Sirs:

Greetings!

I received your letter demanding me to pay in full within sixty (60) days from receipt the
outstanding defaulted monthly amortization in an aggregate amount of ONE HUNDRED FORTY
NINE THOUSAND SEVEN HUNDRED ELEVEN AND 05/100 (PHP149,711.06), as of this date.

To this, it is already beyond my capacity to settle in one-time payment in full the amount
of ONE HUNDRED FORTY NINE THOUSAND SEVEN HUNDRED ELEVEN AND 05/100
(PHP149,711.06) considering my income has been affected by the pandemic due to Covid19. In
fact, my son and his wife were both lost their respective job due to company retrenchment.
Worst, their respective companies could not pay them their separation pays. Thus, I am solely
the one who shouldered all the household expenses while they are still looking for another job,
or whatever activity to source their income., if any.

I have no intention to be in default payment of my monthly obligation but due to the

change of circumstances in my financial capacity, as much to my regret, I left no choice but to
accept the termination/cancellation of our contract to sell

On the other hand, I humbly invoking my right under MACEDA LAW, also known as the
R.A. No. 6552 - AN ACT TO PROVIDE PROTECTION TO BUYERS OF REAL ESTATE ON
INSTALLMENT PAYMENTS. (Rep. Act No. 6552, particularly Section 3(b) which provides, that:

Section 3. x x x

(b) If the contract is canceled, the seller shall refund to the buyer the cash surrender
value of the payments on the property equivalent to fifty per cent of the total payments
made, x x x .

The MACEDA LAW also provides that buyers who are already paid at least 2 years of
monthly amortization are entitled, among others, to such fifty percent refund of the total
payments made, and in my case, I already paid more than three years. Thusly, it will be highly
appreciated for any assistance that your good Office will extend in processing my 50% refund of
the total payments that I made.
