Reg. 2: Definitions

(a)“Act” means the Electricity Act, 2003.

(b)“Contractor” means a person or an agency who undertakes


to produce a given result, not merely supply of goods or
articles of manufacture but including civil works or erection
of equipment or testing and commissioning of equipment
or operation and maintenance of equipment and includes a
sub-contractor.

Reg. 2: Definitions

(c) “Owner” means a company or body corporate or


association or body of individuals, whether incorporated
or not, or artificial juridical person, which owns or
operates or maintains electrical plants or electrical lines
and includes Occupier as per The Factories Act, 1948 &
Employer as defined in BOCW Act, 1996.

Rule-2: Definitions
(d) “Owner” means a Company or Body Corporate or
Association or Body of Individuals, whether incorporated or
not or artificial juridical person, which owns or operates or
maintain electrical plants or electric lines and includes;
(i) “Occupier” as defined in Factory Act, 1948.
(ii) “Employer" as defined in Building and Other
Construction Workers (Regulation of Employment &
Conditions of Service) Act, 1996.

Rule-2: Definitions

(e) “Occupier” as defined in the Factory Act, 1948.

The person who has ultimate control over the affairs of the
factory. Provided that—

(i) in the case of a firm or other association of individuals, any


one of the individual partners or members thereof shall be
deemed to be the occupier;

(ii) in the case of a company, any one of the directors shall be
deemed to be the occupier;
(iii) in the case of a factory owned or controlled by the Central
Government or any State Government, or any local authority,
the person or persons appointed to manage the affairs of the
factory by the Central Government, the State Government
or the local authority, as the case may be, shall be deemed
to be the occupier.

Rule-2: Definitions

(e) “Employer” as defined in Building and Other Construction


Workers (Regulation of Employment & Conditions of Service)
Act, 1996.

(i) Employer means the Owner of the building or other


construction work carried on by the Authority of any Govt.
Department directly without any contractor, the Authority
specified in this behalf, or where no authority is specified,

supplied by a Contractor, the Contractor;

Rule-3:
CEA Regulations, 2011 are not in derogation of any
other law. The provisions of these regulations shall be
in addition to and not in derogation of the provisions
of any other law for the time being in force.

CEA Reg. 7: Safety Provisions Relating to Contractor

 Owner shall incorporate applicable safety provisions in


the contract document.
 The contractor shall observe safety requirements as laid
down in contract document. In case of sub-contract, it
shall be the responsibility of the main contractor that all
safety requirements are followed by the employees and
staff of sub-contractor

Regulation-7: Safety Provisions Relating to Contractor
 Contractor employing 200 or more shall appoint a Safety
Coordinator for implementation of safety requirements.

 In case of < 200 employee, the contractor shall nominate


one of his employee as Safety Coordinator who shall liaise
with SO and his name shall be displayed on Notice Board.

 Contractor shall be responsible for non compliance of


safety measures, implications, injuries, fatalities and
compensation arising out of such situation or incident.

CEA Reg. 7: Safety Provisions Relating to Contractor

 In case of accident, contractor shall immediately submit a


statement of the same to the owner and SO with complete
details like type of injury / causality / property damage and
action taken to prevent recurrence; and

 To submit a monthly statement of accidents to the Owner at


the end of each month

CEA Reg. 8: Reporting of Accidents
Accidents like Fire, Explosion of pressure piping or
pressure vessel, implosion, emission of hazardous
chemicals, collapse of transmission tower, flooding of
power house should be reported to the Authority within 24
Hrs. whether or not any Death or Disablement is caused to
any person.
Hydro-electric generating Units : 50 MW and above.

Electric Lines / Sub-stations : 132 kV and above.


Thermal generating units : 200 MW & above

CEA Reg.9: Emergency Management Plan (EMP)

EMP to be prepared as per Schedule-III, to deal


with emergencies like fire, explosion, gas leakage,
land slide, flood, earthquake, storm, cyclone,
hurricane and crisis situations arising in the event of

bomb threats.

five hundred workers and one more medical officer for every
additional one thousand workers
 One nurse, one dresser cum compounder and one sweeper
cum ward boy throughout the working hours

 Once before employment to ascertain physical fitness of the
person to do the particular job

(I) Annually, for those who are less than forty-five years old.
(II) Every six months, for those who are more than forty-five years
