JUDICIAL AFFIDAVIT OF ELNORA DIMAANTA

This Judicial Affidavit is executed to serve as her direct testimony in

the instant case.

I, Elnora Dimaanta, of legal age, single, a resident of 123 Masaya St.

Sampaloc Manila, state under oath as follows:

PRELIMINARY STATEMENT

The person examining me is Atty. Joan Mae S. Latumbo at her office

at the Manila City. The examination is being held at the same address. I am
answering her questions fully conscious that I do so under oath and may face
criminal liability for false testimony and perjury.

This Judicial Affidavit of the witness Elnora Dimaanta is being offered to

prove that:
1. The witness is present at or near the place of incident;
2. She heard the altercation of the accused and the victim prior to the
discovery of the body of the victim; and,
 3. All other matters relative to this case.

The following are the questions proposed by Atty. Latumbo and my answers
are in English:
Q: Do you swear the truth and nothing but the truth?
A: I do.

Q: Are you aware that you may face criminal liability for false testimony or
perjury if you will not tell the truth?
A: Yes, I am aware.

Q: Please state your name, age, address and occupation.

A: My name is Elnora Dimaanta, 28 years old, a resident of 123 Masaya St.
Sampaloc Manila, a hotel staff at the City Garden Suites at Ermita, Manila.

Q: Do you know why you are here today?

A: Yes. I am here to answer questions in relation to the Criminal Case No.
98765.

Q: Do you know the victim in this case?

A: Yes. Juanito Cagandahan a.k.a Jen Cagandahan.

Q: Do you know the victim personally?

A: No. I came to know the victim only on February 15, 2021 when she was
found dead at Suite 2209 of the City Garden Suites where I work as a hotel
staff;

Q: How about the accused in this case, Silverio Cruz, do you know him?
A: Also, not personally. I just came to know him upon Identification of the
hotel receptionist as the one who checked-in at Suite 2209 together with the
victim.

Q: And what was the prior incident that led to you knowing the victim and the
 accused?
A: At around 9:00 o’clock in the evening of February 15, 2021, I am at the
Suite 2220 because a guest requested extra towel. When I passed by the
Suite 2209, I heard voices of a man and a woman shouting at and cursing at
each other.

Q: Can you recall the words uttered by those persons?

A: I just heard the male voice saying “Bakla kang hayop ka! Niloko mo ko!”
while the female voice saying “So, ano? Ayaw mo na sakin? Ganun ganun
na lang?

Q: Then what happened?

A: I decided to proceed to my area because I realized it’s not right to eavesdrop
to other people’s conversation. However, I heard a loud noise, like a
gunshot. Out of fear, I ran to the nearest elevator. When the door was about
to shut, a man wearing a khaki pants and a white shirt with blue body bag
rushed in the same elevator. I stepped out at the 2 nd floor so that I can report
the incident to our manager while the man did not leave, so I assumed he is
going to the ground floor.

Q. If you saw the man you are referring to wearing khaki pants and white shirt
with blue body bag again, will you be able to identify him?
A. Yes, ma’am.

Q. Is that man in this room?

A. Yes, ma’am.

Q. Can you please point to him.

Witness Your Honor pointed to the Accused.
This man you were describing, is he a guest at the hotel?
A: Yes.

Q: And do you know from which Suite did he come from?

A: At first, I was not aware. But when I described the man to the receptionist,
she identified the man to be the one who checked in with the victim at Suite
2209. It was further confirmed by the CCTV footage in the hallway that
such man came from Suite 2209.

Nothing further, Your Honor, the witness is ready for cross.

Affiant further sayeth naught.
