Niño: Same Appearance, Atty. Niño Etulle for the defense your honor.
Aaron: Proceed.
Niño: Thank you your honor. Ms. Witness, you said that you had a verbal
altercation with the accused, correct?
Niño: The incident took place at around 6 o’clock in the morning while you
were sweeping the leaves in your yard. Correct?
Niño: As you narrated, you saw garbage and trash in your yard, correct?
Niño: So when you saw the accused who was living next to you, you
confronted her and accused her with throwing the garbage in your yard.
Correct?
Joanne: Yes. Sir.
Niño: In your narration, you did not saw her threw the garbage and trash in
your yard, correct?
Niño: But you assumed that it was the accused who threw the garbage at
your yard. Correct?
Joanne: Yes Sir. Since the accused is living alone next door.
Niño: The accused got angry and denied the allegation which resulted in
both of you hurling invectives against one another. Correct?
Niño: So you agree with me that when the accused shouted “BORIKAT
KA! YAWA KA! (YOU SLUT!!!! DEVIL!!!) she made the utterances in the
heat of anger and there was some sort of provocation on your part.
Correct?
Niño: Thank you, Ms. Juntilla. That will be all, your honor. Thank you.
April: That was the last case for today, your honor.
