JUDICIAL AFFIDAVIT OF JOHNNY SIMS

(ACCUSED)
The direct examination is conducted and Recorded by Atty. Mike Khaliffa upon
the person of Johnny Sims, before Manila Prosecutor’s office on September 14, 2020 at
Room 23, 3rd floor Jollibee Plaza building , 5th avenue, Cubao, Quezon City.

Mr. Sims is answering the questions asked of him in his full conscious state of
mind and that he does so under oath and that he may face criminal liability for false
testimony or perjury.

BACKGROUND OF THE CASE

Kanya West is a 20 year old single man residing at 92 K-H street ,Brgy. East
Kamias, Quezon city, was attacked, stabbed by Johnny Sims on September 13,2020 in
Dark Room, Espana, Manila.

ACCUSED: Johnny Sims

FACTS TO BE ESTABLISHED:
1. The fact of the place is at night time.
2. That the accused does not provoke the victim to instigated the heated argument.
3. That Kanya West approach the accused and start shouting at him with insulting
and vulgar words..
4. That Kanya West provoked the accused by sitting beside him.

PRELIMINARY QUESTIONS

Q: Please state your name and profession for the benefit of the court?

A: My name if Johnny Sims, an electrical engineer.

Q: Kindly state why you are present on the crime scene?

A: I was drinking with my companion, Pepe Montalban.

Q: What is your relationship with Pepe Montalban?

A: We are friends.

Q: Was it just the two of you drinking that night?

A: Yes.

Q: Is this your first time to testify in court?

A: yes, that was my first time.

DIRECT EXAMINATION PROPER

Q: What time did you arrive at the Bar?

A: Past 5 in the afternoon.

Q: Please describe to this honorable court the place where you were drinking?
A: It was fairly small and quite dark, since the only source of light are the neon lights
placed near the entrance of the Bar

Q: Why were you at the Bar?

A: We are celebrating for the Championship of Los Angeles Lakers.

Q: What were you drinking?

A: San Miguel light.

Q: How Many botttles?

A: Roughly around 6 bottles up to the time of incident.

Q: Are you drunk during the incident?

A: No we are not, actually we are having good conversation about the prospect
championship team next year.

Q: What happened after that?

A: Kanye East approached us.

Q: Do you know the victim?

A: No.

Q: Why did he approach you?

A: He is saying that the Lakers are a bunch of ass* that they cheated their way to
championship. I guess he overheard my conversation with Pepe.

Q: Did you argue with Kanye, when he said that?

A: No.

Q: When Kanye East approached where you were sitting, was he drunk?
A: Yes.
Q: What happened after that?

A: I told him to calm down because I was actually a fan of heat it just turned out that
lebron become lakers. But Mr. West was insisting and shouting that we are Dumb for
being a fan of lakers and said other insulting words.

Q: What happened during the heated argument?

A: Pepe tried to stop Mr. West, but he was very aggressive and very drunk to the point
where he sat on our table and provoked us to fight.

Q: Did you feel threatened by his provocations?

A: Yes. Mr. West is fairly tall probably 5’ 10 inches tall, and has sturdy mascular build.
And he is boasting that he is an MMA fighter. I think if he will punch me, I will
immediately get knocked out.
