Site visit shall be administered accordingly, on the Bidder’s own risk and
responsibility and complied with COVID-19 protocols. The costs of visiting the Site
shall be at the Bidder’s own expense.

C. Preparation of Bids

ITB 10.1 The language of the Bid is: English

“The Bid, as well as all correspondence and documents relating to the bid
exchanged by the Bidder and the Employer, shall be in written in the language
specified in the BDS (English). Supporting documents and printed literature that
are part of the Bid may be in another language provided they are accompanied by
an accurate translation of the relevant passages in the language specified in the
BDS (English), in which case, for purposes of interpretation of the Bid, such
translation shall govern.”

ITB 11.1 (b) In accordance with ITB 12 and ITB 14, the following schedules shall be submitted
with the bid, including the priced Bill of Quantities for admeasurement contracts:
completed schedule and all relevant forms as required in Section 4 (Bidding
Forms)

ITB 11.1 (h) The Bidder shall submit with its Bid the following additional documents: Not

ITB 12.1 The units and rates in figures entered into the Bill of Quantities and Daywork
Schedule should be typewritten or if written by hand, must be in print form. Bill of
Quantities and Daywork Schedule not presented accordingly may be considered
nonresponsive.

ITB 13.1 Alternative bids shall not be permitted.

ITB 13.2 Alternative times for completion shall not be permitted.

If alternative times for completion are permitted, the evaluation method will be as
specified in Section 3 (Evaluation and Qualification Criteria).

ITB 13.4 Alternative technical solutions shall be permitted for the following parts of the
Works: None

If alternative technical solutions are permitted, the evaluation method will be as


specified in Section 3 (Evaluation and Qualification Criteria).

ITB 14.5 The prices quoted by the Bidder shall be fixed.

ITB 15.1 The prices shall be quoted by the bidder and shall be paid in: Indonesia Rupiah
(IDR)

ITB 16.1 Technical Proposal shall also include a Health and Safety COVID-19 Plan (HS-C19
Plan), in accordance with the relevant government regulations and guidelines on
COVID-19 prevention and control such as the Indonesia Regulation of Minister of
Health in “Permenkes No 9 Tahun 2020 Tentang Pedoman Pembatasan Sosial
Berskala Besar Dalam Penanganan COVID-19” and “Keputusan Menteri
Kesehatan No. HK.01.07/MENKES/413/2020 tentang Pedoman Pencegahan dan
Pengendalian Coronavirus Disease 2019 (COVID-19) tanggal 13 Juli 2020”, or in
the absence thereof, to international good practice guidelines such as World Health

Any bid not accompanied by the HS-C19 Plan shall be rejected by the Employer
as nonresponsive. If a Bidder submits a HS-C19 Plan that does not provide
sufficient information in accordance to the required submission information listed in
the bidding document by the Employer, the Employer shall issue a clarification to

request for further information from the Bidder. The Bidder must submit the
requested information within 5 working days of receiving such a request. Failure to
provide a satisfactory response to the request for further information within the
prescribed period of receiving such a request shall cause the rejection of the Bid.

ITB 18.1 The bid validity period shall be 150 days.

ITB 19.1 The Bidder shall furnish a bid security in the amount of IDR 942,500,000 and
issued by a reputable commercial bank and that bid security issue by an
insurance company will not be acceptable.,

ITB 19.2 The ineligibility period will be not applicable

ITB 19.4 Subject to the succeeding sentences, any bid not accompanied by an irrevocable
and callable bid security shall be rejected by the Employer as nonresponsive. If a
Bidder submits a bid security that (i) deviates in form, amount, and/or period of
validity, or (ii) does not provide sufficient identification of the Bidder (including,
without limitation, failure to indicate the name of the Joint Venture or, where the
Joint Venture has not yet been constituted, the names of all future Joint Venture
Partners), the Employer shall request the Bidder to submit a compliant bid
security within 14 days of receiving such a request. Failure to provide a compliant
bid security within the prescribed period of receiving such a request shall cause
the rejection of the Bid.

ITB 20.1 In addition to the original Bid, the number of copies is: one (1) original hard and
one (1) soft copy for each envelope (Technical and Financial Proposal) and one
(1) soft copy for CSMS/HSE Plan

ITB 20.2 The written confirmation of authorization to sign on behalf of the Bidder shall consist
of: a power of attorney specifying the representative’s authority to sign the Bid on
behalf of, and to legally bind, the Bidder. If the Bidder is an intended or an existing
joint venture, the power of attorney should be signed by all partners and specify the
authority of the named representative of the joint venture to sign on behalf of, and
legally bind, the intended or existing joint venture. If the joint venture has not yet
been formed, also include evidence from all proposed joint venture partners of their
intent to enter into a joint venture in the event of a contract award in accordance
with ITB 11.2

ITB 20.2 The Bidder shall submit an acceptable authorization within 14 days.

D. Submission and Opening of Bids

ITB 21.1 Bidders shall not have the option of submitting their Bids electronically.

ITB 25.1 If electronic bid submission is permitted in accordance with ITB 21.1, the specific

E. Evaluation and Comparison of Bids

ITB 32.1
The currency that shall be used for bid evaluation and comparison purposes to
convert all bid prices expressed in various currencies into a single currency is: Not

ITB 33.1 Domestic preference shall not apply.

ITB 34.1 The Employer does not intend for the contractor to execute any specific elements
of the Works through nominated subcontractors.

ITB 38.2 The qualifications of other firms such as the Bidder’s subsidiaries, parent entities,
affiliates, Subcontractors shall not be permitted.

ITB 40.1
Standstill provisions shall apply. The duration of standstill period will be ten (10)
days from the date of notice of intention for award of contract.

The Employer shall, at the start of the standstill period, notify in writing each Bidder
that submitted a bid, of its intention to award a contract to the successful Bidder at
the end of standstill period. The notification using the form included in Section 9
(Contract Forms) shall include the following information:
(a) the name of each Bidder who submitted a Bid;
(b) the bid prices as read out at bid opening;
(c) the name and evaluated prices of each Bid that was evaluated;
(d) the name of Bidders whose bids were rejected and the reasons for their
rejection;
(e) the name of the winning Bidder, and the price it offered, as well as the duration
and summary scope of the contract awarded; and
(f) a statement of the reason(s) the bid of the unsuccessful Bidder to whom the
notification is addressed was unsuccessful, unless the price information under
(e) of this paragraph already reveals the reason.

Regulations for ADB Borrowers (Appendix 7). The Bidder should submit its
