1. INTRODUCTION

This document is prepared by the Bid Evaluation Committee (BEC) for the reporting of the bidding process,
preliminary examination of bids, evaluation, and recommendation for award of Contract Package: NCB-BS-
MOP-22001 for the Fuel Retailing Filling Station for MPW Vehicles and Motorcycles (2 years). The
procurement procedure is in accordance with the National Public Tender/ National Competitive Bidding
Procedure of RDTL Procurement Legal Regime Decree Law 10/2005 as amended by Decree Law 24/2008.

3. PROCUREMENT PROCESS
3.1 Procedure at Bid Opening
The Bid Opening will be attended by the designated staff from the National Directorate for Procurement and
Logistic Department, DNAGP.

3.2. Invitation to Bid

The Invitation for Bids was advertised in Journal Timor Post, a newspaper of national circulation in Timor Leste
on 2 December 2021 and likewise, posted at the National Directorate for Procurement bulletin board in Rua 20
de Maio, Dili. Copy of the Invitation for Bids, as advertised, is provided in Appendix 1;

3.3. Bid Document

The Bidding Document can be obtained from the National Directorate for Procurement until 24 hours prior to
submission of bids on 14 January 2022.

Four (4) bidders purchased the bidding document prior to the deadline set for Bid submission. List of the
bidders that purchased the Bidding Documents is provided in Appendix 2.

3 .4. Pre bid Meeting

The Pre Bid Meeting was held at the Conference Room, National Directorate for Procurement on 15 December 2021
at 16:00 HTL, attended by four (4) bidders, the content of the bid document such as the instruction to bidders, bid
data sheet, presentation of bid evaluation criteria, forms, technical specifications, general conditions of contract and
particular conditions of contract. The Scope of Services and Term of Reference were presented in both English and
Tetun. List of Attendees during pre-bid meeting is attached as Appendix 3.

Response to Clarifications

During the Pre Bid Meeting the following queries were raised by bidders and requested for clarifications, covered
under the Minutes of Meeting for Contract Package: NCB-BS-MOP-22001 Fuel Retailing Filling Station for
MPW Vehicles and Motorcycles (2 years). Copy of Minutes of Meeting is attached as Appendix 4.

3.5. Bid Submission

The deadline for bid submission was held on 14 January 2022 at 16:30 HTL at the Office of the National
Directorate for Procurement.

Three (3) out of four (4) bidders purchased the Bidding Document responded and submitted their bids
on 14 January 2022 at 16:30 HTL. The Record of Bid Submission is attached as Appendix 5. As follows:

3.6 Bid Opening

The bids were opened in accordance with BDS ITB 13.g in the presence of the bidders’ representatives and
others who choose to attend at the Conference Room, National Directorate for Procurement, Minister of Public
Works,1st floor, Rua 20 de Maio, Dili.

The Bid Opening Representatives from DNA and DNAGP-DGAF opened the outer envelopes first containing
the sealed technical and financial proposals envelopes including the bid securities posted for Lot 1 and 2 by
the three (3) bidders in the presence of the bidder’s representatives during the bid opening date on 15 January
2022 at 16:30 HTL. As follows:

technical and financial proposals including bid securities for Lots 1 and 2 as follows

The sealed envelopes containing the technical and financial proposals including the bid securities for Lot s 1
and 2 of the above three (3) bidders were turned over to the Director National Directorate for Procurement for
Committee on Evaluation. Attendance for Bid Opening found as Annex 6.
3. BID EVALUATION COMMITTEE
The Bid Evaluation Committee (BEC) comprising of the following members was created on 14 January 2022
signed by the Director, National Directorate for Procurement and the Director General for Administration and
Finance under No. 03/Despacho DNA-DGAF-MOP/1/2022. As follows:

Copy of the Composition of the Bid Evaluation Committee members is attached as Appendix 7.

The Committee decisions was made on the basis of unanimous views and in case a unanimous decision could
not be reached on certain issue then the result shall be referred to the Director of the National Directorate for
Procurement and the Director General for Administration and Finance for decision.

4. EVALUATION
The evaluation and Qualification of Bidders shall be in accordance with the evaluation procedure defined in
the Decree Law 10/2005 as amended in the Decree Law 24/2008 of the Procurement Legal Regime.

Evaluation Procedure

Only bids that pass the Administrative/Eligibility Requirement shall be accepted for further evaluation on
Commercial, Technical/Professional, and Local Development Requirements. Bidders are therefore, expected
to submit in compliance with all the requirements of the bidding document following the Decree Law. As stated.

1. The main purpose of tender procedures is to select goods, services and works with the better quality/price
ration, with the purchase price being only one criterion for choosing the grantee.

2. The cost/benefit ration implies comparing the costs and benefits of the alternatives. The best result for the
Government must consider the costs and benefits during the economic life of the good, i.e. the total cost of
each good, service, construction or consultancy during the respective time of useful economic life, not just the
moment of purchase.

3. The essential criteria to be considered when analyzing proposals, based on the best cost/benefit.

4. Bids must be submitted in two envelopes; envelope one concerns technical and professional criteria,
commercial and industrial analysis and local development criteria. Envelope two shall contain the value of the
bid.

5. Bidders shall be integrated in a final list based on their capacity to meet the requirements set for the criteria
of envelope one. This demonstrates the Government’s commitment to give top priority to quality rather than
price, through the professional and technical capacity of the company, its commercial soundness and its
capacity to improve the local and regional development of Timor-Leste. Only then will the jury consider the
contents of financial cost included in envelope two.

6. Envelope two shall be open regarding bidders ranked one and two in the short list.

7. The chosen candidate shall be evaluated based on the compliance with the criteria set in envelope one and
the price indicated in envelope two.

5. PRELIMINARY EXAMINATION FOR COMPLETENESS OF BIDS

At the first step, a preliminary examination for completeness of bids was undertaken to verify if they were
complete as required by the bid document before it can undergo further detailed evaluation.

To wit:

-Whether the bid document requirement have been properly Signed;


-Written Power of Attorney/confirmation of Authorization to commit the Bidder have been submitted or
not;

-Whether Bid Security for Lots 1 and Lot 2 were included;
-Documents establishing the Administrative Requirements/Eligibility of bidders have been furnished
or not;
-Whether documents required to assess the post qualification of a bidder with respect to its technical
Capabilities such as Commercial, Technical/Professional Requirement, Local Development and
financial viability to undertake the contract have been provided or not, and
-Whether bids are generally in order for further evaluation.
-On the Price Schedule, the BEC will evaluate and compare only bids that are determined to be
substantially responsive.

6. BID EVALUATION COMBINED TECHNICAL AND FINANCIAL SCORING

The evaluation procedure for the Contract Package: NCB-BS-MOP-22001 for the Fuel Retailing Filling Station
for MPW Vehicles and Motorcycles (2 years) was incorporated in the Bid Document following the requirement
in the Bid Data Sheet ITB2 8 and 13c. The computation of the Combined Technical and Financial Scoring are as
follow:
A. ADMINISTRATIVE/ELIGIBILITY

Submission of the above is MANDATORY and any tender deemed non responsive at this stage will not be
considered further

B.COMMERCIAL, TECHNICAL REQUIREMENTS AND LOCAL DEVELOPMENT FOR ALL LOTS

Technical Passing Grade as Minimum is70% while the Maximum Value Exceeded all Requirement is 410
equivalent to 100%

This is the second stage of evaluation and will carry a total of 70%. Only bidders who will score above 70 %
under Technical evaluation will be subjected to Financial Evaluation. Those who will score below 70% will
be eliminated from the evaluation process and will not be considered further FINANCIAL EVALUATION

C. FINANCIAL PROPOSAL – Submission of Filled in Price Form and Price Schedule

Only the two (2) highest ranked bidder will be opened. This is the Third stage of evaluation and will carry a total of
30 %. Only bidders who score above 70 % under Technical evaluation will be considered under this stage

The financial submissions will be divided by the lowest financial quote to determine the financial score of each
service.

Thereafter the average financial sore will be computed and will be used in the formula below to compute the
combined technical and financial scores i.e. the average financial score will be considered as the final Financial
Score (F.S.).

COMBINED TECHNICAL AND FINANCIAL SCORES

The following formula shall be used

T.S (70%) + F.S (30 %) = T.T.L (100%)

 T.S = Technical Score = (Technical Evaluation) as evaluated against the technical criteria,

 F.S = Financial Score (computed as below)

FSL / FSC = FS
FSC = Financial submission of the tender under consideration.
FSL = Financial score for the lowest tender.

FS = Computed financial score for each tenderer.
T.T.L = Total Score

The lowest evaluated Financial Proposal (Fm) is given the maximum financial score (Sf) of 100. The formula
for determining the financial scores (Sf) of all other Proposals is calculated as following:

Sf = 100 x Fm/ F, in which:

“Sf” is the financial score,


“Fm” is the lowest price, and
“F” the price of the proposal under consideration.

Step IV. Combination of Technical and Financial Proposal

The weights given to the Technical (T) and Financial (P) Proposals are:
Technical in % = 70
Price in %= 30

Proposals are ranked according to their combined technical (St) and financial (Sf) scores using the weights.

T = the weight given to the Technical Proposal;


P = the weight given to the Financial Proposal;
( T + P = 1) as following: S = (St x T%) + (Sf x P%).

The table below summarises the overall evaluation process and the proposed weighting of each stage.

7. COMPLETENESS OF BID

All the three (3) Bidders, Bidder No. 1 Aitula Fuel Lda, Bidder No. 2 Borala Fuel Lda and Bidder No.3
Lafahek Oil & Gas submitted the filled in Technical Bid Submission Forms. A

(b) Price Schedule

For purposes of the bid, Bidder No. 1 Aitula Fuel Lda, Bidder No. 2 Borala Fuel Lda submitted the based
price of fuel at the respective fuel dispensing unit one (1) day before the bid opening.

Comment: To be revised when the Price Proposals are opened.

(c) Eligibility

Based on results, Bidder No. 1 Aitula Fuel Lda, Bidder No. 2 Borala Fuel Lda submitted the required eligibility
document while and Bidder No.3 Lafahek Oil & Gas failed to comply with the Certidão Dividas.

Bidder No. 3 Lafahek Oil & Gas, Unipessoal Lda submitted the Certidão Dividas under Ref. No. ATTL00
0000057912. TIN No.1204582 under the Firm name Lafahek Oil & Gas, Unipessoal, Lda. The Director is
Amelita Antonia da Costa Santos located in Aimutin, Comoro, Dom Aleixo, Dili, signed by Uldarico Maria
Rodrigue., Commisario de Autoridade issued on 9 December 2021 valid until 8 January 2022 Signed and
stamped by Autoridade Tribunaria on 10 December 2021.

The Bidder therefore failed at this stage. The Certidão Dividas was issued on 9 December 2021 and valid until
8 January 2022. The Certidão Dividas therefore already expired prior to bid submission on 14 January 2022.

(d) Bid Validity and Bid Security


Bidder No. 1 Aitula Fuel Lda, Bidder No. 2 Borala Fuel Lda and Bidder No.3 Lafahek Oil & Gas submitted
the signed Technical Submission form valid for 120 days.

Bidder No. 1 Aitula Fuel Lda, Bidder No. 2 Borala Fuel Lda and Bidder No.3 Lafahek Oil & Gas submitted
the required Bid Securities in the amount for Lots 1= USD 2,742.40 and Lot 2 = USD 968.00 from a
reputable commercial banks in Timor Leste as required by the bid document, a mandatory requirement.

The summary of compliance is shown in Table 4: Preliminary Examination Results.

(c) Compliance with Technical Specifications

The technical examination of the bids was undertaken to evaluate that the technical aspects comply
with the requirements of Technical Specification and Schedule of Requirements of the bidding
document. The evaluation is shown with the compliance to the Technical Specifications.

6. SUBSTANTIAL RESPONSIVENESS

Based on the preliminary evaluation carried out both bidders are substantially responsive

ANPM/PRAC/2015/004 under the Registry No. 1556/2010. No. of Indentification Fiscal Year 1014380,
represented by Armindo da Costa with capital shares of USD 20,000.00, located inSuco Malinamoc, Aldeia 30
de Augusto. The Service Provider checked the activities applicable fields by checking the column on
Construction and operation of Fuel Stations. Compania Borala, Lda complied with the requirements of
Regulation No. 1/2013 and its Amendment No. 3/2014 and No. 1/2020 on the Installation and Operation of a
Gas Station.

Refilling Station located in Rua Mercida Viqueque. One (1) Refilling Stations in Baucau presently undergoing
constructions. Submitted the road map in Dili Station located in Dili in Rua Presidenta Nicolau Lobato.

Bidder No. 1 Aitula Fuel, Lda Submitted the Diesel Acceptance Test from Hera Fuel Storage and Terminal
and Certificate of Quality from SGS and submitted the Certificate for Trade Registry from Ministry of Justice
and Trade Registry And Trade Register Certificate of Registration.

Submitted the Manufacturer’s Wholesaler Authorization stating that Pertamina-Indonesia who are a established
and reputable oil and Gas Exploration and Production Company, which have a couple of Refineries in Indonesia
is authorizing Aitula Fuels, Lda to submit a bid however, the Manufacturer’s Authorization is signed by the
Director of Aitula Fuel’s Lda.

Bidder No.2 Borala, Unipessoal Lda submitted Declaration for Free Circulation from ANPM, in its capacity
as the regulatory body for the sector and downstream in East Timor and in the exercise of its licensing powers,
pursuant to article 11 No. 3, of Regulation N.2/2016, of 28 December 2016, stating ANPM grants the free
circulation of gasoline and diesel for automatic vehicles included in the transaction authorization under No

Bidder No.2 Borala, Unipessoal Lda submitted the Key Equipment – Fuel Dispenser stating that at present
the Company owned two (2) Depots, one located in Dili Depot with 90,000 liters capacity and the year
manufactured was in CY 2017 and in Viqueque Two (2) Depots at 25000 liters capacity per each depot and
the year manufactured was in CY 2020. In Dili, the Fuel Stations consists of six (6) sets of Dispensers and in
Viqueque the Company have 4 units of Dispensers signed by the Manager, the Authorized signatory of the
Director on 14 January 2022. Submitted copies of pictures of all equipment. Submitted the EQU filled in forms
signed by the Authorized Signatoree.

8. Bidder Declaration

Bidder No. 1 Aitula Fuel’s, Lda submitted the Bidder Declaration stating that the Company will start
producing the coupon within 5 days with a commitment of one (1) year but the document signed by
the Director on 23 May 2019.

Bidder No. 2 Borala Fuel submitted the Fuel Supply Declaration stating that the supplier will follow all rules
written in the Contract, Supplier will continue to supply when coupons are still valid and available until the coupons
are fully consummated signed by the Manager, the Authorized signatoree on 14 January 2022.
