Identify the ethical and legal issues of which Gerard needs to be aware.

There are many issues that


fall in the lines of emotional, and financial due to the pressure he is having with his wife no longer working
due to her pregnancy. There is more organizational pressure at this point for Gerard than anything.
Discuss the advantages and disadvantages of each decision Gerard has made and could make.
Gerard has worked at his firm for many years. He has many pressures due to his wife’s pregnancy being
high risk. Also the many changes in his industry and company have put him in an awkward position. He
could make irrational quick decisions based on these pressures. It seems if his firm continues to push the
competitor’s options, the client will drop their services. But if he refuses to follow the changes with his
company he could be terminated
Discuss the issues of accounting firms going into the financial services market.
This issue is prevalent. We have seen this conflict arise in some of the fallouts after the Wall Street
meltdowns in 2008-2009. But many firms have on purpose stayed away from this because of possible
conflicts of interest, as with Gerard and his company
Discuss the types of groups that are influencing Gerard.

Discuss how the Sarbanes–Oxley Act has changed corporate culture

Expand on how the Sarbanes–Oxley Act impacts organizational culture and why federal oversight like this is
needed.
This was congress way to respond to the accounting scandals going at many major corporations. One that we can all
remember would be Enron. Once this scandal was over Enron was out of business as well as the accounting firm
handling them, was in bad shape. There were many other firms involved in this scandal as well, companies lost
billions and the consumer lost faith in accounting firms and in the government’s ability to monitor the policies

Why do you think this type of misconduct continues despite these regulatory laws?
Money is the driving factor as to why this type of thing continues to happen. When millions are at stake,
people will find any way to get it.
