JUDICIAL AFFIDAVIT

I, JONEL RAMOS VARGAS, Filipino, of legal age, a resident of Brgy.

Callawa, Davao City, after having been sworn to in accordance with the
law, do hereby depose and say that:

1. Atty. Marlou V. Suralta conducted and supervised the taking of this

judicial affidavit at his office located at Maa, Davao City.

2. I fully understand or am conscious of all my answers to the questions

of the above-named lawyer and understand that I may face criminal
liability of perjury in case my statements may be proven to be false
testimonies.

PURPOSE

This Affidavit is being offered to prove that the case for murder
against the accused is baseless. 

It is respectfully prayed that this Judicial Affidavit of Mr. Vargas be

admitted in order to expedite the proceedings.

a. Q. Mr. Witness, please state your name and other personal

A. I am Jonel R. Vargas, Filipino, 28 years old, Single, and a resident of
Brgy Callawa, Davao City. (Ako si Jonel R. Vargas, Filipino, 28 years
old, ulitawo, ug residente sa Brgy Callawa, Davao City)

b. Q. Do you know a certain Jojo Magbanua? (Naa ba kay kaila nga

Jojo Magbanua)
A. No Sir. (Wala Sir)

c. Q. Do you know a certain Adelfa Lagac? (Naa ba kay kaila nga

Adelfa Lagac)

A. No Sir. (Wala Sir)

d. Q: Where were you last September 04, 2017? (Asa man ka atong
Septembre 04, 2017?)

A:  Last September 04, 2017, I am at my house in Brgy. Callawa

Davao City (Atong Septembre 04, 2017, ako naa sa akong balay sa
Brgy. Callawa, Davao City)

e. Q: What did you do at around 7:00pm in the evening? (Unsa man

imong gibuhat mga alas syete ang takna sa gabii?)

A: I was just watching the movie “You changed my life” by Sarah

Geronimo and John Lloyd Cruz. In fact, from 4:00 pm in the
afternoon to 11:00pm in the evening, I am just at the sala of my house
consuming my time watching movies. (Nagtan-aw ko sa salida nga
“You changed my life nina Sarah Geronimo and John Lloyd Cruz. Sa
pagkatinoud lang, naa rako sa sala sa akong balay gikan alas kwatro
sa hapon hangtud alas onse sa gabii gihurot akong oras nagtan-aw ug
salida.)

f. Q: What can you say about the allegations that you killed Jojo
Magbanua? (Unsa man imong masulti sa alegasyon nga gipatay nimo
si Jojo Magbanua?)

A: The allegations are all false, fabricated and a brazen lie. (Ang
mga alegasyon nako tanan mali, himo-himo ug usa ka dakong bakak)

g. Q: How can you prove such averments? (Unsaon nimo pag

pamatoud ana nga pangangkon?)

A: My aunt Amihope Vargas can prove that on September 04,

2017 at around 7:00pm in the evening, I was just watching a movie.
 (Ang akong ante Amihope Vargas ang makapamatoud nga atong
Septembre 04, 2017 mga alas syete ang takna sa gabii, nagtan-aw rako
ug salida.
