management of all services as per the Contract shall be with the
Consultant's Team Leader. The Team Leader shall provide overall technical direction and
coordination of the Services. The Consultant's Team Leader shall also manage and
coordinate the assignment of pool of experts that may be required from time to time, with prior

approval of the Client. The Team Leader may delegate its responsibilities to the Deputy Team
Leader time to time for the period of his / her absence in the project duty. Delegation of
responsibility, however, shall not free the Team Leader from his/ her accountability to the
decisions/ actions made by the Deputy Team Leader during that periods.

EOI applications which meets the eligibility criteria and minimum requirement will be
shortlisted on the basis of the Ranking Criteria. The criteria for evaluation encompass
qualification, experience, capacity, and domestic preferences (as mentioned in the Section D
of EOI document).

 The applicants who have scored minimum 60 marks and who secure 1 st to
6th rank in the order of merit based on the evaluation criteria as specified below
shall be shortlisted from EOI.
 The applicant must meet the minimum requirement of each criterion and sub
criterion as specified under the column Minimum Requirement in Table 1, Table
2 and Table 3 below to qualify for ranking. Failures to comply with those Minimum
Requirement will result in the disqualification of the Applicant for further
evaluation.
The maximum overall score that any applicant can obtain is set at 100 Marks and this is
distributed as follows:

a. In Evaluation of the EOI, the following words and expressions shall have the meaning as
stated below:
1) ."Substantially completed project" means the assignment/work/project (consulting
services or works performed by the applicant satisfying any one of the followings
conditions:
I. that is substantiated by the Client’s certificate as not less than 90% completed, or
II. that is, in case of the hydropower project substantiated by the Client’s certificate
as they are in partial operation with minimum one unit
2) . The term "Applicant" means the consultant or any firms who is submitting application
for Expression of Interest to provide the Consulting Services for Owner’s Engineer for
Construction of Budhi Ganga Hydropower Project (20 MW) as per this document.
3) The terms “detailed construction design" means services provided by the Applicant
(firm) in the detailed designs of construction works during construction period. The
"construction supervision" means services of consultants in supervising construction
activities carried out by other contractors as independent Engineer or Employer's
representative or as a partner of JV in EPC or design & build projects. Similarly,
"construction management" means the services provided by the firms for management
of construction works of the project on behalf of owner or as owner’s engineer or
owner’s representatives.
4) the "Client" means the owner of the project in which the applicant is engaged as
contractor or consulting firms.
b. The information furnished by the Consultant in the EOI document are assumed to be
realist and correct for evaluation purpose unless and otherwise specified in Instruction of
Consultant and Note hereon. The consultant shall, solely be liable to the information
furnished thereof and should furnish supporting proofs if requested by the Client.
c. In case of a joint venture (Joint Venture or JV), the Consultant must submit the joint
venture agreement duly signed by authorized signatories & stamped with company seal
of each member of joint venture in every page of JV agreement & clearly mentioning name
of the lead firm, name of JV partners, role and responsibility of each member, share
percentage, name of the authorized signatories. Similarly, the JV agreement should be
signed by authorized representative having power of attorney to sign the JV agreement.
Failure in submission of JV agreement duly signed by authorized signatories will result in
the disqualification of Applicants for evaluation.

d. The number of consulting firms in a JV should not exceed three including the lead firm.
One consulting firm shall not associate in more than one applicant.
e. The applicant must submit curricula vitae (CV) of key experts clearly mentioning nationality,
qualifications, general experiences and specific experiences. The general experiences
and specific experiences acquired only after Bachelor’s degree (or equivalent to
Bachelor’s degree) in related field of the professionals shall only be counted for evaluation.
f. The consultant shall not propose alternate experts for any key experts specified in
Evaluation Criteria (Section D). If so proposed, minimum marks secured by proposed
alternate key experts shall be provided to the Applicant.
g. The Consultant shall not propose the same key expert for more than one designation. If
so proposed, he / she shall be excluded from evaluation for any designation and the
Applicant (firm) shall be disqualified
h. Consulting Services or works delivered by the applicant as a consulting firm / member of
JV of consulting firms or as a member of JV in EPC/ Design & Build Contract shall be
considered for evaluation.
i. The specific experience of applicants in rehabilitation / upgrading / maintenance works
shall not be considered for evaluation. Similarly, review of detailed design of hydropower
projects shall not be considered as a specific experience for Detailed Engineering Design
or Detailed Project Design of the Hydropower Projects.
j. The specific experience of applicants in only one component of hydropower projects viz.
1) only Civil component and II) only Electro_ mechanical/ Hydro mechanical component/
Combined Hydro & Electro mechanical component shall not be considered for evaluation
under specific experience in B2(i). Detailed Engineering Design or Detailed Project Design
of Hydropower Projects, B2 (ii). Detailed construction design / Construction supervision /
construction management/ similar nature of services and B3. Similar Geographical
experience of consulting firm.
k. Completion and work experience shall be evidenced by the Client’s certificate with client
reference. Any certificates issued other than said Client shall not be considered for
evaluation.
l. If the references are other than in English languages, then the Applicant shall submit its
English translated copies.
m. In case of Nepalese Rupees, the average annual turnover of the applicants shall be
calculated in Net Present Value applying Overall Inflation indices of Nepal Rastra Bank.
In case of foreign currencies, conversion of foreign currency to Nepalese Rupees shall be
based on the exchange rate of Nepal Rastra Bank as on 28th day before the last
submission date of EOI application. The foreign currencies submitted in the financial
statement must be convertible currencies from Nepal Rastra Bank.
n. In Case, a corruption case is being filed to Court against the Natural Person or Board of
Director of the firm/institution /company or any partner of JV, such Natural Person or Board
of Director of the firm/institution /company or any partner of JV such firm’s or JV EoI shall
be excluded from the evaluation, if public entity receives instruction from Government of
Nepal.
