BACKGROUND:

On September 30, 2020, I was reviewing instant messages (IMs) due to a separate unrelated incident.
The IMs were dated from August 2 to October 1, 2020. The content of the messages ranged from
work related topics to non-work related topics. Some of the non-work related topics were not
appropriate to be discussed through the agency instant messaging system. Based on the content of the
messages, I requested an internal administrative investigation, which was ordered by Chief Deputy
Kevin McGinley on October 1, 2020.

Note: On January 5, 2021, the new Osceola County Sheriff's Office administration was sworn in and
Chief Deputy John Haydel assumed the duties of the Chief Deputy.

INVESTIGATIVE DETAILS:

September 30, 2020

I was reviewing IMs due to an unrelated investigation and discovered multiple deputies were sending
inappropriate messages during the course of their conversations. The deputies who sent the messages
are Javier Arroyo, Damian Rodriguez, David Ruiz-Beltran, Michael Dijulio, Cristian Torres,
Rhandall Leger-Diaz, Michael Sherotski, and Miguel Irizarry.

The messages included conversations about the attractiveness of female citizens as well as female
deputies, sexually suggestive language, some racially insensitive statements, comments regarding use
of force on subjects, and other offensive comments. The following are the statements as I read them
with no context. During the interviews with the deputies, the context of the individual statements
will be addressed.

Deputy Sherotski made the following concerning statements:

Deputy Ruiz-Beltran made the following concerning statements:

October 1, 2020 /1500 Hours

I met with Deputy Javier Arroyo at the Osceola County Sheriffs South Office. Deputy Arroyo was
informed he was the subject of an internal investigation and was provided with the Osceola County
Sheriffs Office Internal Investigation Notification Form (S0-05-104) outlining his rights and
responsibilities as an accused employee in an internal investigation.

I also provided him an inter-office memorandum specifically identifying his right to the timely
completion of the administrative investigation and outlining circumstances which would necessitate
the tolling of the 180-day requirement. After reviewing, Deputy Arroyo signed both documents and
was provided with copies. Please see attached forms for further details.

October 1, 2020 /1527 Hours

I met with Deputy Damian Rodriguez at the Osceola County Sheriffs South Office. Deputy
Rodriguez was informed he was the subject of an internal investigation and was provided with the
Osceola County Sheriffs Office Internal Investigation Notification Form (S0-05-1 04) outlining his
rights and responsibilities as an accused employee in an internal investigation.

I also provided him an inter-office memorandum specifically identifying his right to the timely
completion of the administrative investigation and outlining circumstances which would necessitate
the tolling of the 180-day requirement. After reviewing, Deputy Rodriguez signed both documents
and was provided with copies. Please see attached forms for further details.

October 1, 2020 /1537 Hours

I met with Deputy David Ruiz-Beltran at the Osceola County Sheriffs South Office. Deputy Ruiz-
Beltran was informed he was the subject of an internal investigation and was provided with the
Osceola County Sheriffs Office Internal Investigation Notification Form (S0-05-1 04) outlining his
rights and responsibilities as an accused employee in an internal investigation.

I also provided him an inter-office memorandum specifically identifying his right to the timely
completion of the administrative investigation and outlining circumstances which would necessitate
the tolling of the 180-day requirement. After reviewing, Deputy Ruiz-Beltran signed both documents
and was provided with copies. Please see attached forms for further details.

October 1, 2020 /1557 Hours

I met with Deputy Michael Dijulio at the Osceola County Sheriff's South Office. Deputy Dijulio was
informed he was the subject of an internal investigation and was provided with the Osceola County

I met with Deputy Cristian Torres at the Osceola County Sheriffs West Office. Deputy Torres was
informed he was the subject of an internal investigation and was provided with the Osceola County
Sheriffs Office Internal Investigation Notification Form (S0-05-104) outlining his rights and
responsibilities as an accused employee in an internal investigation.

I also provided him an inter-office memorandum specifically identifying his right to the timely
completion of the administrative investigation and outlining circumstances which would necessitate
the tolling of the 180-day requirement. After reviewing, Deputy Torres signed both documents and
was provided with copies. Please see attached forms for further details.

October 7, 2020 /1048 Hours

I met with Deputy Rhandall Leger-Diaz at the Osceola County Sheriffs Office. Deputy Leger-Diaz
was informed he was the subject of an internal investigation and was provided with the Osceola
County Sheriffs Office Internal Investigation Notification Form (S0-05-104) outlining his rights
and responsibilities as an accused employee in an internal investigation.

I also provided him an inter-office memorandum specifically identifying his right to the timely
completion of the administrative investigation and outlining circumstances which would necessitate
the tolling of the 180-day requirement. After reviewing, Deputy Leger-Diaz signed both documents
and was provided with copies. Please see attached forms for further details.

October 7, 2020 /1846 Hours

I met with Deputy Michael Sherotski at the Osceola County Sheriffs West Office. Deputy Sherotski
was informed he was the subject of an internal investigation and was provided with the Osceola
County Sheriffs Office Internal Investigation Notification Form (S0-05-104) outlining his rights
and responsibilities as an accused employee in an internal investigation.

October 7, 2020 I 1902 Hours

I met with Deputy Miguel Irizarry at the Osceola County Sheriffs West Office. Deputy Irizarry was
informed he was the subject of an internal investigation and was provided with the Osceola County
Sheriffs Office Internal Investigation Notification Form (S0-05-104) outlining his rights and
responsibilities as an accused employee in an internal investigation.

I also provided him an inter-office memorandum specifically identifying his right to the timely
completion of the administrative investigation and outlining circumstances which would necessitate
the tolling of the 180-day requirement. After reviewing, Deputy Irizarry signed both documents and
was provided with copies. Please see attached forms for further details.

February 2, 2021 I 1817 Hours

Sergeant Jacqueline Moizer and I met with Deputy Michael Sherotski in the Internal Affairs Office
for the purpose of obtaining his sworn recorded statement regarding this incident. Deputy Sherotski
was provided with all the collected materials regarding this incident. Once he advised he completed
his review, Deputy Sherotski's sworn interview was conducted. It is summarized below.

Deputy Sherotski has been employed at the Osceola County Sheriffs Office since August of2018.
He is currently assigned to the Patrol Division in the West Sector. Deputy Sherotski has only been
assigned to the Patrol Division. Deputy Sherotski advised he read the IMs he typed and sent.

Note: The page numbers referenced are not sequential and corresponds with one of five groups of
instant messages which were utilized during this investigation.

I inquired ifhe could explain what "af" meant in his messages. Deputy Sherotski stated, "Asfuck"
On page 166 of 815 Deputy Sherotski wrote, "wooooow /A dumb aj " I asked him to read his
statement out loud to include what he meant by the initials. Deputy Sherotski stated, "Wooooow
Internal Affairs dumb as fuck. "

I questioned if he could explain the context of this statement. Deputy Sherotski advised Deputy
Dijulio was involved in an internal affairs investigation, which he asked Deputy Dijulio about. He
was told by Deputy Dijulio they could not talk about the investigation. Deputy Sherotski's response
was that lA was dumb because he could not find out the information about Deputy Dijulio's case.

Deputy Sherotski explained this statement was an attempt at humor to make Deputy Dijulio feel
better because Deputy Dijulio was involved in an internal affairs investigation.

On page 292 and 293 of 815 Deputy Sherotski said the following on the IMs, "these boys hitting
hard... they 53 aggd a deputy?? and they aren't sig 7." I asked Deputy Sherotski to describe the
context ofhis statements. He advised the "hitting hard" statement was due to a group of individuals
committing robberies throughout Osceola County. Deputy Sherotski explained the "53 aggd a
deputy" was due to the suspects possibly pointed a gun at other deputies after committing a robbery.
He said the "they aren't sig 7" statement was due to his thought that the deputies should have
responded to a threat of deadly force with deadly force of their own. Deputy Sherotski stated he was
not on scene and was commenting based off of information he received.

I questioned if he was involved in the use of deadly force how these statements would look in a court
setting. Deputy Sherotski stated, "I think it would not look favorable. That they would think that it
was predisposed idea to have something happen in that sort ofsituation instead ofbasing it on the
actions and event therein."

On page 338 of 815 Deputy Sherotski' s concerning statement was "PROB MISSED IT WHILE SHE
WAS ARGUING WITH THE "MIXED RACE" SUSP. "Deputy Sherotski advised the statement was
about a call for service where "mixed race " was in quotations due to it being in the call comments.
He advised normally the race of a suspect is referred to as black or white and the "mixed race"
statement was odd to him.

On pages 414 and 415 of 815 Deputy Sherotski was involved in a conversation about a takedown of
a triple homicide suspect during which he stated, ~~AN EXTRA 2 WEEKS ... OFF "Deputy Sherotski
explained his squad was assisting with a takedown of a triple homicide suspect that was known to be
violent. He advised the context of his statement was if there was an officer involved shooting or a
serious use of force, the deputy would get two weeks off during the investigation.

On page 169 of755 Deputy Sherotski's statement was "I JUST 53AGG THOSE PEOPLE FOR A
66. " He advised this comment was regarding a burglary in progress call and he was the first deputy
on scene. Deputy Sherotski stated while he was waiting for additional deputies he was pointing his
firearm towards the house when two individuals stepped out of the house. He held the individuals at
gun point and took them into custody to investigate the incident. Deputy Sherotski said the call
ended up being a civil dispute and no crime was being committed.

On pages 197 to 199 of755 Deputy Sherotski was involved in a conversation where he said, "I WAS
PLANNING ON EATING CHICK FILA WELL THAT DIDN'T HAPPEN SO I WENT TO TEXAS
ROADHOUSE AND THEY CHARGED ME THE FULL AMOUNTAND I HA VENT BEENABLE TO
EAT IT YET ... YEAH I NORMALLY JUST TIP BIG WHEN THEY DRT BUT THEY HIT ME WITH A

$30 BILL SO TIP BIG I DID NOT." I asked Deputy Sherotski what "DRT" meant. He said "DRT,
means "doing the right thing." He explained "doing the right thing, is when business give you a
discount for being uniformed law enforcement. Deputy Sherotski advised this was not an appropriate
conversation.

Deputy Sherotski explained he does tip his servers no matter what he is charged. However, if a place
gives a discount or does not charge him he tips the amount of the bill.

I questioned if he expects restaurant's to give discounts. Deputy Sherotski answered, "No not at all. ,
I inquired if he only goes to places that give discounts. He said, "No not at all."

Deputy Sherotski agreed to allow Sergeant Moizer to ask him questions. Sergeant Moizer discussed
Deputy Sherotski' s previous work history and asked if a previous employer would have allowed him
to speak about customers the way he did on the IMs. He advised they would not have been happy
about it.

Deputy Sherotski advised he has matured in the three months since these messages were sent.
Sergeant Moizer asked if he matured due to an email sent out by Chief McGinley. He answered,
"No, because honestly when I saw that email I didn't think at all that it applied to me. Um, until I
read these I honestly didn't have any idea why I was here. I understood that there were probably
times where I said things that might not have been acceptable or the agency specifically wouldn 't
like. I'm not saying that specifically that everything that I've said here isn 't things that I specifically
haven 't felt in certain situations. But, I'm just saying it's not smart to say it on the agency
computer. ,

Sergeant Moizer questioned what is going to change moving forward given the lessons learned by
Deputy Sherotski. He replied, "/just think all IMs will just be specifically related to work related
stuff and there wouldn 't be personal items in there. There wouldn 't be opinions, they would be
specifically based on calls or needing assistance for whatever reason. "

I reviewed Deputy Sherotski' s Power DMS signature reports with him in relation to the Standards of
Conduct policy and Agency Computers policy. Deputy Sherotski acknowledged he signed the
documents, indicating receipt, review, and expected compliance, prior to this incident occurring.

I read the Agency Computers Policy 218.0(4)(A)(l)(B) and (H) to Deputy Sherotski.

"(B) Creating, displaying, viewing, retrieving, or transmitting threatening, racist,


sexist, sexually explicit, or suggestive, obscene or harassing language, or materials,
except when done with command level approval for law enforcement purposes such
as covert investigatory operations. (H) Using the email and instant message systems

to create offensive or disruptive messages. Any message containing sexual content,


racial slurs, gender specific comments, or any other comment that offensively
addresses someone 's age, sexual orientation, religious beliefs, national origin, or
disability are considered offensive and subjects the member to progressive
discipline. "

I asked Deputy Sherotski if he felt he violated this policy. He stated, "Yes."

I read the Standards of Conduct Policy 341.0(4)(A)(7) Unbecoming Conduct to Deputy Sherotski.

"Members shall conduct themselves at all times, both on and off duty, in such
manner as to reflect most favorably on the Sheriff's Office. Conduct unbecoming
shall include that which brings the Sheriff's Office into disrepute or reflects discredit
upon the members of the Sheriff's Office, or that which impairs the operation or
efficiency of the Sheriff's Office or members. "

I asked Deputy Sherotski if he felt he violated this policy and to explain his answer. Deputy
Sherotski answered, "Yes sir. Because I don't think the messages that I sent were appropriate and
therefore I wasn't conducting myself to reflect the Sheriff's Office in the best light. "

Deputy Sherotski did not have additional information to add to his statement. His interview
concluded at 1847 hours.

February 4, 2021/1035 Hours

Sergeant Jacqueline Moizer and I met with Deputy David Ruiz-Beltran in the Internal Affairs Office
for the purpose of obtaining his sworn recorded statement regarding this incident. Deputy Ruiz-
Beltran was provided with all the collected materials regarding this incident. Once he advised he
completed his review, Deputy Ruiz-Beltran's sworn interview was conducted. It is summarized
below.

Deputy Ruiz-Beltran has been employed at the Osceola County Sheriffs Office since December of
2015. He is currently assigned to the Patrol Division in the South Sector. Deputy Ruiz-Beltran has
only been assigned to the Patrol Division. Deputy Ruiz-Beltran advised he read the IMs he typed and
sent.

On page 205 of396 Deputy Ruiz-Beltran's concerning statement was "tomorrow, we sucking on that
red neck ofyours. " Deputy Ruiz-Beltran explained the comment was sarcasm between two friends.

On pages 208 and 209 of396 Deputy Ruiz-Beltran was involved in a conversation where a deceased
female's race was being discussed. I asked if it was funny to discuss a deceased individual's race.
Deputy Ruiz-Beltran answered, uNo, it's not. Deceased or alive it doesn't ... it's not right to make fun
ofsomeone 's race. "

On page 217 or 396 Deputy Ruiz-Beltran was involved in a conversation about a female co-worker
(Deputy Kelsey Kaminski). During this conversation Deputy Ruiz-Beltran said, "she putting her
personal cell in there ... oh wow, I love seaworld " I inquired what the context of "oh wow, I love
seaworld" was. He advised, "I have no idea why I even wrote that or where it came up of I have no
explanation for that. "

On pages 221 to 223 of 396 there was a conversation about inviting a female deputy (Deputy Yomari
Martinez) to a party. He advised his squad would go out to eat from time to time and Deputy
Martinez was on his squad in the past. Deputy Ruiz-Beltran said it was only to arrange a time for
them to all get together away from work.

On pages 223 to 225 of 396 there was a conversation which mentioned a runaway female had an
OnlyFans account. During this conversation Deputy Ruiz-Beltran asked if the responsible deputy got
the female's username for her OnlyFans account. OnlyFans is a website where someone can pay
money to see nude photographs somebody posts online.

I asked Deputy Ruiz-Beltran to explain why he asked for the runaway female's OnlyFans username.
He answered, "It was, again, a sense ofsarcasm. Um, something to just brighten up the mood a little
bit. Just trying to make fun of the, ofhis comment at the time. "

On pages 307 and 308 of396 Deputy Ruiz-Beltran and Deputy Dijulio have a conversation about
when he trained Deputy Dijulio. During the conversation Deputy Ruiz-Beltran wrote, "and tell me
how the Indians were awesome in hockey ... then told me you never used a hockey stick cause you
were hung like a horse." Deputy Ruiz-Beltran explained, "Um, I partially believe, or partly
remember this incident. In my car he would always, he used to play hockey up north and on the
hockey team was just Native Americans, it was Indians. And he would always comment on how good
they were in hockey. He always had a whole bunch ofstories and I believe at one time he told me
that he never used a hockey stick because he was hung like a horse. "

I questioned if he was talking about a part of the male anatomy when he said "hung like a horse. "
Deputy Ruiz-Beltran answered, "Yes, I was talking about his male reproductive system. " I clarified
if he was referring to a penis. Deputy Ruiz-Beltran stated, "Yeah."

Deputy Ruiz-Beltran advised it was not appropriate to discuss male or female genitalia on an agency
communication device.

On page 381 of396 Deputy Ruiz-Beltran said, "SAWCON DEEZ NUTZ "I asked him to explain the
meaning of this comment. Deputy Ruiz-Beltran stated, "It's spelled incorrectly but, it basically
means to suck on these nuts. " He advised it was not an appropriate statement to send over the agency
messaging system.

On page 19 of 113 Deputy Ruiz-Beltran said, ~~lol, Kayvi we talk a lot of crap on here. So ifyou
don't wannabe in a !A, leave now. "I inquired what the context of this statement was. Deputy Ruiz-
Beltran answered, "Um, the people in the IM, um, we 're really close so we always talk down to each
other. We always talk crap to each other. Um, and Kayvi I believe he just joined the squad so, we
added him to the group chat. I believe it was the sector 4 group chat. Um, so, I was just giving him
the heads up, 'Hey we joke around with each other a lot. You just might not want to be here ifyou
gonna be in an !A. '"

I questioned Deputy Ruiz-Beltran why he continued to send messages on the 1M even when he
warned another Deputy about possibly getting into an IA due to the messages. He replied, "It was
more ofthe comradery. I mean I've worked with these people for, most ofthem since day one. Um,
so, we were really close. Most ofthe time when I would send these instant messages I wouldn't think
twice. Um, re-reading all this I took a step back. I even chucked because I was like, 'Wow, I can't
even believe I even wrote that. ' Um, so, looking back at it now I mean yes, it was completely wrong.
Um, but, I believe it was just more of in the moment type of thing ofnot thinking before I acted "

I asked ifhe thought anything involving this situation was funny. Deputy Ruiz-Beltran stated, "No, it
was more a sense ofshock type ofchuckle, rather than laughter, thinking it's funny. Just shocked of
what I actually wrote. Most ofit I don't even remember writing or what the topic was. So, that's why
I chuckled, it was more shock. "

On page 20 of 113 Deputy Ruiz-Beltran sent a message that said, "56 and kiss me ifyou think you
tuff" I inquired what the context was regarding this statement. Deputy Ruiz-Beltran advised, "The
person I was messaging, he was a very very close friend, he still is. We've been working together
since day one so, we automatically always dramatic or, um, joking around or just ah, talking like
this. So, it was just more like uh, 'Hey 56 me, ' but then the kiss me part was more ofa joke. "

On pages 84 to 86 of 113 Deputy Ruiz-Beltran was involved in a conversation about vehicle


assignments and he asked another Deputy, "Who you suckin off?" I asked him to explain the context
of this statement. Deputy Ruiz-Beltran explained, ~~It was more ofum, it wasn't a direct question. It
was more, not sarcasm but, um, it was more like, 'Who you hibbing up to, who you, like, sucking up
to or being on the good side ofto get a better car or better equipment?'"

On page 91 of 113 Deputy Ruiz-Beltran said, "he rather sit on it than put it in his mouth." I
questioned if he could provide a context to this statement. Deputy Ruiz-Beltran answered, ~~This was

um, an incident that happened out ofwork. We all were being very dramatic. One ofthe members on
the IM, he was uh, we were playing like a, what ifgame. So, like uh, explaining it is going to sound
weird. Um, so, we basically told him, well would you rather sit on a penis or would you rather put it
in your mouth. He said he would rather sit on it rather than putting it in his mouth. "

Due to the nature of several of Deputy Ruiz-Beltran' s messages I asked if he felt his comments could
be interpreted as making fun of homosexuality. Deputy Ruiz-Beltran replied, "I can see, I can see
how that could be perceived, yes."

I inquired ifhe had any issues with homosexuality. Deputy Ruiz-Beltran stated, "No. Well, I do have
a problem with how I was behaving but with homosexuality, I don 't have a problem with. "

Deputy Ruiz-Beltran agreed to allow Sergeant Moizer to ask him questions.

During this interview, Deputy Ruiz-Beltran was asked to read the messages he sent out loud. He was
asked how he felt when he had to read the messages out loud. Deputy Ruiz-Beltran said,
"Uncomfortable. "

Sergeant Moizer asked how things would change moving forward from this investigation. Deputy
Ruiz-Beltran explained, "Um, since I saw the email that was sent a couple ofmonths ago, again, I
didn 't think it was me. But then, speaking with Young I was like, well I need to stop. Since then IMs
have been strictly work If it is anything personal I stick with it when I'm not working. Urn, and I've
honestly totally just got offIMs in total. "

I reviewed Deputy Ruiz-Beltran' s Power DMS signature reports with him in relation to the Standards
of Conduct policy and Agency Computers policy. Deputy Ruiz-Beltran acknowledged he signed the
documents, indicating receipt, review, and expected compliance, prior to this incident occurring.

I read the Agency Computers Policy 218.0(4)(A)(l)(B) and (H) to Deputy Ruiz-Beltran.

I asked Deputy Ruiz-Beltran if he felt he violated this policy. He stated, Yes. The IMs, they're not

professional. They're leaning towards homosexuality. People couldperceive it looks like I'm against
it or I got an issue with it. "

I read the Standards of Conduct Policy 341.0(4)(A)(7) Unbecoming Conduct to Deputy Ruiz-Beltran.

hears ofit, um, it doesn 't really look good So, then people will start questioning how the Deputies
act and behave. It is just bad representation of the Sheriff's Office. "

Deputy Ruiz-Beltran did not have additional information to add to his statement. His interview
concluded at 1102 hours.

February 23, 2021/1009 Hours

Sergeant Jacqueline Moizer and I met with Deputy Javier Arroyo and his representative, Brian
Cechowski (FOP), in the Internal Affairs Office for the purpose of obtaining his sworn recorded
statement regarding this incident. Deputy Arroyo was provided with all the collected materials
regarding this incident. Once he advised he completed his review, Deputy Arroyo's sworn interview
was conducted. It is summarized below.

Deputy Arroyo has been employed at the Osceola County Sheriff's Office since August of20 15. He
is currently assigned to the Patrol Division in the South Sector. Deputy Arroyo has only been
assigned to the Patrol Division where he also serves as a Field Training Officer (FTO). Deputy
Arroyo advised he read the IMs he typed and sent.

On pages 740 and 741 of 815 Deputy Arroyo was involved in a conversation where he said, "my
recruit dnt f around bro ... slammed David on the hood lol. " He explained he and his recruit, at the
time, located a wanted subject while patrolling. Deputy Arroyo advised, "While my recruit was with
him for a little bit I went to my patrol car. Then as I saw my recruit place him on the car by himself
with no help and then he put the cuffs on him by himself So, that's what this is all about. I guess I

exaggerated I guess I was proud because he didn't need me there with him. He was able to put the
cuffs on him by himselfand everything. "

During a conversation with his squad mates, Deputy Arroyo said, "he 's just my side b ... I just use you
for pleasure. " He advised "b " was short for the word "bitch. " I asked if he could provide a context
to these comments. Deputy Arroyo stated, "Well, me and this other deputy are pretty close friends.
We talk to each other like that. Um, this is basically me saying that he 's one ofmy closest friends on
the squad and that's why we're always together. [ ... ]Obviously something inappropriate the way I
said it, instead ofsaying he 's my buddy. "

On page 790 of 815 Deputy Arroyo's concerning statement was, "I'll show you something fat." I
questioned what he was talking about with this statement. Deputy Arroyo answered, "So, my buddy
basically called me fat and I said, 'I 'II show you something/at. 'I don't say it there but, I'm basically
referring to my penis, as a joke."

Deputy Arroyo was involved in a conversation about the race of a deceased female. I asked if it was
appropriate to discuss a deceased citizen's race or sex in the manner in which he and his zone
partners did. Deputy Arroyo advised, "Absolutely not. "

In one of the messages Deputy Arroyo asks his zone partners, "did he look like as bag?" While he
read it out loud, Deputy Arroyo stated, "I was trying to say, 'Does he look like a shit bag?'" I asked
him to explain the context of this statement. Deputy Arroyo said, "I guess I'm trying to ask about
someone else we were talking about but, I guess it got cut off. I basically was trying to ask if a
person that we were dealing with looked like someone who gets into a lot oftrouble. Like a well-
known criminal or something. That's what I meant by shit bag. "

I inquired if he commonly referred to criminal suspects as "shit bags. " Deputy Arroyo answered,
"Uh, when I'm with someone else alone, I might say something like that. "

I asked if it was appropriate to refer criminal suspects or citizens of Osceola County as the term "shit
bag. " Deputy Arroyo answered, "It is very not. It's not appropriate at all and very unprofessional. "

On page 381 of 396 Deputy Arroyo's comment was, "sawcon deezzz. " I inquired as to the context of
this statement. Deputy Arroyo stated, "The first word, sawcon, I guess it was part ofa joke and then
that was the punch line of the joke. Sawcon deezzz is basically referring to oral sexual act as a
joke. "

Deputy Arroyo had a conversation with Deputy Dijulio about an incident that occurred in 2018. The
two of them discussed video and digital photographic evidence. Deputy Arroyo commented that
Deputy Dijulio still had the video and photographs on his cell phone. I inquired if it was appropriate

for a deputy to have evidence on his cell phone or camera after downloading the images or videos
into evidence. Deputy Arroyo explained it was not appropriate and would be against policy.

On page 6 of 113 there was a conversation, in which Deputy Torres said, "ima send yall a video tell
me what u think. " Deputy Arroyo responds with, "you better be naked in it. " I asked if this
statement was an attempt to be funny. Deputy Arroyo answered, "Yes, we do not send each other
nude photographs of one another or anything like that. "

On page 67 of 113 Deputy Arroyo was involved in a group chat with a new squad member. During
this conversation Deputy Arroyo said, "I'm a one minute man :) ... they don't call me flash for
nothing." I inquired if he could provide context to his comment about being "a one minute man."
Deputy Arroyo replied, "Basically it's a joke of me saying that I last about a minute during, um,
while having sex. So, that's the joke of it. "

On page 72 of 113 Deputy Arroyo's concerning statement was, "chick wasp 'ing me offa Iii. That
why I asked ifyou hadpcfor t15, so I could slap cuffs on her lol." Deputy Arroyo advised this
comment was not appropriate. I asked if he would have used force on this female and the case went
to court, how he would think it would look. Deputy Arroyo stated, "Pretty bad ifthey open this up
and they saw that. 'Probably got into my feelings and took it out on her' or something like that. "

On page 79 of 113 Deputy Arroyo's message was, "damn n. " I inquired as to the context of this
statement and what "n" stood for. Deputy Arroyo explained, "N as in n i g g a, nigga is like a
popular term used in the rap and hip hop music. It's inappropriate basically. Anyone else couldjust
look at that and say, 'Oh no, he meant to say the other one ' without context or anything like that.
Saying the actual racial slur. "

I questioned if he uses this term with his friends. Deputy Arroyo stated, "Yeah, this is only used with
close friends who we talk to one another like that. Obviously, I didn't think hard enough before I
started typing that. {. .. } I would never use it against someone else, as a slur, as a racial slur or
anything. "

On page 96 of 113 Deputy Arroyo said, "smd " I asked if he could explain what the meaning was to
this comment. Deputy Arroyo explained it meant, "Suck my dick." I inquired if he could provide a
context to his statement. Deputy Arroyo advised, "It's basically uh, to brush someone off. Like,
forget you or something like that. Instead I said the smd thing. Obviously again, it's something
between friends, um, with one another and it just made its way onto the !Ms. "

On page 10 of999 there was a conversation where Deputy Arroyo said, "stop sending nudes bro."
This comment was in response to a message between two other deputies who were talking about text
messages. Deputy Arroyo explained, "This was a conversation between two zone partners, one of

them said, ~hey did you get my text?' As /joke I put in, 'stop sending nudes bro 'because it kind offit
their conversation. To make it look like something that it really wasn't. Obviously that wasn't the
case. I was making bad jokes. "

On pages 132 and 133 of 999 Deputy Arroyo was involved in a conversation in which he said,
~~at/east I get to look at Yolanda's alpha." While Deputy Arroyo read the comment out loud he
explained it was referring to the female's ~~behind, her butt." I asked if he felt he was objectifying
this female when he made this comment. Deputy Arroyo answered, Well, looking at something like
H

that, yes. "

On page 345 of999 Deputy Arroyo made the comment, ~~your so gay. "I inquired ifhe could provide
context to this statement. Deputy Arroyo advised, ~~Ah yes, um, I'm basically telling someone that
they're not being cool or acting, behaving annoying. If anyone who is homosexual who would see
this would probably be offended with comments like that. It's something that, I guess has been said
for a long time, like, as like a quote from movies and stuff Obviously we don't say that stuff
anymore."

Deputy Arroyo makes several comments with ~~gay" in them as well as sexual innuendos about
homosexual behavior. I asked if he felt his comments make it appear he has a problem with the gay
community. Deputy Arroyo stated, u Yes it would I mean I absolutely do not. I have no issues with
the gay community. I have friends that are gay. But, obviously ifthose people would see that they
will think something else. "

On page 403 of 999 Deputy Arroyo's concerning statement was, u between bo.ffa and deez. " I
inquired if he could provide a context to this comment. Deputy Arroyo answered, HUh, someone was
asking directions ofwhere somethings at or, actually where Leger's at maybe. Um, and I made the
comment between boffa and deez, which would refer to my genital area, as a joke. "

On page 689 of999 Deputy Arroyo said, ~~racist. "I asked if he could explain this statement. Deputy
Arroyo replied, ~~Basically, uh, making a joke as to a lot ofpeople finding things racist nowadays.
And I made the other comment saying, 'stop appropriating culture ' because he was going to get
Chinese. There has been issued in the media and stuff with people bringing things up about
appropriating culture, like, wearing Chinese outfits or anything like that. That people aren 't
supposed to. So, this was a joke in regards to stuff like that. "

I questioned if Deputy Arroyo could describe the concerns due to the comments he made in his IMs.
He advised, u Uh, unprofessionalism, they can try to say I'm some type of way by reading these
comments. Like you said with the gay community, they may think I have something against them with
the jokes I'm making. It's unprofessional."

Deputy Arroyo agreed to answer question from Sergeant Moizer. Sergeant Moizer and Deputy
Arroyo had a brief discussion about the IMs being public record. Deputy Arroyo understood the
messages were subject to public record requests when he sent them. Sergeant Moizer asked why he
felt comfortable sending the messages when he knew they were subject to the public records
requests. Deputy Arroyo stated, fii never thought it would actually be pulled, um, because all these
message were between friends and I didn't, I never had any ill will against anyone with these
messages. That's why I never thought like, I would ever get looked at with these messages. So, that's
how I saw it. Um, obviously now, it's completely different. I only use it strictly for work related
issues and asking questions about work or, 'hey, want to 56 and help me out with paperwork or want
to go have lunch' stuff/ike that. But, it's embarrassing."

Sergeant Moizer inquired how he was going to address any future questions that may arise from the
public regarding his character based on the messages. Deputy Arroyo answered, fiBy being
completely honest with it all. I feel/ike I was honest with everything. From here on out, just act like
a professional deputy that I'm supposed to be acting and behaving as. Like I said, I never thought
any ofthis stuffwas going to get pulled. I thought it was like private, but obviously it wasn't and I
should have thought more ahead of time because I knew there was still the possibility ofthis stuff
going on the record. And even then that's not even a good excuse because I shouldn't have been
typing any ofthis stuffup anyways in any form. So, the best I can do is be better after today, after all
these messages. "

I reviewed Deputy Arroyo's Power DMS signature reports with him in relation to the Standards of
Conduct policy and Agency Computers policy. Deputy Arroyo acknowledged he signed the
documents, indicating receipt, review, and expected compliance, prior to this incident occurring.

I read the Agency Computers Policy 218.0(4)(A)(l)(B) and (H) to Deputy Arroyo.

u (B) Creating, displaying, viewing, retrieving, or transmitting threatening, racist,

sexist, sexually explicit, or suggestive, obscene or harassing language, or materials,


except when done with command level approval for law enforcement purposes such
as covert investigatory operations. (H) Using the email and instant message systems
to create offensive or disruptive messages. Any message containing sexual content,
racial slurs, gender specific comments, or any other comment that offensively
addresses someone 's age, sexual orientation, religious beliefs, national origin, or
disability are considered offensive and subjects the member to progressive
discipline. "

I asked Deputy Arroyo if he felt he violated this policy. He answered, u Yes. The messages were
unprofessional and they have sexual content in there. Uh, that violates policy. "

I read the Standards of Conduct Policy 341.0(4)(A)(7) Unbecoming Conduct to Deputy Arroyo.

"Members shall conduct themselves at all times, both on and off duty, in such
manner as to reflect most favorably on the Sheriff's Office. Conduct unbecoming
shall include that which brings the Sheriff's Office into disrepute or reflects discredit
upon the members of the Sheriff's Office, or that which impairs the operation or
efficiency of the Sheriff's Office or members. "

I asked if he felt he violated this policy and to explain his answer. Deputy Arroyo stated, "Yes,
again, unprofessional conduct representing the Sheriff's Office. It does not look good. "

Deputy Arroyo did not have additional information to add to his statement. His interview concluded
at 1052 hours.

February 23, 2021/1243 Hours

Sergeant Jacqueline Moizer and I met with Deputy Damian Rodriguez and his representative, Brian
~ Cechowski (FOP), in the Internal Affairs Office for the purpose of obtaining his sworn recorded
statement regarding this incident. Deputy Rodriguez was provided with all the collected materials
regarding this incident. Once he advised he completed his review, Deputy Rodriguez's sworn
interview was conducted. It is summarized below.

Deputy Rodriguez has been employed at the Osceola County Sheriff's Office since May of20 17. He
is currently assigned to the Patrol Division in the South Sector. Deputy Rodriguez has only been
assigned to the Patrol Division where he serves as a Field Training Officer (FTO). Deputy Rodriguez
advised he read the IMs he typed and sent.

On pages 779 to 781 of 815 Deputy Rodriguez was involved in a conversation about a citizen
jogging. During this conversation he made concerning statements which were, "someone should run
behind him see what he does ... officer jogging with civilian ... cnn: white cop chases bm for jogging. "
I asked if he could provide a context to his statements. Deputy Rodriguez stated, "Urn, I don 't
remember this exact moment but, you know, I'm assuming we were talking about somebody who was
jogging in the area and I made a joking reference, you know, ifan officer wasjoggingwith a civilian
CNN would probably twist it as a white cop chasing a black male for jogging. "

Deputy Rodriguez and I had a brief discussion about the way society views law enforcement in a
negative light. I questioned if his comments could make the perception of law enforcement worse,
specifically the perception of himself. Deputy Rodriguez answered, "Yes."

On page 784 of 815 Deputy Rodriguez was participating in a group conversation where he said, "I
thought we were more ... chill before I slap you. " I asked for a context to this conversation. Deputy
Rodriguez advised, "Me and Arroyo, we 're pretty goodfriends and I mean, it probably wasn 't the
best idea to say this over an IM Maybe in person, you know, off-duty. But um, you know, basically
stating, you know our relationship, like I thought we were more and he is justjokingly saying, 'I use
you for pleasure, 'like, itjust, kind oflike our relationship, you know, as friends but, we didn't mean
it to that context. If that makes sense. But, it was very inappropriate and shouldn 't have said that,
especially in a group IM "

On page 788 of 815 Deputy Rodriguez said, "be a real cop n sleep under a tree. "I questioned if this
is what he does during his work shift. Deputy Rodriguez stated, "No, I do not. A real cop does not
sleep under a tree."

On page 790 of 815 Deputy Rodriguez said, "fat n short like a tuna can. " I asked if he could provide
the context to this comment. Deputy Rodriguez answered, "Yeah, we were, obviously that is
referring to a penis. That was my comment. Specifically towards Arroyo. "

I inquired if this statement was meant to be a joke. Deputy Rodriguez stated, "It's just a joking
manner. Like I said, our relationship together which shouldn't have been said on an IM or any
public record or anything like that. "

I asked Deputy Rodriguez to read his comment on page 64 of396. He stated, "He could sad, which
means suck a dick. " I questioned if he could provide a context for this statement. Deputy Rodriguez
answered, "I think I was referring to Tylor Robinson, which he is not in this comment, Leger
mentioned him. I believe that's who I am referring to. I think this is when he had left our squad "

On page 93 of 396 Deputy Rodriguez said, "did u taste it?... rub it on your teeth n gums." I
questioned if this was a conversation about locating narcotics on a suspect. Deputy Rodriguez stated,
"Yes, I was reading this earlier and I was trying to recall exactly what we were talking about. But,
just from reading it, it seem a like we were talking about narcotics. Because she writes about the
ounces. In a joking manner I advised, 'did you taste it and did you rub it on your teeth and gums. '"

I inquired if that is how narcotics are tested. Deputy Rodriguez answered, "No. That is absolutely not
how we test narcotics. "

On pages 125 and 126 of999 Deputy Rodriguez was involved in a conversation about a deputy being
transferred to his squad. During this conversation he said, "I hope not another female. " I questioned
if he had a problem working with female deputies. Deputy Rodriguez answered, "No, there's no
issues with any females working our squad. We've worked with a female on our squad Nothing
against them or anything like that. Again, being funny and it was inappropriate. I have nothing

against any other female Deputies or any female working in this agency. ,

On page 133 of 999 Deputy Rodriguez participated in a conversation, in which, he expressed he was
laughing at a comment from another deputy who mentioned he was going to a call and would be
looking at a female citizens "alpha. " Deputy Rodriguez explained he interpreted the message he
laughed at as the other deputy was going to look at a civilians butt.

I questioned if it is appropriate to objectify females in this manner. Deputy Rodriguez answered, "It
definitely inappropriate. It's not funny, um, that's not how I look at this individual or anything like
that."

I had Deputy Rodriguez read his comment on page 321 of999. He stated, "/put my n, meaning my
nigga. " I inquired if he could put a context on the comment. Deputy Rodriguez stated, "/believe
someone put a 16 meaning like a child abuse or something, like a callfor service. I said 'probably a
supplement', Arroyo said 'sounds like it' and then I put 'my n 'meaning my nigga, like as in, like my
boy. Which obviously is inappropriate to write on an agency computer. I meant it as my boy, like my
friend or whatever, but it could definitely be taken out context and somebody else could look at it
differently. ,

~\ On Page 367 of 999 Deputy Rodriguez said, "MY NIKKA. " I asked if he uses this term to call
somebody his friend. Deputy Rodriguez stated, "Yes, like a friend, you know, I'm a minority. I've
used it growing up, you know, in high school and stuff/ike that. Um, obviously it's inappropriate to
use at work and on an agency computer. I wouldn't ever state that again on an agency computer or
in uniform or anything like that. "

I inquired if he uses it in a derogatory manner. Deputy Rodriguez answered, "No."

On page 328 of 999 his concerning statement was, "yuh 25 living with parents doing nothing for
himself low life. " I questioned if he could provide a context to this comment. Deputy Rodriguez
replied, "I believe we were talking about someone. I don 't know exactly who, it was probably a
civilian. Um, maybe a call for service, somebody that we dealt with and I stated, you know, basically
he was living with his parents and he is 25 doing nothing/or himself As in makingfun ofhimfor not
being on his own at that age. Which is inappropriate and I shouldn't be talking about anybody on
calls for service or any civilians or anything like that. It's disrespectful. It's rude. It's
unprofessional. ,

On pages 369 and 370 of 999 Deputy Rodriguez was in a group chat and said, "56 for a
tangerine ... I'/lfeed u ...feed each other no hands though only lingues ... tomgues* ... tongues*., I
asked if he could explain this conversation. Deputy Rodriguez stated, "It's definitely inappropriate.
Like I said, me and Arroyo have a pretty good relationship and I always carry extra tangerines in my

lunch box. Throughout the day we'll meet up and, you know, I'll give him one. I meant it as a joking
manner. You know, to feed each other no hands and only tongues. Obviously it was inappropriate
and unprofessional. "

Based on Deputy Rodriguez writing several messages with sexual innuendoes of a homosexual
nature, I asked if he had any issues with the homosexual community. Deputy Rodriguez answered,
uNo I do not."

On page 398 of999 Deputy Rodriguez said, ufor smashing A's girl on the clock "Deputy Rodriguez
explained, HThat was a joke. I've never done that, especially on the clock or anything like that. It
was just inappropriate. "

Deputy Rodriguez advised Hsmashin" meant having sex. I asked if he ever taken part in any sexual
activity while on-duty. Deputy Rodriguez stated, HThat's never happened before. It was said in a
joking manner. Um, which should have never been said It was inappropriate towards Arroyo and
his wife."

On pages 410 and 411 of 999 Deputy Rodriguez has a conversation with one other deputy about an
off-duty detail. During the conversation he tells the other deputy to work a specific area of the detail
because a business in that area of the detail gives the deputies free food. I inquired if he only works
the details to get the free food. Deputy Rodriguez answered, uNo."

On page 606 of999 Deputy Rodriguez sends some messages in Spanish to another Deputy. I asked
him to translate his messages. He stated, HI honestly don't speak a lot of Spanish. It's just small
words that I know that are inappropriate. I put, 'Que Ia que hay Maricon!' It means from my ... it
means like what's up and then referring to like a homosexual, like you know, gay. That's what
Maricon means.[... } The next one says, 'Damelo duro pato.' Which means, again referring, uh, it
basically says give it to me hard and referring to a homosexual. "

On page 674 of999 Deputy Rodriguez said, Hmight run into a sig 3 at your crib. "Deputy Rodriguez
explained, "I believe I was referring to Leger because he responded right before that, 'don't run into
anymore signal 4s. ' Meaning don 't run into anymore car accidents and I put, 'I might run into a
signal 3 at your crib. 'Meaning, signal 3 means hit and run referring to his girl in a sexual manner.
Which is inappropriate. "

On page 696 of999 Deputy Rodriguez said, looked like a pos. "He advised Hpos" means upiece of
shit." I inquired ifhe was talking about a citizen in this comment. Deputy Rodriguez stated, uYes, I
believe we were referring to the citizen on the call. That's not how we talk about citizens. I shouldn't
have said that. It's inappropriate and obviously ifsomeone else is to read this they would take it out
of context. "

On pages 726 and 728 of 999 Deputy Rodriguez made several inappropriate statements about
Poinciana such as, "Poinci-tard, Poinciana is where u go when u die and heaven doesn't accept you,
and Poinciana is like a Hispanic female, sometime she's good, crazy, or wants toFu up. " I asked if
it was appropriate to talk about the community he patrolled in the negative manner as he did. Deputy
Rodriguez advised, "It's not, it's definitely inappropriate. I don't think about Poinciana like that or
anywhere I patrol. "

Deputy Rodriguez agreed to answer questions from Sergeant Moizer. Sergeant Moizer questioned
how he was going to explain the messages if asked in the future. Deputy Rodriguez stated, "I mean,
this was definitely a mistake. This is something that I would never do again. Like reading everything,
I realized how it can be taken out ofcontext and it's actually embarrassing, you know, like reading it
and telling you what I mean by everything. Um, you know, I wish I could take everything back. It was
definitely inappropriate, unprofessional. I would never do anything like this again. Movingforward,
I would definitely train new recruits and tell them, 'Hey this is, everything that you state on your
agency phone, computer, IMs, whatever it is it's all subject to public record and anybody can get
ahold of it. 'And then, 'You don't want to make a mistake and then be in an !A and have to explain
yourselffor everything. ' Um, I would never do this again moving forward. I definitely learned my
lesson and obviously reading everything is kind ofputs it in light for me, you know, to see just how
unprofessional everything is. "

I reviewed Deputy Rodriguez's Power DMS signature reports with him in relation to the Standards
of Conduct policy and Agency Computers policy. Deputy Rodriguez acknowledged he signed the
documents, indicating receipt, review, and expected compliance, prior to this incident occurring.

Cechowski (FOP), in the Internal Affairs Office for the purpose of obtaining his sworn recorded
statement regarding this incident. Deputy Torres was provided with all the collected materials
regarding this incident. Once he advised he completed his review, Deputy Torres's sworn interview
was conducted. It is summarized below.

Deputy Torres has been employed at the Osceola County Sheriffs Office since December of 2015.
He is currently assigned to the Patrol Division in the West Sector. Deputy Torres has only been
assigned to the Patrol Division where he previously served as a Field Training Officer (FTO). Deputy
Torres advised he read the IMs he typed and sent.

On pages 217 of 396 Deputy Torres was sending messages about a female deputy, Deputy Kelsey
Kaminski, using his cell phone. One of his messages said, "taking nudist selfies. " I inquired if he
could provide a context to his message. Deputy Torres stated, "To be humorous. She was on a phone
call with Detective Mintz. So, just to lighten up the mood. "

I explained to Deputy Torres that Deputy Kaminski will be informed of his statement and asked him
what he thought her reaction is going to be. Deputy Torres answered, "Uh, embarrassed and upset. "

On pages 221 and 222 of 396 Deputy Torres was involved in a conversation where a party was being
planned. During which it was discussed to invite two female deputies, one of which was in a

relationship. Deputy Torres sent a message saying, "she got a bfnow ... /'ll break em up tho., He
explained it was just "playful banter, and he was not trying to ruin a relationship.

On page 19 of 113 there was a group chat in which Deputy Ruiz-Beltran wrote, "lol, Kayvi we talk a
lot ofcrap on here. So ifyou don't wannabe in a /A, leave now. , Deputy Torres responded, uNAW
F THAT STAY." Deputy Torres explained, "My intention wasn't to get anyone in trouble or to be in
this predicament. It was more of, we just talk nonsense on the group chat so, just stay and hang out
with us essentially. ,

On page 37 of 113 Deputy Torres said, "we'll receive ya with his 3'd leg., I asked what the context
of this comment was. Deputy Torres answered, "From what I gather from this, that we would
receive another Deputy as one of our own. I'm not sure why I said third leg because it's not even
accurate. ,

Deputy Torres and I briefly discussed the importance of context when it came to his IMs. I explained
I perceived his message about a "3'd leg" was referring to a penis. I asked if my perception of his
statement was accurate. Deputy Torres stated, "Yes, it's what it looks like. Humorous, just being
childish. "

On pages 84 and 85 of 113 Deputy Torres was having a conversation with another deputy about how
his patrol car was detailed while being repaired. Deputy Torres was asked, "Who you suckin off?"
His response to this question was "John Holl Sr., I question if he was attempting to be funny with
his response. Deputy Torres stated, "Yes it was, because I spoke to John Holl Sr about getting my
car fixed and he 's the one that helped me get it detailed when I got the car. I have no relationship
with him or anything like that. ,

On page 90 of 113 Deputy Torres was involved in a group chat in which he said, "good thing uve
been using those knee pads with Marcos Lopez. , I inquired what he meant by this statement. Deputy
Torres replied, "Arroyo was doing kitchen remodel at his house. He went to Home Depot and he
bought knee pads. As he was leaving Marcos Lopez was there trying to get popularity with the
civilians. He stayed there talking to him for a little while so, that's just where the reference comes
into play. ,

On page 91 of 113 Deputy Torres said, "Arroyo has that double hand twist gawk combo 3000 going
on., I asked if he could provide a context to his statements. Deputy Torres answered, "/t'sfrom a
viral, like, TikTok Instagram video ofpeople messing around about doing sexual favors for other
people."

Due to the last two messages being involved in the same conversation I asked Deputy Torres ifboth
messages were referencing sexual innuendoes. Deputy Torres stated, "Yes, your interpretation, yes. ,

Deputy Torres explained he was being facetious when making the statement in his messages. He
advised he does not think it is appropriate to make statements which could be perceived as making
fun of the gay community.

I reviewed Deputy Torres's Power DMS signature reports with him in relation to the Standards of
Conduct policy and Agency Computers policy. Deputy Torres acknowledged he signed the
documents, indicating receipt, review, and expected compliance, prior to this incident occurring.

I asked if he felt he violated this policy and to explain his answer. Deputy Torres stated, "Yes,
because I didn't hold myself to a professional standard for the agency. I embarrassed the agency
and myself That's pretty much it."

I asked if he had anything he wanted to add to his statement. Deputy Torres stated, "I'mjust, sorry
for embarrassing the agency and for embarrassing myself "

Deputy Torres did not have additional information to add to his statement. His interview concluded
at 1011 hours.

Brian Cechowski (FOP), in the Internal Affairs Office for the purpose of obtaining his sworn
recorded statement regarding this incident. Deputy Leger-Diaz was provided with all the collected
materials regarding this incident. Once he advised he completed his review, Deputy Leger-Diaz's
sworn interview was conducted. It is summarized below.

Deputy Leger-Diaz has been employed at the Osceola County Sheriffs Office since January of2018.
He is currently assigned as a School Resource Officer. He was previously assigned to the Patrol
Division in the South Sector. Deputy Leger-Diaz advised he read the IMs he typed and sent.

On page 762 of 815 Deputy Leger-Diaz said, "she had big tangos. " I inquired what he meant when
he wrote "tangos. " Deputy Leger-Diaz stated, "Ah, tangos is just a filler word for titties. " He
explained he wrote this message referring to a female citizen that "had big breasts."

I asked if this was an appropriate way to talk about or describe a female citizen. Deputy Leger-Diaz
advised it was not.

On pages 779 to 781 of 815 Deputy Leger-Diaz was involved in a conversation about a citizen
jogging. This conversation was in reference to a black male that called the Sheriffs Office to advise
he was going for a jog. During the discussion Deputy Leger-Diaz expressed he was laughing at the
other comments by sending "lol" in the messages.

I inquired if he felt the conversation was funny at the time he sent his message. Deputy Leger-Diaz
stated, "Yes, sir I did" I asked if he felt it was funny looking back at it. Deputy Leger-Diaz
answered, "No, sir. It doesn't look good "

I asked him to explain why the conversation does not look good. Deputy Leger-Diaz replied,
~~Because, based on reading it and understanding it now, it brings up a sensitive matter ofrace."

On pages 64 to 66 of396 Deputy Leger-Diaz was in a group message where another Deputy wrote,
"he could SAD." Deputy Leger-Diaz responded, "spell it out long for me." He continued making
inappropriate comments such as, "bring the KY. "

I questioned what the context was for the "spell it out long for me" messages. Deputy Leger-Diaz
advised, "So, based on my personal relationship with this deputy and reading what I said, um, that
the suck a dick, !jokingly replied and said, 'spell it out long for me.'"

I inquired about the context for the "bring the KY" comment. Deputy Leger-Diaz answered, "Uh,
KY is like a jelly, KY Jelly, and it was reference, uh, when I said 't6 t1 00 sso 't1 00 is to go pee. [ ... ]
I made a joke to Deputy Rodriguez, 'come with me too and bring the KY Jelly. ' Making an
inappropriate joke. "

On page 138 of 396 Deputy Leger-Diaz said, "13q (Quebec) roommates stated he 45 'd them. " I
asked what he meant by "13q." Deputy Leger-Diaz stated, "It means someone that, ah, likes the
same sex. In this instance someone was homosexual. "

Deputy Leger-Diaz explained this comment was in reference to a call for service where two
roommates were sexually intimate with each other. He advised he wrote "13q" because the citizens
on the call told him they were homosexual.

I asked if "13q" was an appropriate term to refer to someone's sexuality. Deputy Leger-Diaz
answered, "Yes, yes it can be." I inquired as to where it would be appropriate. He stated, "As far as
when !first started out in patrol I learned that 13q means someone that is homosexual or gay. That's
how I learned that. Such as other jargon like 10-100, 10-200 which is going to the bathroom."

I clarified he was trained to use the term "13q" when referring to someone that is gay. Deputy Leger-
Diaz advised, "Right. I didn't mean as anything like, makingfun oftheir sexuality or anything. !just
stated, responded to his message, I stated, 'Hey, it was two homosexual males and the roommate
stated that he was battered. '"

I asked Deputy Leger-Diaz to read his comment on page 278 of396. He stated, "56 or meet up and
catch deez hands then. Catch is pretty much to fight. " I questioned if he had an anger issue or any
problems with his zone partners which would make him want to fight his co-workers. Deputy Leger-
Diaz answered, "No I do not. " He explained he made the comment in response to comments made
by his zone partners which were all in a joking manner.

On pages 125 and 126 of999 Deputy Leger-Diaz was involved in a conversation about a Deputy
being transferred to his squad. During this conversation he asked, "A s3 or nah?" Deputy Arroyo
said in the messages that Deputy Kelsey Kaminski (KK) was the Deputy being transferred to the
squad. In response to what Deputy Arroyo wrote, Deputy Leger-Diaz stated, "2 drinks and I would
s3."

I inquired as to the context of "s3" in his statements. Deputy Leger-Diaz advised, "In this context it
would mean someone who you would think is attractive and you want to have sexual relations with. "

I asked Deputy Leger-Diaz to read the "2 drinks" comment. He stated, "2 drinks and I would signal
3 or have sexual relations with that person. "

I questioned what he thought Deputy Kaminski would think if she knew about this statement. Deputy
Leger-Diaz answered, "Very unhappy or disrespected or uncomfortable."

On page 143 of999 Deputy Leger-Diaz said, "I'm going to f up cypress woods today. "He explained
the meaning of 'f" is 'fuck." I asked Deputy Leger-Diaz to put a context on this statement. He
advised, "That issue always has issues with parking and I always have given out a lot ofparking
violations. So, every time I go to the community in the morning there is a lot of violations and I
would cite a whole bunch of cars. That's what it meant by saying, 'I would fuck up cypress woods
today.'"

On page 328 of 999 Deputy Leger-Diaz' s concerning comment was, "tht guy deserve to be smacked
rude af" I inquired as to the context of this statement. Deputy Leger-Diaz stated, "It was a verbal
between a mother and a 26 year old son and her son was just being uncooperative and yelling
obscenities to myselfand other deputies on that call. "

I questioned if he "smacks" people when they are rude to him. Deputy Leger-Diaz answered, "No. "

On page 355 of999 Deputy Leger-Diaz said, "racist." He explained this was a response to one of
his zone partners not waving at him when they passed each other in their patrol vehicles. Deputy
Leger-Diaz described his patrol car has dark tinted windows and his zone partner said he didn't see
Deputy Leger-Diaz. He advised his statement was meant as a joke and he does not think any ofhis
zone partners are racist.

On page 401 of 999 Deputy Leger-Diaz said, "I use my sexy no jutsu to squash calls." I inquired
what "sexy no jutsu" was. Deputy Leger-Diaz stated, "Are you familiar with the cartoon Naruto?
It's like a ninja show and they use super powers and all that. Like Arroyo, Javier said, 'I use my
sharingan to dodge reports. 'It's just techniques, that's just one ofthe techniques in the show where
someone can transform to like, ah, someone else. Like a beautiful person. "

I asked Deputy Leger-Diaz what he meant by "squash calls. " He answered, "Just getting out ofa
report." I questioned what type of calls he "squashed." Deputy Leger-Diaz advised, "Mainly like
um, property damage and burglary to a conveyance. "

On page 503 of 999 Deputy Leger-Diaz is involved in a group chat discussing the ticket printer
software and he said, "program is called brazzers ... brazzos *. " He explained "brazzers" is a
pornographic website. I asked why he told a zone partner to get a pornographic website downloaded
to an agency computer. Deputy Leger-Diaz replied, ~~My concept behind it was that the two are
similar and I thought that it was kind ofhilarious. "

On page 602 of 999 Deputy Leger-Diaz said, "chill out cops are not supposed to have fun. " I

inquired as to the context of this statement. Deputy Leger-Diaz stated, "I was trying to say that you
guys have to be serious. A serious demeanor and notjoke around. That was my demeanor about it. "

On page 606 of999 Deputy Leger-Diaz sends some messages in Spanish to another Deputy. I asked
him to translate his messages. He stated, "I said, 'hoye carbon te voy a dar un beso. ' Um, carbon is
one ofthose words that is hard to translate because um, carbon basically comes from, it's usually
used from Puerto Rican descent and depending on how you use it. Like 'Oh hey carbon come over
here 'like, buddy come over here. Or it can be used bad like 'oye tone cab ron 'you know, cabron can
be like, 'hey you freaking fuck boy' and all that. It can go that way depending on how you use it. "

I questioned how he was using it. Deputy Leger-Diaz advised, HI was using it like um, jokingly
matter, like, 'hey come give me a kiss. '"

The next comment in Spanish was, Ho suave vatos." Deputy Leger-Diaz explained, HHere I'm
saying oh smooth and vatos. This must have been a typo because I don't even know what the
meaning of that word is. "

I asked Deputy Leger-Diaz if he could read the comment from Deputy Rodriguez which he was
replying to. He translated Deputy Rodriguez's statement of HDamelo duro pato" to mean "He said
Damelo duro pato, translating is like, give it to me hard Um, pato is Spanish and can be translated
as like, someone is gay. And I replied by saying, oh give it to me like soft. "

On page 722 f 999 there was a group chat occurring where Deputy Arroyo asked someone what they
wanted to eat. I questioned what Deputy Leger-Diaz's response was. He stated, "Your delta. That
was an abbreviation for ah, your dick ... I just thought I would put humor into that conversation."

On page 770 of999 Deputy Leger-Diaz said, "Carlos getting a sex change. "He explained Carlos is
an Osceola County Sheriffs Office deputy. I asked why he made this comment. Deputy Leger-Diaz
advised, HBecause he always, he always has back problems and he is always out a lot. So, I made, in
the context, ajoke 'Oh he's probably out that long cause he is getting a sex change. 'To explain why
he is offa lot. " He described this was not an appropriate statement to make.

Based on several comments made by Deputy Leger-Diaz referencing homosexual innuendoes I asked
ifhe was making fun of the gay community. He explained he was not making fun of and does not
have a problem with the gay community.

Deputy Leger-Diaz agreed to answer question from Sergeant Moizer. Sergeant Moizer asked how he
would address any issues that might arise in the future regarding the perception of the IMs he sent.
Deputy Leger-Diaz stated, "I'd have to explain to that person that at the time what my intent was.
Which was to incite humor on the squad to help alleviate the stresses ofah, shift work. "

I reviewed Deputy Leger-Diaz' s Power DMS signature reports with him in relation to the Standards
of Conduct policy and Agency Computers policy. Deputy Leger-Diaz acknowledged he signed the
documents, indicating receipt, review, and expected compliance, prior to this incident occurring.

I read the Agency Computers Policy 218.0(4)(A)(1)(B) and (H) to Deputy Leger-Diaz.

"(B) Creating, displaying, viewing, retrieving, or transmitting threatening, racist,


sexist, sexually explicit, or suggestive, obscene or harassing language, or materials,
except when done with command level approval for law enforcement purposes such
as covert investigatory operations. (H) Using the email and instant message systems
to create offensive or disruptive messages. Any message containing sexual content,
racial slurs, gender specific comments, or any other comment that offensively
addresses someone 's age, sexual orientation, religious beliefs, national origin, or
disability are considered offensive and subjects the member to progressive
discipline. "

I asked Deputy Leger-Diaz if he felt he violated this policy. He answered, "Yes sir, because like how
the policy was stating, I made some jokes about another female and my intent what I wrote down
was sexually."

I read the Standards of Conduct Policy 341.0(4)(A)(7) Unbecoming Conduct to Deputy Leger-Diaz.

"Members shall conduct themselves at all times, both on and off duty, in such
manner as to reflect most favorably on the Sheriff's Office. Conduct unbecoming
shall include that which brings the Sheriff's Office into disrepute or reflects discredit
upon the members of the Sheriff's Office, or that which impairs the operation or
efficiency of the Sheriff's Office or members. "

I asked if he felt he violated this policy and to explain his answer. Deputy Leger-Diaz stated, "Yes
sir, because I had comments in there about sexual innuendoes, curse words, brought up things about
homosexuality and race, which wouldn't be seen as professional in nature. "

Deputy Leger-Diaz did not have additional information to add to his statement. His interview
concluded at 1542 hours.

March 10, 2021 I 1904 Hours

Sergeant Jacqueline Moizer and I met with Deputy Miguel Irizarry and his representative, Brian

Cechowski (FOP), in the Internal Affairs Office for the purpose of obtaining his sworn recorded
statement regarding this incident. Deputy Irizarry was provided with all the collected materials
regarding this incident. Once he advised he completed his review, Deputy Irizarry's sworn interview
was conducted. It is summarized below.

Deputy Irizarry has been employed at the Osceola County Sheriffs Office since January of20 18. He
is currently assigned to the Patrol Division in the West Sector. Deputy Irizarry has only been
assigned to the Patrol Division. Deputy Irizarry advised he read the IMs he typed and sent.

On pages 8 and 9 of 815 Deputy Irizarry was involved in a conversation regarding a person speeding
and he said, "HE RICAN?" He explained his comment was a question asking if the driver was
Puerto Rican. I asked Deputy Irizarry what the context of his statement was. He advised, "Um, due
to over the course of the years seeing that mostly, you know, Puerto Ricans are the ones that are
causing, you know, driving aggressively causing traffic infractions. Pretty much, you know, the ones
that are pretty much speeding in our county from what I see. Being Puerto Rican myself um,
knowing, I've seen also from the island as well how they act. ,,

I inquired if Deputy Irizarry felt his answer could be considered stereotyping drivers based on race.
He stated, "It could be considered stereotyping but, I mean for me I was just asking, you know, due
to the area being predominately Puerto Rican and then my time as patrol being contact with Puerto
Ricans driving aggressively and all that. "

I questioned if law enforcement officers are supposed to participate in stereotyping or bias based
profiling of individuals. Deputy Irizarry answered, "No. " Deputy Irizarry understood his statement
was not appropriate and he does not participate in any kind of stereotyping of individuals.

In Deputy Irizarry's IMs he states "catch these hands,, on several occasions. He explained this was
something he says amongst his friends about fighting one another. Deputy Irizarry advised he does
not have an anger problem and would not fight any of his friends or co-workers.

On pages 86 to 89 of 815 Deputy Irizarry is involved in a group chat about a female he just contacted
on a traffic stop. A Deputy involved in the conversation said the female must have been "t8. ,,
Deputy Irizarry explained, "T8 pretty much in cop jargon is, ah, she must have been attractive. ,,
During the conversation, Deputy Irizarry specifically said, "BLONDE HAIR, TIGHT DRESS ... U
WONT MISS HER. ,, I asked if it was appropriate to talk about any citizen in this manner. Deputy
Irizarry advised, "No sir. "

On page 120 of 815 Deputy Irizarry said, "these chick here on this 25 kinda t8 lol. " I inquired as to
the context of this statement. Deputy Irizarry answered, "Pretty much saying that the girls on the 25,
a signal code for a fire, um t8 is obviously in service but we use it in cop jargon as attractive. So, it's

saying that the girls were attractive. "

On pages 122 and 123 of 815 Deputy Irizarry is involved in a conversation about the use of the
Precision Immobilization Technique (PIT) bumpers. During this conversation Deputy Dijulio said,
HWE GONNA GET ROWDY WITH THIS NEW PIT BUMPER OR WHAT." Deputy Irizarry
responded, HPOLICY SAYS OTHERWISE LMAO." Deputy Irizarry explained he understood the
policy and the PIT technique was not to be used on just anybody.

However, Deputy Irizarry said, HJUST START PITTING PEOPLE FOR NO REASON LMAO."
Deputy Irizarry explained he did not think it would be funny to PIT people for no reason nor would
he do it.

On page 356 of 815 Deputy Irizarry asked another Deputy what they ate, to which the Deputy said,
Hwalnut hidden in a protein bar." Deputy Irizarry responded, HSO SAFE TO SAY HDEEZ NUTZ"
LMAO." I asked for the context of this comment. Deputy Irizarry stated, "Pretty much, it's like a
meme that goes around, um, that said that quote. Due to the previous Deputy saying that it was a
walnut, which is a nut, I pretty much said these nuts. "He explained "DEEZ NUTZ" means genitalia.

On page 22 and 23 of 755 a group chat was had where Deputy Irizarry said he was going to be a
back-up officer on a call and multiple employees referred to Deputy Irizarry as "perv. "I explained to
Deputy Irizarry that I perceived this context of the conversation as he was going to a specific call for
service due to females being involved. Deputy Irizarry understood how someone could reach the
same conclusion as the one I described.

On pages 96 to 108 of 755 Deputy Irizarry is involved in a group conversation about the
attractiveness of female celebrities. I inquired if the content of the messages would lead someone to
believe they were objectifying females. Deputy Irizarry answered, HYes sir."

During this conversation he specifically said, "SHE GOT DSL. " I asked what this comment meant.
Deputy Irizarry stated, "It's a slang term meaning dick sucking lips. "He explained he was referring
to one of the celebrities being talked about.

On pages 694 to 654 of755 Deputy Irizarry participated in a conversation about the Arabic language.
He makes a comment about someone speaking Arabic with a Puerto Rican accent and laughed at it.
Deputy Irizarry explained this was not an appropriate statement to make.

I reviewed Deputy Irizarry's Power DMS signature reports with him in relation to the Standards of
Conduct policy and Agency Computers policy. Deputy Irizarry acknowledged he signed the
documents, indicating receipt, review, and expected compliance, prior to this incident occurring.

comments due to the women, in reference to the women as well as the language comment as well. "

I read the Standards of Conduct Policy 341.0(4)(A)(7) Unbecoming Conduct to Deputy Irizarry.

"Members shall conduct themselves at all times, both on and off duty, in such
manner as to reflect most favorably on the Sheriff's Office. Conduct unbecoming
shall include that which brings the Sheriff's Office into disrepute or reflects discredit
upon the members of the Sheriff's Office, or that which impairs the operation or
efficiency ofthe Sheriff's Office or members. "

I asked if he felt he violated this policy and to explain his answer. Deputy Irizarry stated, "Yes sir.
Due to, like I said prior, with the women comment. To find them attractive while on-duty. That's not
being professional as well as using someone 's language as humor which is not professional in the
Sheriff's Office at all. "

Deputy Leger-Diaz did not have additional information to add to his statement. His interview
concluded at 1933 hours.

Additional Information

On February 8, 2021, Deputy Michael Dijulio' s employment was terminated due to an unrelated
Internal Affairs Investigation. Due to this fact, Deputy Dijulio was not interviewed regarding the
content of his IMs.

FINDINGS:

1. On September 30, 2020, I was reviewing instant messages (IMs) due to a separate unrelated
incident. The IMs were dated from August 2 to October 1, 2020.

2. The content of the messages ranged from work related topics to non-work related topics,
which were not appropriate to be discussed through the agency instant messaging system.

3. The deputies who sent the messages are Javier Arroyo, Damian Rodriguez, David Ruiz-
Beltran, Michael Dijulio, Cristian Torres, Rhandall Leger-Diaz, Michael Sherotski, and
Miguel Irizarry.

4. Deputy Sherotski made comments about using deadly force and being upset about not getting
a discount on food.

5. During his interview, Deputy Sherotski advised he does not expect discounts from
restaurants and always gives tips to servers. He explained his comment about using deadly
force was inappropriate due to him not being on scene and was not aware of all the facts.

6. When asked ifhe violated the Standard of Conduct Policy 341.0(4)(A)(7), Deputy Sherotski
stated, u Yes sir. Because I don't think the messages that I sent were appropriate and
therefore I wasn't conducting myself to reflect the Sheriff's Office in the best light. "

7. Deputy Ruiz-Beltran's comments were sexually explicit and could be interpreted as offensive
towards the gay community.

8. Deputy Ruiz-Beltran explained his comments were not appropriate and they were meant to
be humorous statement between him and his zone partners.

9. When asked if he violated the Standard of Conduct Policy 341.0(4)(A)(7), Deputy Ruiz-
Beltran stated, ~~Yes. Um, I'm representing the Sheriff's Office so, when someone sees this or
hears of it, um, it doesn 't really look good So, then people will start questioning how the
Deputies act and behave. It is just bad representation ofthe Sheriff's Office. "

10. Deputy Arroyo made comments which were sexually explicit, sexually suggestive, offensive
towards the gay community, and racially insensitive.

11. Deputy Arroyo explained the comments which were sexual in nature were to be taken as
jokes. He advised the comments which were racially insensitive were meant as a term said
between friends and not as a slur or in a derogatory manner.

12. When asked if he violated the Standard of Conduct Policy 341.0(4)(A)(7), Deputy Arroyo
stated, "Yes, again, unprofessional conduct representing the Sheriff's Office. It does not look
good"

13. Deputy Rodriguez made comments which were sexually explicit, sexually suggestive,
potentially offensive towards the gay community, and racially insensitive.

14. Deputy Rodriguez explained the comments which were sexual in nature were to be taken as
jokes. He advised the comments which were racially insensitive were meant as a term said
between friends and not as a slur or in a derogatory manner.

15. When asked if he violated the Standard of Conduct Policy 341.0(4 )(A)(7), Deputy Rodriguez
stated, "Yes. Same reason as before. Just unprofessionalism and how I used the !Ms to, you
know, state unprofessional behavior and stuff/ike that in messages. Um, !fee/like I violated
that policy. "

16. Deputy Torres made comments which were sexually suggestive and could be perceived as
making fun of the gay community.

17. Deputy Torres explained his comments were made to be humorous and in no way did he
intend to be offensive towards anybody.

18. When asked if he violated the Standard of Conduct Policy 341.0(4)(A)(7), Deputy Torres
stated, "Yes, because I didn't hold myself to a professional standard for the agency. I
embarrassed the agency and myself That's pretty much it. "

19. Deputy Leger-Diaz's comments were sexually explicit, racially insensitive, and offensive
towards the gay community.

20. Deputy Leger-Diaz advised he was not serious when he wrote the messages. He said his
intent was, "To incite humor on the squad to help alleviate the stresses ofah, shift work "

21. When asked if he violated the Standard of Conduct Policy 341.0(4)(A)(7), Deputy Leger-
Diaz stated, "Yes sir, because I had comments in there about sexual innuendoes, curse
words, brought up things about homosexuality and race, which wouldn't be seen as
professional in nature. "

22. Deputy Irizarry made comments which were insensitive towards females and racially
insensitive.

23. Deputy Irizarry advised his comments were inappropriate and would not happen again.

24. When asked if he violated the Standard of Conduct Policy 341.0(4)(A)(7), Deputy Irizarry
stated, "Yes sir. Due to, like I said prior, with the women comment. To find them attractive
while on-duty. That's not being professional as well as using someone 's language as humor
which is not professional in the Sheriff's Office at all. "

25. Deputy Dijulio's comments were sexist, offensive and inappropriate to be sent through the
agency instant messaging system. He was unable to be interviewed due to being terminated
on February 8, 2021.

CONCLUSION:

The conclusions of this investigation are based on a Preponderance of Evidence established during
this investigation. A Preponderance of Evidence is evidence which is of greater weight, or more
convincing than the evidence which is offered in opposition to it. The alleged policy violations are
considered closed as follows:

As to Deputy Michael Sherotski:

Standards of Conduct 341.0(4)(A)(l)- Unbecoming Conduct: SUSTAINED

"Members shall conduct themselves at all times, both on and off duty, in such
manner as to reflect most favorably on the Sheriff's Office. Conduct unbecoming
shall include that which brings the Sheriff's Office into disrepute or reflects discredit
upon the members of the Sheriff's Office, or that which impairs the operation or
efficiency of the Sheriff's Office or members. "

To wit:

Deputy Michael Sherotski sent inappropriate instant messages using an agency computer messaging
system. The messages included references to excessive force and being upset about a restaurant not
giving him a discount on his food. The comments made by Deputy Sherotski bring the Sheriff's
Office into disrepute and does not reflect most favorably on the agency.

As to Deputy David Ruiz-Beltran:

Standards of Conduct 341.0(4)(A)(l)- Unbecoming Conduct: SUSTAINED

"Members shall conduct themselves at all times, both on and off duty, in such

To wit:

Deputy David Ruiz-Beltran sent inappropriate instant messages using an agency computer messaging
system. The messages included sexually explicit statements as well as comments that could be
offensive towards the gay community. The comments made by Deputy Ruiz-Beltran bring the
Sheriffs Office into disrepute and does not reflect most favorably on the agency.

As to Deputy Javier Arroyo:

Standards of Conduct 341.0(4)(A)(l)- Unbecoming Conduct: SUSTAINED

((Members shall conduct themselves at all times, both on and off duty, in such
manner as to reflect most favorably on the Sheriff's Office. Conduct unbecoming
shall include that which brings the Sheriff's Office into disrepute or reflects discredit

On October I, 2020, an internal investigation was initiated into your conduct regarding incidents of inappropriate instant messagi ng utilizing
the instant messaging platform on your agency computer. The investigation revealed the following:

I. You sent inappropriate instant messages using an agency computer messaging system that were deemed to be reflective of unbecoming
conduct of a sherifrs office employee.
2. Your comments were sexually explicit, racially insensitive, and offensive to the LGBTQ community.
3. While you stated that your comments were made in a joking manner and not intended to insult, demean or otherwise degrade any particular
individual or group, they were inappropriate and unprofessional and reflect poorly on you and the Osceola County Sherifrs Office.

This 24 hour suspension is based on this internal investigation's findings of violation ofOCSO Policy a nd Procedure 341.0 (4)(A)(7). Any
further violations of this policy will result in progressive discipline.
