I,  Taylor  Alison  Swift  ​(Name  of  the  Client)  agrees  to  the  final  size,  shape, 
flavor,  and  design  for  the  custom  cake  and  also everything that is stated below 
for  the  policy.  and  will  pay  the  total  price  of  ​P11,000.00  (Eleven  Thousand 
Pesos)​ to Fudzbyneney based on what the agreed time and mode of payment.  
 
 CAKE AND ORDER POLICY 
 
I. PERSONAL INFORMATION 
1. The  ​CLIENT  ​authorizes  ​FUDZBYNENEY  ​to  keep  their  personal 
information  stated  about  for  booking  purposes.  ​FUDZBYNENEY 
promises  that  this  is  confidential  and  will  not  be  disclosed  to  any 
person,  form,  company  not  related  to  the  business  and  it  will  be 
used against them. 
2. The  ​CLIENT​’s  information  stated  above  is  final  and  can  not  be 
changed.  If  the  ​CLIENT  ​wishes  to  change  the  following 
information  (E.g.  Delivery  Address  and  Date),  he/she  needs  to 
come  forward  to  his/her  contact  person  at  FUDZBYNENEY  and the 
changes  are  still  subject  for  approval  depending  also  for  the 
availability. 
 
II. CAKE FLAVOR AND DESIGN 
1. Whatever  the  final  cake  size,shape,  flavor,  design,  serving,  and 
drawing/photo  that  is  stated  above  that  is  approved  by 
FUDZBYNENEY a ​ nd the ​CLIENT ​is final and ​can not be changed​.  
2. Please take note that​ CLIENT​’s photo inspiration is from the 
internet, it is really only for ​INSPIRATION ONLY​. Small details and 
changes (E.g. Size, Color, Shape, Accents, etc.) will apply for 
copyright purposes. This is still and upon for approval of the 
CLIENT ​as well.  
3. FUDZBYNENEY s ​ hould deliver the agreed cake size, shape, flavor, 
design, and serving to the C ​ LIENT ​as what agreed above.  
4. The ​CLIENT s ​ hould be aware and held responsible that the 
products of F ​ UDZBYNENEY ​have ​ALLERGENS ​(E.g. Dairy, Eggs, 
Cheese, Nuts, etc.) and it comes with ​RISK OF FOOD 
CONTAMINATION​ if exposed and stored incorrectly after delivery. 
FUDZBYNENEY w ​ ill not be held liable for any accident relating to 
it. 
 
III. DEPOSIT AND PAYMENT  
1. The  ​CLIENT  ​is  required  to  pay  the  full  Fifty (50)% down payment 
as  a  deposit  to  reserve  their  preferred  date,  which  is  ​NOT 
 REFUNDABLE  upon  placing  the  order  and  signing  the  contract  to 
FUDZBYNENEY.​ No Down Payment, No Order.  
2. The  ​CLIENT  ​should  pay  on  time  and  only  be  allowed  to  pay  the 
DEPOSIT  ​and  ​BALANCE  ​on  the  agreed  ​DUE  DATE​.  The  ​CLIENT 
should  only  give  the  payment  personally  to  the  one  who  is 
responsible  and  the  name and the one who signed below or his/her 
contact person to F ​ UDZBYNENEY​.  
3. The  ​CLIENT  ​is  required  to  pay  the  remaining  balance,  which  is 
NOT  REFUNDABLE  based  on  the  agreement  above  with 
FUDZBYNENEY.  If  the  CLIENT  failed  to  pay  for  the  remaining 
balance  on  time  or  not,  both  parties  have  to  settle  it.  If  not 
possible, legal sanctions will apply.   
 
III. DATE CHANGES & CANCELLATION  
1. The  ​CLIENT  ​may  change  the  final  agreed  delivery  date  needed 
Three  (3)  months  earlier  before  the  said date​, but this depends on 
the availability of the preferred new delivery date. 
2. The  ​CLIENT  ​may  cancel  ​Three  (3) months before the said delivery 
date  but  never  beyond  the  said  duration.  The  ​DOWN  PAYMENT  is 
still not refundable.  
 
V. REFUND 
1. The  refund  will  be  processed  if  and  only  if  the  cancellation  is 
approved.  
2. Any  refund  that  is  possible  will  be  processed  if  and  only  if  it  is 
approved. 
 
VI. FORCE MAJEURE 
1. In  the  event  of  ​FORCE  MAJEURE  ​(​fire,  flood,  lightning,  typhoon, 
earthquake,  storm,  riot  or  any  other  unforeseen disabling cause of 
acts  of  God.)  During  the  week  and  day  of  delivery  date  occurs 
which  causes  the  failure  of  delivery  of  the  cake,  ​FUDZBYNENEY 
will  not  be  held  responsible  for  the  delays  and  damages  and  the 
client  should  still  pay  for  the  balance.  However,  ​FUDZBYNENEY 
will  do  its  best  to  still  deliver  the  cake  ​IF  POSSIBLE  within  the 
agreed  date  and  would  like  to  ask  some  consideration  from  the 
 client  (E.g.  Delivery  time  extension,  etc.)  but  If  the  delay  is  not 
caused by the Seller,the Seller will be held liable for it. 
 
 
This order form and contract is exclusive for Fudzbyneney: Custom Cake and 
Pastries only.  
 
If any of the policy is violated by either of the both parties, the one will be held 
liable and the problem will be resolved through legal sanctions.
