DEED OF ABSOLUTE SALE OF REAL PROPERTY

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF ABSOLUTE SALE OF REAL PROPERTY (“Deed”), made and


entered into this ___day of _______________________, in Kalibo, Aklan, by and
between:

PABLO Q. MAGALLANES, Filipino, of legal age, and a resident of P-6 C.


Laserna St., Kalibo, Aklan, hereinafter referred to as the “SELLER”;

-AND-

SPOUSES FELICIANO T. CASTILLO AND CHARITO B. CASTILLO, of


legal ages, Filipinos, and a residents of Poblacion, Kalibo, Aklan hereinafter
referred to as the “BUYER”.

WITNESSETH, that-

WHEREAS, the SELLER is the owner of a parcel of residential lot with house
identified as Lot No. 1945-B-3-A with TD No: 17-01-006-04880 and PIN 038-01-006-
05-160 located at New Busang, Kalibo, Aklan with TCT No: 087-2021000030 and an
area of three hundred thirty two square meters (332 sq.m.). Attached as Annex “A” is a
copy of the Tax Declaration and Annex “B” is a copy of the Transfer Certificate of Title;

WHEREAS, the SELLER desires to sell the whole area of Lot 1945-B-3-A with
house pertaining to an area of three hundred thirty two square meters (332 sq.m.) and
the BUYER is willing to buy the said house and lot, particularly with the following
boundaries and house:

North: NE-Lot 1945-b-4


East: SE-Lot 1945-A
South: SW-Lot 1945-B-3-B
West: NW-Lot 1945-B-1

House: Light Gray, Blue Roof, and made of concrete; Bungalow.

NOW THEREFORE, for and in consideration of the foregoing premises, the


SELLER has agreed to sell, transfer and convey Lot 1945-B-3-A with house to the
BUYER, subject to the following terms and conditions, to wit:
Section 1. PURCHASE PRICE. The purchase price for the house and lot consisting of
three hundred thirty two square meters (332 sq.m.), more or less, is FIVE HUNDRED
FIFTY THOUSAND PESOS (P 550,000.00), Philippine Currency.

Section 2. CAPITAL GAINS TAX, DOCUMENTARY STAMP TAX, TRANSFER FEE,


REGISTRATION FEES, NOTARIAL FEES AND OTHER INCIDENTAL EXPENSES. All
taxes and other expenses i.e. Capital Gains Tax, Documentary Stamp Tax, transfer tax,
registration fees, and, broker’s commission, notarial fee, shall be for the account of the
SELLER and BUYER in equal portions.

Section 3. WARRANTIES, REPRESENTATIONS and UNDERTAKING. The SELLER


represents and warrants that he is the absolute, and legal owner of the house and lot,
that he can validly and legally sell and transfer the ownership of the house and lot to the
BUYER in accordance with Philippine law and the terms of this final Deed of Sale free
from all claims, liens and encumbrances.

Section 4. MISCELLANEOUS PROVISIONS

4.1. . The BUYER shall take possession of the house and lot upon execution of
this Deed and may exercise all acts of ownership appurtenant thereto as expressly
provided by law.

4.2. That MRS. CHARITO B. CASTILLO shall sign this Deed acting under a
General Power of Attorney attached as Annex “C”.

IN WITNESS WHEREOF, the parties have hereunto set their hands on the date
and the place first above written.
