COMPLAINT AFFIDAVIT

I, CYNTHIA R. CALANOC, of legal age, Filipino, married, and with

residence address at 29-F Junio St. Col. Bonny Serrano Road, Libis,
Quezon City, after having sworn to in accordance with law do hereby
depose and say, that:

1. I would like to file a complaint against Narciso Vasquez and

Roger Trinidad (Respondents, for brevity) for their deliberate act
of demolishing, without our knowledge and consent, the tall
concrete fence wall, cutting the trees and destroyed several
plants we planted in front of said concrete fence wall they
demolished along the sidewalk of Junio Street. This was
transpired on February 23, 2021.

2. Respondents being a resident of 650 Col. Bonny Serrano Road,

Libis Quezon City, had already have access to the main road
(Col. Bonny Serrano Road), when they demolished the
abovementioned concrete fence located at the back of their real
property. This to have access also to Junio Street in front of our
house.

3. The concrete fence I am referring to had been existing for more

than fifty (50) years and beyond the metes and bounds of their
property. It was constructed on different purposes, such as a
security from direct access from the main road (Col. Bonny
Serrano Road), but especially as a firewall that commonly
shared by the houses located along Junio Street. It was so
happened that the portion of the wall that was demolished by
respondents was the only portion that has no residential
structure.

4. As part of the community beautification program, we planted

several plants and trees on that sidewalk that me and my
husband have been the one who maintained and cared of the
plants. In fact, prior the demolition, I planted a set of seeds.
These plants and trees had sentimental value to us because not
only it yield fruits, but also helped us as our stress reliever.

5. We confronted respondents for their actuation because they did

not asked permission that they will demolish the concrete fence
and clear all the plans and trees there. We also asked whether
they have a permit to conduct renovation because these were
already beyond the bounds of their property.

6. We learned upon inquiring from the DENR and the designated

City Engineering of Quezon City Hall that they don’t have permit
 to cut the trees and conduct renovation. We can give way if
they only have asked us first for permission, in order for us to
transfer the plants and trees to another safe location, but, the
worst part, not only that they deceived us that they secured
permits, but, worst, the son of Roger, Mr. Rogel Trinidad, who
happened to be a school teacher, deliberately uttered to us
idiot and stupid, and there were many times she took
videos/photos using his mobile phone every time I was walking
in front of their house, to our damaged and prejudiced, which
really caused us serious emotionally distressed, sleepless nights,
and moral anguished. We went to the barangay to report said
incidents, but to our dismay, no action has been taken and our
complaints were only fell into deaf ears.

7. At present, there were letters from the Department of Building

Official and DENR addressed to Respondents, stating that they
were, indeed, liable for violation of building code for lack of
permit, and violation of environmental laws, respectively.

8. That I respectfully pray that the damages that caused by

respondents against our person be recompensed.

9. That I am executing this affidavit to attest to the truth of the

foregoing instrument and for any legal purposes and intent this
may serve.
