Rekha sharma (complainant) got married with Pawan kumar

24/04/2008 Vishwakarma (opposition party) in her father’s house.


Rekha sharma’s family gifted jewerly, clothes, pulser bike, bed,
sofa set and golden ring with household goods.
She mentioned in her complaint that opposition party’s family
was greedy and start taunting for not coming with dowry.
She mentioned in her complaint that opposition’s party
demanded the 50000 rupees and 3 golden rings and threatened
to expel from house if her family does not fulfil their demand.
She mentioned in her complaint that she did cooked meal for
entire family and did not get food to feed herself.
She mentioned in her complaint that opposition party and his
family start to compel fulfil their demands. When she said that
her family is not well enough to fulfil their demands, opposition
party threatened to lost her life.
15/12/2011 When complainant family refused to fulfil opposition party’s
demands, she expelled from her in-law house and she did start
live in her father’s house.
She mentioned in her complaint that opposition party works in
financial department as a driver. She also contented that
opposition party earn 30000 rupees per month. The relevant
facts is mentioned in para. 9 in her complaint.
She also claimed that she is not well literate to earn her
livelihoods. She also contented that her father is very poor to
afford her expenses.
11/01/2012 She mentioned in her complaint that opposition party came to
her father’s house with his family when she was alone and her
father was in field. Opposition party and his family abused her
and threatened her to kill her. She got scared and ran away from
her house to the father. Villagers also noticed her voice of
crying.
01/01/2012 Complainant’s family tried many times to compromise and
settle the disputes but opposition party refused to allow her live
in their house last time.

She requested to honorable court to allow following relief:

1. She would allow to get maintenance worth rupees 5000 per month from
opposition party’s income.
2. She should allow to get legal expenses worth 10000 rupees of her council
fees and worth 10000 rupees for her legal proceeding fees.

Written statement filed by opposition party

12/11/201 The opposition party filled his written statement against complainant’s
3 complaint.
Opposition party accepted contention of complainant that both party
got married each other at complainant’s house.
Opposition party contented that complainant’s contention is partially is
true and partially is wrong, he accepted that complainant’s father gifted
him pulser bike for complainant travelling and some households’
goods, rest part of her contention is exaggerated and is not true.

Opposition party contented that para. 3 and 4 of complainant’s


complaint is totally make of self-story and truth is that opposition
party made ideal marriage with complainant and didn’t demand any
dowry but complainant’s family gifted lot of women jewelry and
clothes voluntary, he also contented that he provided happy life to
complainant and didn’t cause any turmoil to her.
Opposition party contented that para. 5 of complainant’s complaint was
self-made story and said that he and his family never threatened to kill
her or got second marriage.
Opposition party contented that para.6 of complainant’s complaint was
totally wrong and lie and claimed that if he was greedy for dowry, he
would never make ideal marriage in first place and didn’t gifted golden
ring, watch and two sarees on ritual of ‘GOD BHARAI’.

Opposition party also gifted one golden “SETHAR’, one golden


‘MANGTEEKA’ , pair of golden rings, golden ‘mangal sootra’ , one
golden rings, one silver ‘ bichua’ , one silver anklet and 11 sarees on
day of wedding.

Opposition party also gifted one pair of golden ear rings, golden anklet
and one silver ‘BICHUA’ on day of KARVA CHAUTH in 2008.
The relevant contention mentioned in para. 5 of opponent w.s.
Opponent contented that para. 7 of complainant’s complaint was
wrong. He claimed whenever he picked her up from her father house,
she compel him to live in her father’s house and when opponent
refused to live in her father’s house she refused to obey her martial
obligations.
Opponent contented that para. 8 of complainant’s complaint was wrong
and totally hypothetical because she went to her maternal home
without any justification and she stayed there for 1 year. This shows
that the contention of wife was hypothetical andwhy she didn’t come
back to her husband’s home.
Para 9 is completely incorrect that she is student and she doesn’t have
any source of income.
Wife is practicing in salon with a income of Rs.12000 and with that she
is capable of maintaining herself.
Para 13 is incorrect because the complainant hometown is Sitapur and
her marriage was solemnized in Sitapur and thus her complain must be
rejected.
